HomeMy WebLinkAbout1957_01_07 Planning Board Minutes MINUTES OF A MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK, HELD JANUARY 7, 1957, AT POLICE HEAD- QUARTERS, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. CALL TO ORDER The Chairman called the meeting to order at 8:30 p. m. PRESENT: Mr. Fred L. Maggini, Chairman Mr. G. Norman Blair Mr. Henry E. Mullick Mr. Joseph Rigano ABSENT: Mr. John F. O'Conor Also Present: Town Engineer Friedlander APPROVAL OF MINUTES On motion by Mr. Mullick, seconded by Mr. Blair, the minutes of the previous meeting held December 3, 1956, were approved as presented. COMMUNICATION - BROWN, CROSBY & CO. INC. The Secretary presented a letter from Brown, Crosby & Co. Inc. , 96 Wall Street, New York 5, dated December 13, 1956, consenting to extension of time to May 1, 1957 for the completion of work covered by Subdivision Bond No. 251372, Indemnity Insurance Co. of North America. The letter was received and filed. PUBLIC HEARING - RE SUPPLEMENTAL REGULATIONS APPLYING TO SUBDIVISIONS FILED PRIOR TO OCTOBER 19, 1955 The Secretary presented the Affidavit of Publication of the Notice of Public Hearing which was published in the Daily Times on December 31, 1956. -90- The Chairman declared the Hearing open and inquired whether anyone present wished to be heard. Mr. Jerome N. Wanshel, Attorney, addressed the Board, stating that he was opposed to any provisions in these Regulations allowing this Board to waive any requirements. There being no one else who wished to be heard, on motion duly made and seconded, it was unanimously RESOLVED, that the Public Hearing on the Supple- mental Requirements, be and it hereby is closed. After further discussion, on motion by Mr. Mullick, seconded by Mr. Rigano, it was unanimously RESOLVED, that this Board hereby approves the "Supplemental Requirements of the Town of Mamaroneck Planning Board, relating to subdivisions for which plats or maps have been filed prior to October 19, 1955", prepared by this Board and published in the form of a Notice of Public Hearing for this meeting; and IT IS HEREBY DETERMINED AND STATED, that the "Supplemental Requirements " contained in said Public Notice shall constitute said rules of procedure relating to subdivisions filed prior to October 19, 1955; FURTHER RESOLVED, that the "Supplemental Re- quirements of the Town of Mamaroneck Planning Board relating to subdivisions for which plats or maps have been filed prior to October 19, 1955", be and they hereby are referred to the Town Board for its approval in accordance with Section 272 of the Town Law. PUBLIC HEARING - PROPOSED SUBDIVISION SOUNDVIEW WOODS, INC. The Secretary presented the Affidavit of Publication of the Notice of Public Hearing published in the Daily Times on December 31, 1956. -91- The Chairman declared the Hearing open and inquired whether anyone present wished to be heard. The developers, Messrs. Charles A. Newbergh, and Joseph E. Muson, Esq. , addressed the Board requesting final approval of the plans as submitted for the subdivision, Soundview Woods, Inc. The following persons addressed the Board: Mr. Frank M. Gagliardi, Attorney, representing residents of the Bonnie Briar section stated that it was not his intention to obstruct the developers from going ahead with the development, but he felt that the map as presented must conform precisely with the preliminary plans so as to show all streets. He further stated that he must insist that the approval of any plans be withheld until such time as all the streets are shown. Mr. Jerome N. Wanshel, Attorney, also spoke and stated that the developers should present, at this time, an over-all map which would show clearly what the developers propose to do, in detail. Mr. Wanshel stated for the record: "I should like it to appear that a number of residents in the area filed a petition more than a year ago to re-zone the entire area, including the portion in which the land involved in the present application is located, and that no action has been taken on said petition except that there is pending before this Board an over-all re-zoning of the Town. Secondly, I should like it to be made very clear for the record that, in the event such re-zoning takes place, the applicant (if the application is granted) will not get any rights in the lot division and will be bound, insofar as the vacant land is concerned, by the Zoning Requirements at the time application for permission was presented. " There being no one else who wished to be heard, on motion duly made and seconded, it was unanimously RESOLVED, that the Public Hearing on the application of Soundview Woods, Inc. , be and it hereby is closed. Following a general and lengthy discussion, during which the matters of means of ingress and egress, incompleted bridge plans, etc. , were discussed, the Town Attorney pointed out that this Board should also give consideration to offers of dedication of streets, -92- such easements as may be required for drainage, completed bridge plans, etc. , prior to granting any approval. In view of the fact that complete information with regard to the above mentioned matters was not submitted to this Board by the developers at this time, it was on motion duly made and seconded, unanimously RESOLVED, that the proposed Plat or Subdivision Plan as shown on Subdivision of Property Belonging to Soundview Woods, Inc. , in the Town of Mamaroneck, Westchester County, N. Y. , made by James P. Ward, 107 Boston Post Road, Larchmont, N. Y. , N. Y. S. License No. 18922, and dated December 21, 1956, County Block 3106 and 3956, Sheet No. 36, is hereby rejected. FURTHER RESOLVED, that this resolution should be without prejudice to the submission of a revised or corrected map of this subdivision. RE PRELIMINARY REPORT OF PLANNING CONSULTANT The Chairman advised the members of the Board that he had been in touch with Mr. Fred P. Clark, Planning Con- sultant to this Board, and ascertained that Mr. Clark was ready to submit his preliminary report , in connection with Mr. Clark's proposal of work. Upon suggestion of the Chairman, the Board, together with the Town Engineer, Town Attorney, and Councilman Kane, agreed to meet with Mr. Clark on Thursday, January 10, 1957, at 8 p. m. , in the Council Room of the Weaver Street Fire House, Town, to hear Mr. Clark's report.
