OF MAMARONECK, HELD DECEMBER 3, 1956, AT POLICE HEAD-

CALL TO ORDER
The Vice Chairman called the meeting to order at 8:30 p.m.

APPROVAL OF MINUTES
On motion by Mr. Blair, seconded by Mr. Mullick, the
minutes of the previous meeting held November 5, 1956,
were approved as presented.
COMMUNICATIONS
A letter, dated November 21, 1956, was received from the
Indemnity Insurance Company of North America, consenting
to an extension of Subdivision Bond No. 251372, GB & EM
Realty Corporation, to December 11, 1956.
RE: SUPPLEMENTAL REGULATIONS APPLYING TO SUBDIVISIONS
FILED PRIOR TO OCTOBER 19, 1955
Town Attorney Delius discussed with the members of the Board
the matter of the adoption of supplemental regulations applying
to subdivisions filed prior to the creation of the Planning Board.
On motion by Mr. O'Conor, seconded by Mr. Mullick, it was
unanimously

RESOLVED, that the following Notice be published
in the Mamaroneck Daily Times:
PUBLIC NOTICE
PLEASE TAKE NOTICE, that the Planning Board of the
Town of Mamaroneck will hold a public hearing on the 7th day of
January 1957, pursuant to Section 276 of the Town Law to consider
the adoption of supplemental requirements for subdivision plats
filed in the Office of the County Clerk of Westchester County prior
to October 19, 1955 (the effective date of the adoption by the Planning
Board of the present requirements for the approval of subdivision
plats) and which supplemental requirements are authorized by the
amendment to Section 276 of the Town Law by Chapter 797 of the
Laws of 1956. The said proposed supplemental requirements are
as follows:
SUPPLEMENTAL REQUIREMENTS
of the
TOWN OF MAMARONECK PLANNING BOARD
relating to
SUBDIVISIONS FOR WHICH PLATS OR.MAPS HAVE BEEN
FILED PRIOR TO OCTOBER 19, 1955
Section 1. AUTHORITY
By authority of the resolution adopted by the Town Board of the Town
of Mamaroneck on June 6, 1956, pursuant to the provisions of Section
276 of the Town Law, as amended by Chapter 797 of the Laws of 1956,
the Planning Board of the Town of Mamaroneck hereby promulgates
the following supplemental requirements relating to subdivisions for
which plats or maps have been filed in the Office of the County Clerk
of Westchester County prior to October 19, 1955.
Section 2. STREETS AND ROADS NOT ACCEPTED OR DEDICATED
Approval of subdivision plats showing streets or roads which have not
been accepted or dedicated prior to January 1, 1957 will not be granted
by the Board until the subdividing owner or his agent shall:
A. In the case of subdivision streets or roads not completely
improved prior to October 19, 1955:
1. File with the Board, and obtain the Board's approval of,
a layout containing the information required by subdivisions 7,8,9,10,
11 and 12, of Section 6A of the Board's Requirements, and showing
compliance with the following sections thereof:

Section 4, Paragraph A, subdivisions 4,6, and 9.
Section 7, Paragraph A, subdivision 9.
Sections under the headings, ROUGH GRADING, FINAL
GRADING, DRAINAGE, SANITARY SEWERS, WATER SUPPLY,
PAVEMENT, CURBING
Five copies of each such layout shall be filed with the Board.
2. Comply with the provisions of Paragraph F of Section 3 of
the Board's Requirements.
B. In the case of subdivision streets or roads which have been
completely improved prior to October 19, 1955:
1. Obtain a certificate from the Engineer or other duly desi-
gnated official evidencing compliance with the sections of the Board's
Requirements under the headings, ROUGH GRADING, FINAL GRADING,
DRAINAGE, SANITARY SEWERS, WATER SUPPLY, PAVEMENT, CURB-
ING, or in lieu thereof file with the Board a bond for the completion of
such improvements complying with the requirements of Paragraph F of
Section 3 of the Board's Requirements. The last sentence of such Para-
graph F shall be applicable to all streets, and all underground utilities
to which this regulation applies.
Section 3. COMPLIANCE WITH TOWN LAW
All streets and roads to which these Supplemental Requirements apply,
and all layouts filed hereunder, and procedures relating thereto shall
comply with the provisions of Section 276 and Section 277 of the Town
Law, as amended.
Section 4. WAIVER OF REQUIREMENTS
The Board may, in specific cases waive or modify any of the above re-
quirements.
Section 5. DEFINITIONS
The terms, THE BOARD'S REQUIREMENTS, as used herein shall mean
the Requirements for the Approval of Subdivisions Plats in the Town of
Mamaroneck, effective October 19, 1955, In all other respects the
definitions contained in Section 2 of the Board's Requirements shall
apply to these Supplemental Requirements.

RE MURDOCK WOODS SUBDIVISION - BOND NO. 251372
Mr. Irwin Oster of 3 Split Tree Road, Scarsdale, N.Y.,
appeared before the Board and stated that in view of the
fact that the Town Engineer had recommended that the
Town would wait until Spring to accept that portion of
Salem Drive and Split Tree Road, which had been paved,
he requested an extension of time for completion.
On motion by Mr. Blair, seconded by Mr. Mullick, the
following resolution was unanimously adopted:
WHEREAS, this Board heretofore approved a bond of
indemnity signed by G.B. & E.M. Realty Corp. and the
Indemnity Insurance Company of North America, the con-
dition of which bond is that G.B. & E.M. Realty Corp.
shall complete the improvement of a portion of Split Tree
Road as shown on map#R.O. 9919, and more particularly
described therein on or before December 11, 1956, which
bond is for the sum of$3,000. and is dated November 11,
1956,
WHEREAS, it appears that G.B. & E.M. Realty Corp. has
been unable to complete this work in accordance with the
plans and specifications for roads and highways, adopted
by this Board June 6, 1955,
NOW, THEREFORE, BE IT
RESOLVED, that the time for the completion of the im-
provement of said Split Tree Road as required by said
bond of indemnity is extended to May 1, 1951', provided,
however, that the Indemnity Insurance Company of North
America will continue their bond until that date.
Mr. Oster further stated that the Town Engineer had re-
quested that a curb be installed in that section of Salem
Drive, and questioned the necessity of such curbing stating
that this would entail an expenditure of some $1500. --$1800.
He added that it was his understanding that the Town had ac-
cepted many roads without such curbs.

Following discussion, the Board directed that Mr. Oster
be notified that no action would be taken pending a public
hearing to be held on the adoption of Supplemental Regu-
lations applying to subdivisions filed prior to October 19,
1955.
RE GLEN ROCK ESTATES SUBDIVISION
Messrs. Glaser and Gleicher appeared before the Board
requesting consideration of the many problems these
developers are confronted with concerning the installation
of curbs, sewers, water mains, etc. in their subdivision
due to the prohibitive costs of all such installations not-
withstanding the excessive amount of rock necessitating
blasting for any installation of work.
The Board discussed this matter and no action was taken.
RE ALBERT GOULD SUBDIVISION
The Town Engineer presented a preliminary plan and profile
of proposed road as shown on Subdivision Map of Winged Foot
Knolls, Section Two, in the Town of Mamaroneck, Westchester
County, N.Y., dated October 19, 1954, and advised that said
plan and profile had been filed prior to the creation of the
Planning Board.
He further stated that the developer proposed a new location
of the turn-around with a radius of 50 feet instead of the
original turn-around which had a radius of 40 feet. The
new location of the turn-around will shorten the length of
the dead-end street.
Following discussion, no action was taken pending submission
of the final plan showing new turn-around and easement covering
entire water main.
RE PROPOSED SUBDIVISION RE PROPERTY OWNED BY EMNA A. FORBES
The Town Engineer presented a preliminary map for pro-
posed subdivision pf property belonging to Edna A. Forbes,
located on Ormand Place.

The Board examined the preliminary plan with particular
reference to the possible extension of York Road as a
through street.
Following discussion, no action was taken pending further
consideration.
There being no further business to come before the meeting, it was
adjourned at 10:30 p.m.
