Meeting; of the Town Board
TOWN OF MAMARONECK
held December 26, 1924.
The meeting was called to order by Supervisor
Burton at 11. 20 P.M.

The minutes of the meetings of October 15th,
October 17th, November 10th and November 19th were read,
and upon motion, duly seconded, approved,
Mr. Sutton of Edgewood Road appeared before the
Board and objected to the rgno°ring of the present Police
Station from its present site to its new site on Edgewood
Road and suggested- the acquiring and purchasing of property
at the corner of Weaver and hillcrest Avenues and moving
same thereon. After discussing the matter, it was upon
motion, duly seconded

Communications from the Board of Appeals were
received and read, advising the Board that at the meetings
of the Board of Appeals held on December 4th, the application
of F. William Shaefer to erect a one family residence with
garage attached on the northeast corner of Chatsworth Avenue
and Lookout Circle within thirty(30) feet of Chatsworth Ave-
nue was granted; and that at its meeting held December 18th
the application of John Haman to erect a one family residence
on the east side of Maplewood Street; the application of the
Harioo Corporation and the Larchmont Gables Company Inc. , to
erect an apartment house on the northwest corner of Boston
Post Road and Arden Road; the application of James A.Isbister
to erect a one family residence on the westerly corner of
Echo Lane and Lookout Circle ; the application of Charles
Santoro to erect a one family residence on the northwest
corner of Harmon Drive and 'ffindsor Street, were granted by
said Board; Whereupon the following resolutions ,were presented
and unanimously adopted:

and that the decision of the Building Commis-
ion be reversed., provided that no part of
said building be within 30 feet of Lookout
Circle and 15 feet of Chatsworth Avenue, there-

RESOLVED, that the Town Board pursuant to
Article 5, Section 26 of the Town Lav:, hereby
consents to and confirms the action of the
Board of Appeals in reversing the decision
of the Building Commission.-
WHEREAS, the Board of Appeals has recommended
to the Town Board that the application of
John Hagman to erect a one family residence
on the east side of Maplewood Street, within
30 feet of the street lines, be granted and
that the decision of the Building Commission
be reversed, provided that the front wall of
the building proper shall be no nearer the
street than the front wall of the house on
either side and that the steps shall be no
nearer the street than 25 feet, thereforf, be it
RESOLVED, that the Town Board pursuant to
Article 5, Section 26 of the Town Law, hereby
consents to Ind confirms the action of the
Board of Appeals in reversing the decision of
the Building Commissions
WHEREAS, the Board of Appeals has recommended
to the Town Board that the application of the
Harmoo Corporation and the Larcnnont Gables
Company Inc ., to erect an apartment house on
the northwest corner of Boston Post Road and
Arden Road in an unclassified district be
granted and that the decision of the Building
Commission be reversed, provided that the
building conform to the requirements of a
class "A" district as to set back and percent-
age of lot occupancy and be erected as shown
on the plot plan filed, therefore be it
RESOLVED, that the Town Board pursuant to
Article 5, Section 26 of the Town Law, hereby
consents to and confirms the action of the
Board of Appeals in reversing the decision of
the Building Commission,
WHEREAS, the Board of Appeals has recommended
to the Town Board that the application of
James A.Isbister to erect a one family resi -
dence on the westerly corner of Echo Lane and
Lookout Circle within 30 feet of Lookout
Circle, be granted and that the decision of
tie Building Commission be reversed, provided
tkgt the building be no nearer than 30 feet
to Echo Lane and 17 feet to Lookout Circle,
therefore be it
RESOLVED, that the Town Board pursuant to
Article 5, Section 26 of the Town Law, hereby
consents to and confirms the action of the
Board of Appeals in reversing the decision of
the Building Commission.
WHEREAS, the Board of Appeals has recommended
to the Town Board that the application of
Charles Santoro to erect a one family residence
on the northwest corner of Harmon Drive and
:Windsor Street within 30 feet of Windsor Street,
be granted and that the decision of the Building
Commission be reversed, provided that the bu.ild-

ing be no nearer than 30 feet to Harmon Drive
or 15 feet to i ndsor Street, therefore be it
RESOI:VED, that the Town Board pursuant to
Article 5, Section 26 of the Town Law, hereby
consents to and confirms the action of the
Board of Appeals in reversing the decision of
the Building Commission.
A communication was also received from the Board of
Appeals requesting the gathering toget-her of all amendments
to the Zoning Ordinance and 'having them printed and inserted
and copies of the Ordinance that are now being distributed.
The Clerk was requested to ask the members of the Board of
Appeals to send a representative of their body to appear at
the next meeting of the Board for the purpose of receiving
suggestions as to changes they are contemplating in the pre-
sent zoning code.

The following resolution was presented by Justice
Collins, seconded by Justice Boyd., and upon roll call was
unanimously adopted:
WHEREAS, this Board has received from the
Receiver of Taxes of this Town, his state®
men+ under the provisions of Section, 28 of
the "Nestchester County Tax Act, from which
it appears that on December 1, 1924, the
sum, of $15, 064.45 was still outstanding and
unpaid for State and County Taxes levied
on April 1, 1924, and
WHEREAS, the Supervisor has requested this
Board to authorize the issuance and sale of
a temporary certificate of indebtedness for
the sum of $15,064. 45, being the amount re-
ported by the Receiver of Taxes as uncollect-
ed and outstanding on December 1, 1924, as
aforesaid.
NOVA, THEREFORE, be it
RESOLVED, that pursuant to the provisions of
the Westchester County Tax Act, the Supervisor
be and he hereby is authorized and empowered
to borrow upon the faith and credit of the
Toar? of Mamaroneck, the sum of $15, 064.45 for
which sum he shall issue in the name and under
the seal of said Town against uncollected State
and County taxes levied on April 1, 1924, one
or more certificates of indebtedness, each of
such denomination as the Supervisor may deter-
mine, which shall bear interest at a rate of
not more than 6fd per annum and shall be
made payable at such time as the Supervisor
may fix, but not later than December 1, 19255,
Said certificate of indebtedness shall be
signed by the Supervisor and countersigned
by the Town Clerk. And. be it further
RESOLVED, that the Supervisor be and he
hereby is authorized and empowered to die-
of said certificate of indebtedness
for not less than the par value thereof.
And be it further
RESOLVED, That the Supervisor and Town. Clerk
be and they hereby are authorized and em-
powered to sign and execute such papers as
may be necessary to affect the sale of said
Certificates .
Mr. Dudley moved and Mr. Collins seconded the adoption of
the following resolution :
AREAS the Tovm Board of the Town of Mamaroneck
has, in the manner provided by law and by resolution dated
June 11, 1.923, extended Sewer District No . 1 of the Town of
Mamaroneckk; and
9PI-IFLREAS the Board of Sewer Commissioners of Sewer
District No. 1 of the Town of Mamaroneck has heretofore filed
in the office of the Town Clerk a map and plan of such Dis-
trict, as extended and as required by law, and has reported
to the Town! Board the amount of cost of construction of Sect—
ien 7 and Section 8 cf the Sewer System, respectively, deter-
mined as required by law, the said report of said cost read-
ing as follows :

We beg to advise you that this Commission has recent-
ly opened bids for the construction of Contract No . 7 of the
Seger System in Sewer District No . 1 of the Town of Mamaroneck,
Based on these bids, we herewith respectfully reliort to you
that the amount of cost of construction of Contract No . 7 of
the Sewer System in Sewer District No . 1 of the Town! of Mamaro-
neck, including engineers' fees and otter necessary expenses
in connection therewith, will be $40,000 .
On November 24® 1.924, this Commission also opened
bids for the construction of Contract No . 8 of the Sewer System
in Sewer District No. 1. of the Town of Mamaroneck, Based on
these bids, we herewith respectfully report to you that the
amount of cost of construction of Contract No. 8 of the Sewer
System in Sewer District No . 1. of the Town of Mamaroneck,
including en€rineersa fees and other necessary expenses in
connection therewith, will be $60, 000.
We therefore respectfully request that you
immediately authorize and direct the issue and sale of bonds
for the amount required in connection with these two con-
tracts, to wit, 0100, 000.

NOW, THEREFORE, BE IT RESOLVED by the Town: Board of
the Town of Mamaroneck:
1. $1006000 . Sewer District Bonds of the Tows: of
Mamaroneck shall be issued pursuant to the provisions of the
Town Law, constituting Chapter 62 of the Consolidated Laws of
the State of New York, and Chapter 422 of the Laws of 1922
of the State of New York. Said bonds shall be dated January
1, 1925, shall bear interest at the rate of four and one quarter
per centum (4-1/4%) per annum, payable semi-annually or, Janu-
ary lot and July 1st, in each year, and shall be one hundred
and twenty in number, numbered 1 to 120 , inclusive. Eighty of
said bonds shall be of the denomination of $ 1, 000 . each, and
forty of said bonds shall beef the denomination. of 6W500.
each. Said bonds shall mature, $p2, 500 . on January lst in each
of the years 1930 to 1969, irclusive, and shall be substantially
in the following form:

elusive, maturing in order as numbered, $2, 500 on January let,
in each of the years 1930 to 1969, inclusive, issued pursuant

to the provisions of the Town Law constituting Chapter 62

2. The Town of Mamaroneck hereby covenants to pay
the principal and interest of the said bonds as the same shall
become due by levying and collecting an assessment or assess-
ments on property of the district at such time or times and
in such amounts as may be necessary therefor, The Town of
Mamaroneck further covenants that in case of a default in
carrying out the terns of the foregoing covenant the said Town
will raise by tax upon all the taxable property in said Town
from time to time a sum or sums sufficient to pay the princi-
pal and interest of said bonds as the same may be or shall
become due.
3. The said bonds authorized by this resolution
-- shall be sold upon sealed proposals upon notice published not
less than five or more than thirty days before such sale, at
least once in The La,rchmont Times, #gich is designated the
official newspaper of said Town for the purpose of such publi®
cation, and also in The Daily Bona. Buyer, a financial news-
paper published in the City of New York. Said notice of sale
shall be substantially in the following form:

$100, 000 . SEWER DISTRICT BONDS
Sealed proposals will be received by the Town
Board of the Town of Mamaroneck on January 14, 1925, at 8 :30
P.M. o'clock, at No. 8 Elm Street, Mamaroneek, -New York, for
the purchase of $100, 000. Sewer District Bonds of said Town.
Eighty of said bonds will be of the denomination of $1, 000 .
each, and forty of said bonds will be of the denomination of
$500. each. Said bonds will be dated January 1, 1925, and
will mature, $2, 500. on January let in each of the years 1930
to 1969, inclusive .
Said bonds will bear interest at the rate of four
and one quarter per centum (4-1/4%) per annum, payable semi-
annually on January 1st and July lst of each year . Both
principal and interest will be payable in lawful money of the
United States of America at the office of The United States
Mortgage & Trust Company, New York City. The bonds will be
coupon bonds, with the privilege of registration as to both
principal and interest.
The right is reserved to reject all bids and any
bid not complying with the terms of this notice will be re-
jected.
The bonds will not be sold for less than oar and in
addition to the amount bid the successful bidder must pay
accrued interest at the rate borne by the bonds from the date
- of the bonds to the date of payment of the purchase price.
All bidders are required to deposit a certified
check payable to the order of the Town of Mamaroneck for two
per centum (20) of the amount of bonds bid for, drawn upon
an incorporated bank or trust company. Checks of unsuccess-
ful bidders will be returned upon the award of the bonds.
No interest will be allowed upon the amount of the check of
a successful bidder and such check will be retained to be
applied in part payment for the bonds or to secure the Town
against any loss resulting from the failure of the bidder to
comply with the terms of his bid.
The bonds will be prepared under the supervision of
the United States I'dortgage & Trust Com_oany, which will certify
as to the genuineness of the signature of the officials and
the seal impressed thereon.
Bids are desired on forms which will be furnished
by said Trust Company or by the undersigned.
Proposals should be addressed to the Town Clerk,
Mamaroneck, New York, and enclosed in a sealed envelope marked
on the outside "Proposal for Sewer Bonds " ,
The successful bidder will be furnished with the
opinion of Messrs, Hawkins, Delafield and Longfellow, of New
York City, that the bonds are binding and legal obligations
of the Town, payable in the first instance from assessments
and not from a. general town tax, awiich, however, may be levied
if there is a shortage in the primary fund.
