HomeMy WebLinkAbout1960_08_06 Planning Board Minutes MINUTES OF A SPECIAL MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK HELD AUGUST 6, 1960, IN THE OFFICE OF THE TOWN ATTORNEY, 100 MAMARONECK AVENUE, MAMARONECK, NEW YORK. CALL TO ORDER The Chairman called the meeting to order at 10:00 a. m. PRESENT: Fred L. Maggini, Chairman Joseph Rigano Lee Bloom ABSENT: G. Norman Blair D. B. Follansbee ALSO PRESENT: John L. Delius, Town Attorney Maurice Friedlander, Town Engineer BUSINESS--MURDOCK WOODS, SECTION 5 Mr. Maggini asked the board members present if they had given further study and thought to the subdivision known as Murdock Woods, Section 5. Mr. Bloom and Mr. Rigano answered in the affirmative and also stated that they had revisited the property in question. Following some discussion on motion by Mr. Bloom, and seconded by Mr. Rigano that the following resolution was unanimously adopted: WHEREAS, heretofore and on June 13, 1960, a public hearing was held by this Board upon the application of Stanart Development Company and Mansol Developers, Inc. for the approval of a certain subdivision map entitled "Subdivision Map of Section 5, Murdock Woods, Town of Mamaroneck, 269 4 Westchester County, New York" and dated May 31, 1960 and the plans and construction drawings for the construction of streets, sewers, water, etc. , including a sewer pumping station; and WHEREAS, after discussion with the persons who appeared at said public hearing concerning the advisability of re- locating a surface drain or ditch through portions of this property and the installation of a drain through lot 24 as shown on said map, the hearing was closed and decision reserved. WHEREAS, thereafter and on August 1, 1960, the Stanart Development Company and Mansol Developers, Inc. , th-e following suggestions made by this Board filed a revised map showing a surface drain from the land of Jerrold Robinson through Lot 24 and/or 25 as shown on said map to a culvert under the street or road shown as Kolbert Lane on said map; and WHEREAS, after filing such revised map this Board again considered the proposed subdivision NOW, THEREFORE, BE IT RESOLVED that the application of Stanart Development Inc. , and Mansol Developers Inc. , he and same is hereby granted subject to the following conditions: 1. Applicant shall construct a drain through Lot 24 and/or 25 from the land of Jerrold Robinson to a culvert in Kolbert Lane in accordance with the construction drawings and specifications approved by the Town Engineer. 2. A deed shall be given for streets, and an easement for a sanitary sewer from said sewer pumping station to Salem Drive through Lot 19 as shown on construction plans, as well as easements for drainage purposes from all catch basins in Kolbert Lane shown on the map and provided for in the construction drawings leading to the open drain south of Kolbert Lane. 3. Applicant shall execute and record in the County Clerk's Office, Division of Land Records, a declaration of a drain easement 270 through Lot 24 and/or 25 from the land of Jerrold Robinson to a culvert under Kolbert Lan-which declaration shall be binding upon the successors and assigns of applicant and which shall provide that applicant or the owner of Lot 24 and/or 25, and/or his successors and assigns shall at all times maintain and keepopen said drain at his own cost and expense. This declaration shall be submitted to, and approved, by the Town Aibrney before recording. 4. That the applicant shall install all street im- provements in accordance with the plans and specification,filed with this application and in accordance with the standards and specifications and procedure acceptable to the approporiate Town departments, and that no building permit shall be issued unless or until such improvements are completed or, alternatively, that a performance bond sufficient to cover the full cost of the same, as estimated by the Town Engineer, shall be furnished by the applicant to the Town. 5. That in the event the performance bond be given such performance bond shall be in the amount of $99, 029. 18 and be issued by a bonding or surety company acceptable to the Town Board and approved by the Town Board as to form, sufficiency and manner of execution for the term not to exceed three years. 6. That formal offers or deeds of cession to the public of all streets, highways, easements for drains and sewers be filed with the Planning Board in form satisfactory to the Town Attorney, to be held until such streets, highways or easements are formally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of the dedication of any such street, highway or easements nor waive the payment of necessary title charges and recording fees; but such acceptance shall be based solely upon the adoption of a resolution by the Town Board. FURTHER RESOLVED that upon compliance with the above conditions, the Chairman of the Planning Board 271 is hereby authorized to sign such subdivision map as evidence of the approval of the same by the Town Board.
