HomeMy WebLinkAbout1963_08_19 Planning Board Minutes MINUTES OF A SPECIAL MEETING OF THE TOWN OF MAMARONECK PLANNING BOARD, HELD AUGUST 19, 1963, IN THE CONFERENCE ROOM OF THE TOWN OFFICES, 158 W. POST ROAD, MAMARONECK, NEW YORK. CALL TO ORDER The Chairman called the meeting to order at 8:30 p.m. PRESENT: Fred L. Maggini, Chairman Joseph Rigano Lee Bloom G. Norman Blair ABSENT: D. B. Follansbee ALSO PRESENT: Frederick F. Kellogg, Jr. , Town Engineer MINUTES On motion duly made and seconded the minutes of the meeting held August 5, 1963 were approved as presented. PUBLIC HEARING - LUNDY LANE The secretary presented the affidavit of publication of notice of Public Hearing as published in the Daily Times, August 12, 1963 . The Chairman declared the hearing open and inquired whether any person present wished to be heard. There was no one present to oppose the subdivision. Mr. Maggini asked Mr. Kellogg if he had set the amount of the bond required and Mr. Kellogg reported that the amount required would be $66,700.00. All members of the Board agreed, after review, that the bond was very fair, modest and reasonable. Following some further discussion and on motion duly made and seconded, the following resolution was unanimously adopted: WHEREAS, Loreto Poccia and Viggo Borgen, Agents for Mrs. Elena S. Peterson, owner of premises shown upon a map known as Subdivision of Lundy Lane, in the Town of Mamaroneck, Westchester County, New York, which is known as Block 502, Parcel 11 on the Tax Assessment Map of the Town of Mamaroneck, have filed with this Board an application for the approval of this plat and the accom- panying construction drawings for the construction of roads, drains, sewers, water lines and all necessary improvements; and WHEREAS, a Public Hearing was duly held, pursuant to the provisions of Section 276 of the Town Law, after notice published in the official newspaper of the Town of Mamaroneck, The Daily Times, on August 12, 1963 ; and 390 1 WHEREAS, this Board has examined the plans and determined that the same are all satisfactory, NOW, THEREFORE, BE IT RESOLVED that the application of Loreto Poccia and Viggo Borgen, Agents for Mrs. Elena S. Peterson, be and the same is hereby granted, and the map known as Subdivision Map of Lundy Lane, in the Town of Mamaroneck, Westchester County, New York made by Thomas John McEvoy, N.Y.S. License #39309 and dated June 19, 1963 ; together with the construction drawings for all roads, drains, sewers, water lines and all necessary improvements, are hereby approved, upon the following conditions: 1. That the applicants furnish a performance bond in the amount of $66,700.00, pursuant to Section 277 of the Town Law; such bond to run for a term of three years and to be issued by a bonding or Lsurety company and be subject to approval by the Town Board as to 10 the security and sufficiency and manner of execution as provided z in Section 277 of the Town Law; the condition of such bond to be as stated in Section 277 of the Town Law, for the installation of W all roads, drains, sewers, water lines and all necessary improve- ments as shown on the construction drawings. That formal deeds of cession to the public of all streets, high- s' ways or public places and any necessary easements as shown on 65 Subdivision Map of Lundy Lane, in the Town of Mamaroneck, 2 Weschester County, New York made by Thomas John McEvoy, N.Y.S. ZD License #39309 and dated June 19, 1963 , be filed with the Planning O Board in form satisfactory to the Town Attorney and that such shall Qbe held until such streets are formally accepted by the Town Board, m provided that such delivery of such offers or deeds shall not con- stitute an acceptance by the Town of Mamaroneck of the dedication of any such street or highway nor waive the payment of necessary charges, including title search and recording fees; but such acceptances shall be based solely upon the adoptions of a resolu- tion by the Town Board. 3. That the applicants obtain approval from the Westchester Joint Water Works and from the Town Board, of the Town of Mamaroneck, for the extension of the water mains as shown on said construction drawings and that an amount sufficient to cover the cost of the installation of said water lines and appurtenances as estimated by the manager of said Water Works, be deposited with said Water Works. 4. That an easement for purposes of installation, maintenance and service of water lines and appurtenances, in form satisfactory to the Town Attorney, be delivered to the said attorney and recorded prior to the installations of such water lines and appurtenances. FURTHER RESOLVED, that upon compliance with the above conditions, the Chair- man of the Planning Board is hereby authorized to sign such subdivision plat as evidence of the approval of same by this Board. Mr. Kellogg disucussed W the letter and it was decided no action was necessary. (p 4 3 91 The letter was received and filed for the record.
