THE TOWN OF MAMARONECK, HELD AUGUST 5, 1957, AT POLICE
HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK
CALL TO"ORDER
The Chairman called the meeting to order at 8:30 p.m.
PRESENT: Mr. Fred L. Maggini, Chairman
Mr. G. Norman Blair
Mr. Joseph Rigano
Mr. John F. O'Conor
ABSENT: Mr. Henry E. Mullick
ALSO PRESENT: Mr. Maurice Friedlander, Town Engineer &
Building Inspector
APPROVAL OF MINUTES
On motion by Mr. Rigano, seconded by Mr. Blair the
minutes of the meeting of July 1, 1957 were approved
as presented and the minutes of the meeting of July
27,1957 were approved as corrected.
PUBLIC HEARING -- PROPERTY OF EDNA A. FORBES
The Secretary presented the affidavit of publication
of the notice of public hearing as published in The
Daily Times on July 31, 1957.
The Chairman declared the hearing open and inquired
whether any persons present wished to be heard.
The following persons addressed the Board:
Mr. Roger H. Harper, 100 Mamaroneck Avenue, Mamaroneck,
attorney for Mrs. Forbes, explained the final plans and
construction drawings.

Dr. A. S. Breakey, Durham Road, Larchmont, representing
Mrs. Forbes, answered in detail questions regarding the
plans submitted.
Upon ascertaining that no other persons wished to be
heard, on motion duly made and seconded, it was unani-
mously
RESOLVED that the Public Hearing on the application of
"Property of Edna Forbes", be and it hereby is closed.
After further discussion, on motion by Mr. O'Conor,
seconded by Mr. Blair, the following resolution was
unanimously adopted:
WHEREAS, Edna Forbes has heretofore filed with this
Board a map or subdivision plat entitled, "Subdivision
Map of Property Belonging to Edna A. Forbes", Town of
Mamaroneck, Westchester County, New York, made by T. J.
McEvoy, N.Y.S. License 21387, and dated July 15, 1957,
County Block 3956, Sheet 36, in accordance with the
provisions of the Town Law and the specifications for
Street improvements contained in the "Requirements for the
Approval of Subdivision Plats in the Town of Mamaroneck,, etis
Westchester County, New York", adopted by this Board on t�w �0''
October 19, 1955, together with a final layout showinggVtreets,
drains, easements, pavements, curbs, and water, together
with construction drawings prepared in accordance with the
provisions of Section 6 of Said "Requirements for the
Approval of Subdivision Plats in the Town of Mamaroneck,
Westchester County, New York", all of which have been
approved by the Town Engineer; and
WHEREAS, a Public Hearing was duly held on August 5, 1957,
pursuant to the provisions of Section 276 of the Town Law
after notice published in The Daily Times on July 31,
1957; and
WHEREAS, this Board has examined the subdivision map or plat,
together with other details submitted in accordance with
the final layout and has determined that same are satis-
factory subject to the conditions hereinafter recited,
NOW, THEREFORE, BE IT
RESOLVED that the subdivision map or plat entitled, "Sub-
division Map of Property Belonging to Edna A. Forbes", Town
of Mamaroneck, Westchester County, New York, made by T. J.
McEvoy, N.Y.S. License 21387, and dated July 15, 1957,
County Block 3956, Sheet 36, together with the specifi-
cations submitted and approved by the Town Engineer, are

hereby approved pursuant to the provisions of Section
276 of the Town Law to the end that the subdivision map
or plat may be filed in the County Clerk's Office,
subject, however, to the following conditions:
(1) That no building per_nit shall be issued for the
construction of houses on any lots of said sub-
division unless or until Edna A. Forbes has
furnished a bond in the sum of S15,000.00 for
the completion of such improvements, such bond
to run for a term of three years provided, how-
ever, that the term of such bond may be extended
by the Planning Board, or, at any time during the
term of the performance bond, may be modified to
an appropriate amount so that the new face value
of such completion bond will cover the cost in
full of the improvements required, but taking
• into account improvements already installed,
such modification or reduction to be made after
due public notice and public hearing as required
under Section 277 of the Town Law; such bond to
be approved by the Town Board as to the surety.
(2) That Edna A. Forbes shall deliver to the Town
Attorney deeds and/or releases for the land
lying in the bed of all streets and highways
as shown on such subdivision map or plat.
FURTHER RESOLVED that deeds, releases, or grants for
street rights and easements are received solely for the
purpose of compliance with Section 277 of the Town Law
and Section 3 of the "Requirements for the Approval of
Subdivision Plats in the Town of Mamaroneck, Westchester
County, New York", and that the filing of same shall not
constitute the dedication of any streets, highways, or
easements, until after the approval by the Town Board, nor
constitute a waiver of the payment of the necessary title
charges and recording fees.
PROPOSED SUBDIVISION -- "MURDOCK WOODS, SECTION 4"
The Board discussed the proposed subdivision Murdock
Woods, Section 4, and Mr. Friedlander explained that the
Preliminary Plans had been changed to allow for a cul de
sac having a 50 foot radius.
The Secretary was instructed to advise Mr. Oster,`3 Split
Tree Road, Scarsdale, N-.Y. advising him that it was now
in order for him to resubmit the Preliminary Plan showing
this change to the Board for further study.

COMMUNICATIONS
(1) Letter from W. F. Apt.--Garfield Street Property
The Secretary presented a letter from W. F. Apt,
enclosing a copy of his letter to Mr Guadagnola,
advising Mr. Guadagnola as to deed restrictions,
etc. on Garfield Street.
The Secretary was instructed to acknowledge the letter
and send copy of same to Mr. Fred. Clark, Planning Con-
sultant.
(2) Letter from C. J. Gronberg-- Appointment of Henry
E. Mullick
The Secretary read a letter form Mr. Gronberg,
Town Clerk, stating that Mr. Mullick had been
reappointed to the Planning Board for a five
year term, effective July 7, 1957 to July 6,
1962 by the Town Board, at their meeting on
July 3, 1957.
The letter was received and filed.
(3) Letter from A. G. Bogardus -- Larchmont Hills Civic
Association
The Secretary read a letter regarding the Up-
zoning or down-zoning of areas in their district.
The Secretary was directed to acknowledge the letter and
send a copy to Mr. Clark
ADJOURNMENT
There being no further business to come before the
meeting, it was adjourned at 9:40 p.m., to reconvene
on September 9, 1957.
