HomeMy WebLinkAbout1956_08_06 Planning Board Minutes MINUTES OF A MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK, HELD AUGUST 6, 1956, AT POLICE HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. CALL TO ORDER The Chairman called the meeting to order at 8:30 p. m. PRESENT: Mr. Fred L. Maggini, Chairman Mr. G. Norman Blair Mr. John F. O'Conor Mr. Joseph Rigano ABSENT: Mr. Henry E. Mullick Also Present: Town Engineer Friedlander Town Councilman Kane PUBLIC HEARING --SUBDIVISION MAP OF SAXON PARK ESTATES The Secretary presented the Affidavit of Publication published in the Daily Times on July 31, 1956, of notice of a public hearing for this evening. The Chairman declared the hearing opened and inquired whether anyone present wished to be heard. Mr. Joseph Scarpinato was present, and no other person ap- peared in favor of or in opposition to this application. Thereupon, the hearing was closed and decision reserved. PUBLIC HEARING --SUBDIVISION MAP OF LAKEWOOD The Secretary presented the Affidavit of Publication published in the Daily Times on July 31, 1956, of notice of a public hearing for this evening. The Chairman declared the hearing opened and inquired whether anyone present wished to be heard. -65- Mr. Fred Maloof was present, and no other person appeared in favor of or in opposition to this application. The Chairman, thereupon, declared the hearing closed. On motion duly made and seconded, the following resolution was adopted: WHEREAS, Fred Maloof has heretofore filed with this Board a map or subdivision plat entitled "Map of Lakewood in the Town of Mamaroneck, Westchester County, N. Y. , made by Thomas J. McEvoy, Surveyor, N. Y. S. 21387, and dated April 18, 1956, County Block 3944, Sheet 35 and 36", in accordance with the provisions of the Town Law, and the specifications for street improvements contained in the "Requirements for the Approval of Subdivision Plats in the Town Of Mamaroneck, Westchester County, New York" adopted by this Board on October 15, 1955, together with a final layout showing streets, drains, easements, pavement, curbs, and water, together with construction drawings pre- pared in accordance with the provisions of Section 6 of the said "Requirements ", all of which have been ap- proved by the Town Engineer; and WHEREAS, a public hearing was duly held pursuant to the provisions of Section 276 of the Town Law after notice published in the Daily Times on July 31, 1956; and WHEREAS, This Board has examined the subdivision map or plat, together with other details submitted in accordance with the final layout has determined that same are satisfactory subject to the conditions hereinafter recited, NOW, THEREFORE, BE IT RESOLVED, that the subdivision map or plat entitled "Map of Lakewood in the Town of Mamaroneck, Westchester County, N. Y. , made by Thomas J. McEvoy, Surveyor, N. Y. S. 21387, and dated April 18, 1956, County Block 3944, Sheet 35 and 36", together with the specifications submitted and approved by the Town Engineer are hereby approved pursuant to the provisions of Section 276 of the Town Law to the end that the subdivision map or plat may be filed in the County Clerk's office, subject, however, to the following conditions: -66- 1. That no building permit shall be issued for the construction of houses in said subdivision until the streets shown on said map are improved in accordance with the construction drawings filed with this application, and the specifications for street improvements contained in the "Require- ments for the Approval of Subdivision Plats in the Town of Mamaroneck, Westchester County, New York" adopted by this Board on October 15, 1955, or, in the alternative, that Fred Maloof furnish a bond in the sum of $7, 500. for the completion of said improvements, such bond to run for a term of one year. 2. That Fred Maloof shall deliver to the Town Attorney deeds and/or releases for the land lying in the bed of all streets and highways as shown on such sub- division map or plat. 3. That Fred Maloof shall deliver to the Town Attorney a grant or deed of an easement through Lots 1 and 5, in the "Reserved Parcel" on said map as shown on the construction drawings. FURTHER RESOLVED, that deeds, releases, or grants, are received solely for the purpose of compliance with Section 277 of the Town Law, and Section 3 of the "Requirements ", and that the filing of same shall not constitute the dedication of any streets, highways or easements until after the approval by the Town Board, nor waive the payment of the necessary title charges and recording fees. APPROVAL OF MINUTES On motion duly made and seconded, the minutes of the meetings of July 2, 1956; July 10, 1956; and July 23, 1956, were approved as presented. -67- COMMUNICATIONS A certified copy of a resolution adopted by the Town Board at its meeting Held July 11, 1956 was received authorizing the Planning Board to retain the services of a consultant to study and make recommendations concerning the possible revision of the Zoning Ordinance of the Town of Mamaroneck. The Chairman stated that he had communicated with Planning Consultants, Frederick P. Clark, and George M. Raymond Associates, outlining the scope of the proposed study and requesting recommendations as to procedure and costs. The Chairman further stated that he thought it might be advisable to contact a third consultant. A letter dated July 27, 1956, was received from Mr. C. A.. Latimer, Chairman of the Planning Board of the Village of Mamaroneck, stating that the Village would be happy to co- operate with this Board. In reference to his communications to the Chairmen of the Planning Boards of the Villages of Larchmont and Mamaroneck, the Chairman reported that he had received a call from Mr. William Eipel, of the Village of Larchmont, advising that he was in complete agreement with the proposal to hold a joint meeting. The Chairman then stated that he would now proceed to arrange a joint meeting of the Planning Boards in the very near future. RE PROPOSED SUBDIVISION OF PROPERTY BELONGING TO EDNA A. FORBES A. letter dated July 31, 1956, was received from Mr. Arnold S. Breakey, Durham Road, Larchmont, advising that under separate cover a surveyor's map of a 3. 9 acre plot bounded by Winged Foot Drive and Ormond Place, is being delivered to this Board. The map contains lines representing a proposed subdivision and plan of development. The Chairman directed that a reply be sent to Mr. Breakey acknow- leding receipt of said letter and plans. -68- Mr. Jerome Wanshel, Larchmont Attorney, requested a copy of this preliminary map stating that his client, Mr. Harold Shapiro, had advised him that his deed calls for ownership of half the road. RE OFFICIAL MAP The Chairman reported that he had been in touch with Mr. McEvoy with reference to progress made on the Official Map of the Town. He said that Mr. McEvoy had recommended that the Map be indexed. Chairman requested that Mr. McEvoy advise the Board as quickly as possible as to the cost of indexing. RE PROPOSED SUBDIVISION SOUNDVIEW WOODS, INC. Mr. Joseph E. Muson, Attorney for Soundview Woods, Inc. appeared and submitted revised preliminary plans, together with application. The Board, after discussing the preliminary plans with the Town Engineer, directed the Secretary to return said plans to the developer suggesting that a conference be arranged with the Town Engineer regarding proposed changes or modifications prepared by Frederick F . Clark, Planning Consultant for this Board on this particular subdivision. The Town Engineer was directed to report back to this Board at an informal meeting to be held on Monday, August 13. RE PROPOSED SUBDIVISION ---GLEN ROCK ESTATES Mr. Ralph Cronquist, appearing on behalf of Messrs. Glaser and Gleicher, who were present, submitted five (5) copies of preliminary plan, together with application, covering Glen Rock Estates subdivision. After discussion, the Board indicated its approval of this preliminary plan, and directed the Secretary to so advise Mr. Cronquist that it was now in order for them to proceed with the preparation of the final layout. -69- imminemommumummi ® RE PETITIONS CREATION NEW RESIDENCE AA1 DISTRICT This matter is being held in abeyance pending the outcome of this Board's decision conerning the matter of a possible revision of the Zoning Ordinance of the Town of Mamaroneck. RE INFORMAL MEETING At the suggestion of the Chairman the Board decided to meet informally on Monday, August 13, to consider the matter of revision of the Zoning Ordinance, and the engagement of a planning consultant. RE PROCEDURE FOR FILING OF SUBDIVISION PLATS The Chairman presented, and the Board approved, the "Out- line of Procedure To Be Followed For the Approval of sub- division Plats" for the use of applicants. RE NEXT REGULAR MEETING Because of Labor Day falling on the regular date of the Planning Board meeting, the next regular meeting will be held on Tuesday, September 4, 1956.
