MINUTES OF THE REGULAR MEETING OF THE
BOARD OF FIRE COMMISSIONERS AND THE
TOWN BOARD OF THE TOWN OF MAMARONECK,
HELD ON THE 2ND DAY OF MAY 1984, IN
THE AUDITORIUM OF THE TOWN CENTER,
VILLAGE OF MAMARONECK.
CALL TO ATTENTION - Location of Exits
Supervisor Battalia pointed out to those assembled the location
of exits in the Auditorium as required by law for public
gatherings.
BOARD OF FIRE COMMISSIONERS
The meeting was called to order by Commissioner Battalia at
8:20 P.M. in the Auditorium.
Present were the following, representing all members of the
Commission:

1. Claims
Commissioner Amlicke presented fire claims for authorization of
payment and, on his motion which was seconded by Commissioner
Silverstone, it was unanimously
RESOLVED, that this Commission hereby

ADJOURNMENT
There being no further business to come before this Commission,
on motion by Commissioner Silverstone, seconded by Commissioner
Bloom, it was unanimously declared that this meeting be adjourned
at 8:28 P.M.
CONVENE REGULAR MEETING
On motion duly made and seconded, it was unanimously resolved that
the Regular Meeting be convened.
Present were the following, representing all members of the Board:

At this time Supervisor Battalia changed the order of the agenda,
read and presented the Police Week and Police Officer Memorial
Day Proclamation to Police Officer Jack Thompson, President of
the P.B.A. Mrs. Battalia stated that the police have served this
community in an exemplary manner and that the Board was pleased
to honor them in this way. Patrolman Thompson thanked the Board,
noting that Town residents have been quite generous to the P.B.A.
and added that it has been a pleasure to serve this community.
He then introduced the other policemen in attendance: Lt. Thomas
Mahoney, Sgt. Paul Munch, Patrolman John Pfoh and Sgt. Louis
Mosiello.
The Supervisor presented Police Chief Baumblatt's regrets that" a
prior committment precluded his attendance at the time his
Department was being honored.
PUBLIC HEARING: Overnight Parking Ordinance
On motion by Councilman Bloom, seconded by Councilwoman Silverstone,
it was unanimously

RESOLVED, that the Public Hearing be,
and it hereby is, declared open.
Council Bloom reviewed the most recent events relative to
overnight parking, including information about the questionnaire
circulated by the Traffic Committee. The following persons then
addressed the Board relative to the overnight parking ordinance:

George and Elizabeth Quinlan, 20 Rockland Avenue, Town

Ruth Campanelli, 7 Barnum Road, Town
Alison Renson, 1088 Palmer Avenue, Town
Rachel Schper, 15 Overlook Terrace, Town
Lauren Tait, 17 North Chatsworth Avenue, Town
Mike Tanney, 60 Mohegan Road, Town
Gail Kelly, 1076 Palmer Avenue, Town
Richard Mari, Larchmont Acres, Town

The following aspects of the matter being addressed were discussed:
-parking on the thruway access roads
-alternate side of the street parking for street
cleaning purposes
-objections to increased parking on Palmer Avenue
due to the creation of increased hazardous
conditions because view from driveways will
be blocked
-tax rebate to businesses allowing apartment dwellers
to park on their property
-manner in which to proceed in order to have a street
added to list of exemptions
-severity of parking conditions in and around the
apartment complexes
-circumstances encountered by various residents in
obtaining a parking space
-individual situations encountered by multi-car families
-pros and cons of continuing with the overnight parking
ban
-allowing parking overnight at Central School off
Palmer Avenue
Each of the Board members commented on the subject matter, noting
their concern for the apartment dwellers and thereafter, following
Supervisor Battalia's expressions of appreciation, on behalf of
the Board, to the members of the Traffic Committee and Councilman
Bloom, she reiterated the need for appointees to the recently
formed Tenants Council and urged that resumes be forwarded to
her office.
On motion by Councilwoman Silverstone, seconded by Councilman
Amlicke, it was unanimously
RESOLVED, that the Public Hearing be,
and it hereby is, declared closed.
Thereafter, on motion by Councilman Bloom, seconded by Council-
woman Silverstone, it was unanimously

RESOLVED, that the Town Board of the Town of
Mamaroneck, by virtue of the authority granted
to it, does hereby establish the following
traffic regulations:
No parking shall be allowed on any streets within
the Town of Mamaroneck between the hours of 3:00
a.m. and 6:00 a.m. except as follows:
1. The north side of Dillon Road between Parkland
Avenue and Edgewater Place;
2. The south side of Locust Terrace between the
intersection of Parkland Avenue and seventy-
five feet east of the intersection of Locust
Terrace with Parkland Avenue;
3. The south side of Copley Road between the
intersection of Alden Road and Copley Road and
one-hundred-fifty feet east from said intersection;
4. The south side of Lester Place;
5. The east side of Cabot Road;
6. The east side of Thompson Place;
7. The east side of Richbell Road;
8. Garit Lane for its entire length on both sides;
9. Valley Road for its entire length on both sides;
10. Alden Road between Harmony and Boston Post Road
on west side;
11. Plymouth Street for fifty feet east from the
intersection of Plymouth and Winthrop;
12. Baldwin Avenue on the south side exclusive of the
circle with front end to curb;
13. South side of Laurel Avenue from Thompson Place east;
14. Burton Road on the east and west side;
15. The west side of Richbell Road between Palmer Avenue
and the Village of Mamaroneck Village line;
II/ 16. The east side of Palmer Avenue from the Central School
driveway to the Village of Mamaroneck Village line;
17. The north side of Chatsworth Avenue from Myrtle
Boulevard to Jefferson Street;
and be it further
RESOLVED, that this ordinance is subject to the
provisions of the Traffic Regulation regarding Snow
Emergency Streets promulgated on December 14, 1970,
by the Police Commission of the Town of Mamaroneck,
a copy of which is annexed hereto;
and it is further
RESOLVED, that this regulation shall supersede any
previously enacted regulations relating to overnight
parking between 3:00 and 6:00 A.M.
The following streets will be designated as snow emergency streets
upon which there will be no parking at any time during a declared
snow emergency and any vehicles parked thereon will be subject to
being towed away at the expense of the owner. Any accumulation of
snow exceeding 2 inches shall be considered a snow emergency.

The Chief of Police or whoever may be acting in his absence is
• hereby authorized to declare a snow emergency.

APPROVAL OF MINUTES
The minutes of the Special Meeting of February 17, 1984, were
presented and on motion by Councilman Lerman, seconded by
Councilman Amlicke were unanimously approved as corrected.
The minutes of the Special Meeting of March 29, 1984, were
presented and on motion by Councilwoman Silverstone, seconded
by Councilman Amlicke were unanimously approved as corrected.
The minutes of the Regular Meeting of April 18, 1984, were
presented and upon request of Councilwoman Silverstone, action
on that set was tabled until the next meeting.
The minutes of the Special Meeting of April 25, 1984, were
presented and on motion by Councilman Lerman, seconded by
Councilwoman Silverstone were unanimously approved as submitted.
AFFAIRS OF THE TOWN
1. Appointment - Recreation Commission
This matter was tabled until the next meeting.
2. Resolution - Policy on Handicapped
Councilman Lerman advised that the Committee on the Disabled
endorses the policy statement under consideration and urged its
adoption. He reviewed the Federal Government's regulations
which require the adoption of such policy, and, thereafter, on
Councilman Lerman's motion, seconded by Councilwoman Silverstone,
it was unanimously
RESOLVED, that this Board hereby adopts the
following policy statement relative to
prohibiting discrimination of the handicapped:
It has been and will continue to be the policy
of the Town of Mamaroneck not to discriminate
on the basis of physical or mental handicap
with respect to access, or participation in its
activities and programs.
The Town shall also not discriminate against
qualified individuals with a handicapping
condition in any aspect of the employer/employee
relationship, including, but not limited to:
recruitment, promotion, demotion, transfer,
compensation or termination.
Further, the Town shall conduct a self
evaluation of its programs and facilities and
endeavor to eliminate any non-structural or
structural barriers that may exist.

The responsibility for compliance with State
and Federal regulations prohibiting discrimination
against the handicapped shall be vested in the
Office of the Town Administrator of the Town
of Mamaroneck. The Office of the Town Admin-
istrator shall establish a grievance procedure
that incorporates standards for the prompt
resolution of complaints alleging handicapped
discrimination.
and be it further
RESOLVED, that this policy statement shall be
publicized in a manner to accommodate those
with visual and hearing impairments.
3. Report on Town Center
Counsel to the Town, Steven Silverberg, reported on his research
and the opinions of the Building Inspector and Town Engineer with
respect to the renovations and the Environmental Quality Review
Act. He stated that the proposed work on the building will
constitute a Type II action; it will not be necessary for the
Town to file an Environmental Assessment Form; the Town will not
have to obtain a building permit or other approvals from the
Village of Mamaroneck; that the Town should consult with the
Mamaroneck Village Building Department and that the necessary
State Departments be contacted.
4. Approval - Bonding Resolution - Cost of Renovation Town Center
The following resolution was offered by Councilman Bloom who moved
its adoption, seconded by Councilwoman Silverstone,
to wit:
BOND RESOLUTION DATED MAY 2, 1984.
A RESOLUTION AUTHORIZING THE RECONSTRUCTION OF THE
TOWN CENTER OF THE TOWN OF MAMARONECK, WESTCHESTER
COUNTY, NEW YORK, AUTHORIZING THE ISSUANCE OF
$3,800,000 SERIAL BONDS AND THE EXPENDITURE OF
$200,000 CURRENT FUNDS OF SAID TOWN TO PAY THE COST
THEREOF.
BE IT RESOLVED, by the Town Board of the Town of
Mamaroneck, Westchester County, New York, as follows:
Section 1. The reconstruction by the Town of Mamaroneck,
Westchester County, New York, of the town hall of said
Town, commonly known as the Town Center, including
original furnishings, equipment, machinery or apparatus
required for the purposes for which such building will
be used, at a maximum estimated cost of $4,000,000 is
hereby authorized.
Section 2. The maximum estimated cost of the aforesaid
specific object or purpose is $4,000,000, and the plan
for the financing thereof is as follows:
a) By the issuance of $3,800,000 serial bonds of

said Town, hereby authorized to be issued
therefor pursuant to the Local Finance law; and
b) By the expenditure of $200,000 current funds
of said Town hereby appropriated therefor.
Pursuant to Section 107.00 of the Local
Finance Law, such current funds will be expended
prior to the issuance of the bonds herein
authorized or bond anticipation notes. Such
current funds shall constitute the down payment
required by Section 107.00 of the Local Finance
Law.
Section 3. It is hereby determined that the Town Center
will constitute a Class "A" building within the meaning
of subdivision 11(a) of paragraph a of Section 11.00
of the Local Finance Law when reconstructed substantially
pursuant to the plans therefor now on file in the
office of the Town Clerk, and that the period of
probable usefulness of the aforesaid specific object
or purpose is twenty years, pursuant to subdivision
12(a) (1) of paragraph a of Section 11.00 of the Local
Finance Law. It is hereby further determined that the
maximum maturity of the serial bonds herein authorized
will exceed five years.
Section 4. Subject to the provisions of the Local
Finance Law, the power to authorize the issuance of
and to sell bond anticipation notes in anticipation of
the issuance and sale of the serial bonds herein
authorized, including renewals of such notes, is hereby
delegated to the Supervisor, the chief fiscal officer.
Such notes shall be of such terms, form and contents,
and shall he sold in such manner, as may be prescribed
by said Supervisor, consistent with the provisions of
the Local Finance Law.
Section 5. The faith and credit of said Town of
Mamaroneck, Westchester County, New York, are hereby
irrevocably pledged to the payment of the principal of
and interest on such obligations as the same respectively
become due and payable. An annual appropriation shall
be made in each year sufficient to pay the principal of
and interest on such obligations becoming due and payable
in such year.
Section 6. The validity of such bonds and bond
anticipation notes may be contested only if:
1) Such obligations are authorized for an object or
purpose for which said Town is not authorized to
expend money, or
2) The provisions of law which should be complied with
at the date of publication of this resolution are
not substantially complied with,
and an action, suit or proceeding contesting such
validity is commenced within twenty days after the
date of such publication, or
3) Such obligations are authorized in violation of
the provisions of the Constitution.

Section 7. Upon this resolution taking effect, the
same shall be published in full in The Daily Times,
the official newspaper, together with a notice of the
Town Clerk in substantially the form provided in Section
81.00 of the Local Finance Law.
Section 8. This resolution is adopted subject to
permissive referendum in accordance with Section 35.00
of the Local Finance Law.
The question of the adoption of the foregoing resolution was duly put
to a vote on roll call which resulted as follows:

The resolution was thereupon declared duly adopted.
5. Resolution re membership - N.Y.S. Thruway Authority Board
Supervisor Battalia reviewed her discussion with Assemblyman
Perone regarding legislation to expand the above captioned Board
from three to five members. She further stated that since this
Board should push for representation on that Board since we are
plagued with constant problems on that roadway.
Following a brief discussion in which it was noted that the
Governor will make the appointments with the approval of the
legislature and the rate of pay enumerated, on motion by
Councilwoman Silverstone, seconded by Council Bloom, the following
resolution was unanimously adopted:
WHEREAS, it has become increasingly apparent
that Westchester County should provide input
into the decision-making body of the New York
State Thruway Authority;
and
WHEREAS, Assemblyman John Perone and Senator
Joseph Pisani have introduced legislation to
appoint a resident of the County of Westchester
as a member of the New York State Thruway
Authority Board;
Now, therefore, be it
RESOLVED, that this Board hereby supports and
urges the passage of Assembly Bill No. 9668 and
Senate Bill No. 8153, an Act to amend the
Public Authorities Law in relation to membership
of the New York State Thruway Authority Board.
WRITTEN COMMUNICATIONS
There were no written communications to come before the Board.

ORAL COMMUNICATIONS
A resident's suggestion that lines be painted to delineate the
parking spaces on Richbell Road was referred to the Traffic
Committee.
THE SUPERVISOR
1. Regular Reports
a) Supervisor Battalia announced that County Executive Andrew
O'Rourke will be at the Rye City Hall on May 8th to address
the matter of the County sales tax proposal.
b) Mrs. Battalia reported that she has written to Congressman
Ottinger protesting the transportation of radioactive toxic
waste materials along the Thruway without prior notification
to local officials.
c) Mrs. Battalia reported that the Larchmont Village Board of
Trustees and the Town of Mamaroneck Town Board will hold an
informational meeting on the proposed Westchester County
takeover of the Town's transfer station on Thursday, May 3,
at 8:30 P.M. in the Larchmont Village Center.
d) The Supervisor announced that the Town Board will hold an
agenda meeting at 6:30 P.M. in the Supervisor's Office of
the Town Center on Wednesday, May 9th.
e) Supervisor Battalia announced that several vacancies exist
on various Boards and Commissions such as the Library Board,
C.A.C. , etc. and urged interested persons to submit resumes.
At this time, Item #2 under THE SUPERVISOR was taken up
2. Proclamations:
a) Mental Health Month
Pursuant to presentation by Councilman Bloom and on his
motion which was seconded by Councilwoman Silverstone, the
Supervisor was authorized to issue the following proclamation:
P R O C L A M A T I O N
MAY 1984 - MENTAL HEALTH MONTH
WHEREAS, the pressures and stresses experienced in today's
climate present a serious and costly threat to the
general health of the American people, affecting
each and everyone of us to some degree;
and
WHEREAS, stress can result not only in depression, anxiety,
emotional disorders and damaging physical health;
and

WHEREAS, rising health care costs make it even more
imperative that we pursue the goals of good
mental health and the prevention of mental
and physical illness;
Now, therefore, be it
RESOLVED, that the Town Board of the Town of Mamaroneck
urges that during May, Mental Health Month,
citizens cooperate with the Mental Health
Association of Westchester County by emphasizing
ways to recognize, reduce, and deal with stress
by supporting the Association in its efforts to
help the community become knowledgeable about
mental health issues and to provide a wide and
varied range of services for the mentally ill.

b) National Volunteer Week
Upon presentation by Councilwoman Silverstone, and on her
motion seconded by Councilman Bloom, the Supervisor was
authorized to issue the following proclamation:
P R O C L A M A T I O N
WHEREAS, the Town of Mamaroneck recognizes the vital role
its volunteers play in making and keeping our
Community a good place in which to live,
and
WHEREAS, they, through their generous contribution of
time and energy, provide those services so
essential to the comfort and well-being of the
many who need them,
Now, therefore, be it
RESOLVED, that to appropriately commemorate the work of
our volunteers and their tireless efforts, the
week of May 7th through May 12th, 1984, is hereby
designated
Volunteer Recognition Week in the Town of Mamaroneck
and be it further
RESOLVED, that I, Dolores A. Battalia, Supervisor of the
Town of Mamaroneck, do hereby honor and acclaim all
those who have made it possible to establish and
develop various programs in the Town, and urge that
all of our citizens who can, participate in the
continuance of these invaluable services.

Supervisor Battalia took this opportunity to congratulate Tony
Fava for being honored on a County-wide basis for his volunteer
service to the community.
REPORTS OF THE COUNCILMEN AND THE COUNCILWOMAN
Councilwoman Bloom reported on the following:
1) the organizational meeting of the Human Rights Commission
held on Wednesday, April 25th in the Supervisor's Office.
2) the meeting of the Traffic Committee held on Monday,
April 30th in the Auditorium of the Town Center.
3) the meeting of the Cable T.V. Control Board held on May 1st
at the Village Center in Larchmont, at which time Ira
Birnbaum, Manager of UACC of Westchester, was in attendance
and various exchanges were made on issues such as the tax
offset and rate increases.
Councilman Amlicke requested updated information on the Olympic
Torch caravan passing through this area and the status of the
meeting between school and town respresentatives. Both Town
Administrator Stephen Altieri and Councilwoman Silverstone
provided Mr. Amlicke with said information.
Councilwoman Silverstone reported on the following:
1) the submission by each Board member of the scope of
responsibility for the members of the Joint Planning
Committee, which precipitated some discussion relative to
appointments, size of the committee as well as a charge to
the group.
2) the communication from the Automobile Association requesting
support for the proposal that the drinking age be raised to
twenty-one years of age.
3) the proposal to renovate the Town Center and said plans and
noted that arrangements for the move out of the building
during the renovation are being looked into. She also stated
that presentations will be made to the staff during the month
of May.
Councilman Lerman reported on the following:
1) the planning Board meeting of Wednesday, April 25th.
2) the April 30th meeting of the Committee on the Disabled.
3) the first public meeting of the Coastal Zone Management
Committee on April 26th.
Councilman Bloom noted that the Sarah Neuman Nursing Home will be
holding a fair, the proceeds of which will benefit the Rescue Squad,
on Saturday, May 12th and urged all to attend.

There being no further business to come before this Board,
on motion by Councilman Amlicke, seconded by Councilwoman
Silverstone, this meeting was adjourned at 10:46 P.M.
