OF THE TOWN OF MAMARONECK, HELD APRIL 7, 1958, AT
POLICE HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The Chairman called the meeting to order at 8:30 p. m.
PRESENT: Mr. Fred L. Maggini, Chairman
Mr. John O'Conor
Mr. G. Norman Blair
Mr. Henry E. Mullick
Mr. Joseph Rigano
ALSO PRESENT: Mr. Maurice Friedlander, Town Engineer and
Building Inspector
Mr. Peter Kane, Councilman
APPROVAL OF MINUTES
The minutes of the meeting of March 3, 1958, were approved
as presented.
PUBLIC HEARING--SECOND SUPPLEMENTAL MAP
SOUNDVIEW WOODS, INC. , SECTION ONE
The secretary presented the affidavit of publication of the
notice of public hearing as published in The Daily Times
on March 26, 1958.
The Chairman declared the hearing open and inquired whether
any persons present wished to be heard.
The following persons addressed the Board:

Mr. Charles A. Newbergh, representing Soundview Woods, Inc. ,
appeared and explained in detail the map and construction draw-
ings which had been submitted with the application.
Mr. Friedlander advised that the plans and drawings met with
his approval and that he estimated the costs of the required
improvements to be $21, 405. 00.
Upon ascertaining that no other persons wished to address the Board,
on motion duly made and seconded, it was unanimously
RESOLVED that the Public Hearing on the Second Supplemen-
tal Map of Soundview Woods, Inc. , Section One, be and it
hereby is closed.
After some further discussion, on motion by Mr. Blair, seconded by
Mr. O'Conor, the following resolution was unanimously adopted:
WHEREAS, Soundview Woods, Inc. has filed with this Board
a map or subdivision plat entitled, "Second Supplemental
Map of Soundview Woods, Inc. , Section One in the Town of
Mamaroneck, W stchester County, New York, made by T.
J. McEvoy, N. Y. S. #21387 and dated March 25, 1958", in
accordance with the provisions of the Town Law and the
specifications for street improvements contained in the "Re-
quirements of the Approval of Subdivision Plats in the Town
of Mamaroneck, Westchester County, New York", adopted
by this Board on October 15, 1955, together with a final
layout showing streets, drains, easements, pavements, curbs,
and water, together with constructions drawings prepared in
accordance with the provisions of Section 6 of said "Require-
ments for the Approval of Subdivision Plats in the Town of
Mamaroneck, Westchester County, New York", all of which
have been approved by the Town Engineer; and
WHEREAS, a public hearing was duly held pursuant to the
provisions of Section 276 of the Town Law after notice
published in The Daily Times on March 26, 1958; and
WHEREAS, this Board has examined the subdivision map or
plat, together with other details submitted in accordance
with the final layour has determined that same are all sat-
isfactory subject to the conditions hereinafter recited,

NOW, THEREFORE, BE IT
RESOLVED that the subdivision map or plat entitled,"Second
Supplemental Map of Soundview Woods, Inc. , Section One,
in the Town of Mamaroneck , Westchester County, New York,
made by T. J. McEvoy, N. Y. S. #21387, and dated March
25, 1958", together with the specifications submitted and
approved by the Town Engineer, are hereby approved pur-
suant to the provisions of Section 276 of the Town Law to the
end that the subdivision map or plat may be filed in the
County Clerk's Office, subject, however, to the following
conditions:
(1) That no building per mit shall be issued for
the construction of houses on any lots shown on
said map unless or until Soundview Woods, Inc. ,
has furnished a bond in the sum of $21, 405. 00
for the completion of such improvements, such bond to
run for a term of three years provided, however,
that the term of such bond may be extended by
the Planning Board, or, at any time during the
term of the performance bond, may be modified
to an appropriate amount so that the new face
value of such completion bond will cover the
cost in full of the improvements required, but taking
into account improvements already installed,
such modification or reduction to be made after
due public notice and public hearing as required
under Section 277 of the Town Law.
FURTHER RESOLVED that deeds, releases, or grants for
additional street rights and easements are received solely
forthe purpose of compliance with Section 277 of the Town
Law and Section 3 of the "Requirements for the Approval
of Subdivision Plats in the Town of Mamaroneck, Westchester
County, New York", and that the filing of same shall not
constitute the dedication of any streets, highways, or ease-
ments, until after the approval by the Town Board, nor
constitute a waiver of the payment of the necessary title
charges and recording fees.
BOND---SUBDIVISION MURDOCK WOODS SECTION 3
Mr. Maggini stated that a letter had been received from
Mr. William Bishop asking for an extension of the bond

for Murdock Woods, Section 3. The letter explained that due to
the illness of Mr. Irwin Oster the installation of utilities had
been delayed.
After some discussion , on motion by Mr. Mullick, seconded by
Mr. Rigano, the following resolution was unanimously adopted:
WHEREAS, this Board heretofore approved a bond of
indemnity signed by G. B. & E. M. Realty Corporation
and the Indemnity Insurance Company of North America,
the condition of which bond is that G. B. & E. M. Realty
Corporation shall complete the improvement of a portion
of Split Tree Road as shown on map # R. 0. 9919, and
more particularly described therein on or before Decem-
ber 11, 1956 which bond is for the sum of $3, 000. and
is dated November 11, 1956; and
WHEREAS, it appears that G. B. & E. M. Realty Cor-
poration has been unable to complete this work in ac-
cordance with the plans and specifications for roads and
highways adopted by this Board, June 6, 1955:
NOW, THEREFORE, BE IT
RESOLVED that the time for the completion of the im-
provement of said Split Tree Road as required by said
bond of indemnity is extended to June30, 1958, provided,
however, that the Indemnity Insurance Company of North
America will continue their bond until that date.
PROPOSED SUBDIVISION---MURDOCK WOODS SECTION 4
Mr. Irwin Oster, 3 Split Tree Road, Scarsdale, appeared and
presented Preliminary Plans to the Board which he stated had
been revised in accordance with suggestions made by the Board.
After examining the plans and discussing the details with the
Town Engineer, Mr. Friedlander, the Board accepted the
Preliminary Plans and advised Mr. Oster to proceed with
the preparations of final plans and follow the necessary pro-
cedure to obtain a public hearing.
PROPOSED SUBDIVISION---GLEN ROCK ESTATES
Mr. William A. Glaser, representing Glen Rock Estates, sub-
mitted Preliminary Plans for Glen Rock Estates.

These Preliminary Plans were accepted by the Board after some
discussion and Mr. Maggini instructed Mr. Glaser to proceed
with final plans and arrange for a public hearing.
PROPOSED SUBDIVISION---THIRD SUPPLEMENTAL MAP OF
SOUNDVIEW WOODS, SECTION ONE
Mr. James Ward, representing Soundview Woods, Inc. , submitted
Preliminary Plans for the Third Supplemental Map of Soundview Woods
Inc. , Section One. These plans were received by the Board and re-
ferred to the Town Engineer for study.
PLANNING CONSULTANT--MR. FRED CLARK
A preliminary draft re: OB Districts was read and discussed.
COMMUNICATIONS
The secretary read a letter from Mr. Jerome N. Wanshel calling
attention to an editorial which had appeared in the Daily Times, on
March 8, 1958. A copy of the editorial accompanied the letter
and this too was read.
The secretary was instructed to acknowledge receipt of the letter
and file it.
NEW BUSINESS
1. The secretary was instructed by Mr. Maggini, chairman, that in
the future a public hearing should be advertised for a regular
meeting of the Planning Board, providing that the application was
received in compliance with the Town of Mamaroneck Planning
Board "Requirements for the Approval of Subdivision Plats in the
Town of Mamaroneck, Westchester County, New York.
2. The secretary was also advised to purchase new stationery for
the Board

ADJOURNMENT
There being no further business to come before the meeting
it was adjourned at 9:30 p. m. to reconvene on May, 5, 1958
