HomeMy WebLinkAbout1961_08_21 Planning Board Minutes 1 MINUTES OF A SPECIAL MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK, HELD AUGUST 21, 1961, IN THE OFFICE OF THE TOWN ASSESSOR, 158 W. POST ROAD, MAMARONECK. CALL TO ORDER The Chairman called the meeting to order at 8;15 p. m. PRESENT: Fred L. Maggin;, Chairman Joseph Rigano G. Norman Blair Lee Bloom ABSENT: D. B. Follansbee yam. ALSO PRESENT: Fred F. Kellogg, Jr. , Town Engineer PUBLIC HEARING---SOUNDVIEW WOODS, SECTIONS 1 & 2 The secretary presented the affidavit of publication of notice of public hearing as published in the Daily Times on August 16, 1961. The Chairman declared the hearing open and inquired whether any person present wished to be heard. Judge Reuben Sirlin, representing Investors Collateral Corp. owners of the proposed subdivision, stated that his clients were most anxious that this developemtn be approved. Mr. William LaVallee, engineer for Investors Collateral Corp. , said that his firm would agree to all conditions shown on the map. Mr. Robert Rannow, 10 York Road, owner of a home in the development, submitted a statement which is on file with the application signifying his intention of granting an easement over his property to facilitate matters. Following some further discussion and explanations en the 319 11 if 0 part of the owners and the Town Engineer, on motion by Mr. Bloom, seconded by Mr. Rigano, the following resolution was unanimously adopted: WHEREAS, Investors Collateral Corp. , Inc. has filed an application for the approval of plans for the re-subdivision of Soundview Woods, which is found on a map entitled "Revised Subdivision Map of Soundview Woods, Sections One and Two, Town of Mamaroneck, Westchester County, New York;" and WHEREAS, a public hearing was duly held pursuant to the provision of Section 276 of the Town Law after 4 notice published in the official newspaper of the Town of Mamaroneck, i. e. The Daily Times on August 16, 1961; and WHEREAS, the Board has examined the map and plans and determined that the same are satisfactory, subject to the conditions herein recited, NOW, THEREFORE, BE IT e" RESOLVED, that the application of Investors Collateral corp. , Inc. be and the same hereby is granted, subject to the following conditions:'- That formal offers or deeds of cession to the public of all streets, highways or public places not marked with such notation on the plat, and easements for drain and sewers as shown on Resubdivision Map entitled, "Revised Subdivision Map of Soundview Woods, Sections One and Two, Town of Mamaroneck, Westchester County, New York" made by Thomas J. McEvoy, New York State License #21837 and dated July 28, 1961, be filed with the Planning Board in form satis- factory to the Town Attorney to be held until such streets are formally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of Mamaroneck of the dedication of any such street or highway nor waive the payment of necessary charges and recording fees, but such • acceptance shall be based solely upon the adoption of a resolution by the Town Board; [ 0 ii 320 1 FURTHER RESOLVED that the resolution of March 4, 1957, as adopted by this Board is hereby superceded; and FURTHER RESOLVED that the applicant, Investors Collateral Corp. , Inc. file a performance bond in the sum of $155, 700. issued by Continental Casualty Company, which bond shall be issued pursuant to Section 277 of the Town Law to secure the installation of street and drainage improvements in accordance with the standards and specifications and procedure acceptable to the appropriate Town departments within eighteen (18) months from the date thereof and that no building permit shall be issued unless and until such bond is filed and approved by the Town Board, as required by Section 277 of the Town Law. FURTHER RESOLVED that this resolution is subject to the following conditions, viz: That Investors Collateral Corp. , Inc. shall commence construction of the culvert under York Road and the construction of the street known and shown as Ridgeway Road on the aforesaid map and construction drawings and complete the same prior to the construction of any other roads or streets shown on said map. FURTHER RESOLVED that upon compliance with the above conditions, the Chairman of the Planning Board is hereby authorized to sign the plans and specifications as evidence of the approval of same.
