HomeMy WebLinkAbout1961_04_10 Planning Board Minutes MINUTES OF A SPECIAL MEETING OF THE PLANNING BOARD HELD APRIL 10, 1961, IN THE OFFICE OF THE TOWN ASSESSOR, 158 WEST POST ROAD, MAMARONECK, NEW YORK. CALL TO ORDER The chairman called the meeting to order at 8:15 p. m. PRESENT: Fred L. Maggini, Chairman Joseph Rigano G. Norman Blair Lee Bloom ABSENT: D. B. Follansbee ALSO PRESENT: Fred Kellogg, Town Engineer Thomas J. McEvoy, Town Assessor OLD BUSINESS---WINGED FOOT ESTATES A discussion was held on the application of Winged Foot Estates. Four tracings were wubmitted by Mr. McEvoy which were accepted by the town engineer. On motion by Mr. Bloom and seconded by Mr. Blair the following resolution was unanimously adopted: WHEREAS, heretofore on March 6, 1961 a public hearing was held by the Board upon the application of Mr. Vileno for the approval of a certain sub- division map entitled "Subdivision Map of Winged Foot Estates, Town of Mamaroneck, Westchester County, N. Y. " and dated February 22, 1961; and WHEREAS, after discussion with the persons who appeared at said public hearing the hearing was closed and decision reserved: 297 • NOW, THEREFORE, BE IT RESOLVED that the subdivision map or plat entitled "Subdivision Map of Winged Foot Estates in the Town of Mamaroneck, Westchester County, N. Y. " dated February 22, 1961, made by T. J. McEvoy, New York State License #21387 together with construction plans for Winged Foot Estates, sheets 1, 2 and 3 of 3 sheets, dated Feb. 22, 1961, made by Dolph Rotfeld, Engineer, New York State License #37056, and approved by the Town Engineer, of the Town of Mamaroneck and the Superintendent of the Westchester Joint Water Works #1, are hereby approved by the Planning Board pursuant to Section 376 of the Town Law and that the subdivision map or plat may be filed in the stchester County Clerk's Office subject to the following conditions: 1. That no building permit shall be issued for the construction of any houses on any lots on said map except on lots numbered 10 through 13 in- clusive, which four lots have frontage on a paved and dedicated street known as Winged Foot Drive. 2. That the applicant shall install all street improvements in accordance with the plans and specifications filed with this application and in accordance with the standards and specifications and procedure acceptable to the appropriate Town departments, and that no building permits shall be issued unless or until such improvements are completed. 3. That formal offers or deeds of cession to the public of all streets, highways, easements for drains and sewers be filed with the Planning Board in form satisfactory to the Town Attorney, to be held until such streets, highways or easements are formally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of the dedication of any such 298 I street, highway or easements nor waive the payment of necessary title charges and recording fees; but the acceptance shall be based solely upon the adoption of a resolution by the Town Board. 4. That the Town of Mamaroneck is able to obtain from the Westchester County Park Commission an easement or license for the construction of an 8 inch sewer pipe, a 6 inch water pipe and a 12 inch drain pipe, all of which pipes run from easements over lots #4 and #5 as shown on the subdivision map, through the lands of the Westchester County Park Commission to the existing stream and water and sewer pipes presently located in said Park Commission land, all of which pipes and stream now exist in locations shown on the above referred to construction plans. FURTHER RESOLVED that upon compliance with the above conditions, the Chairman of the Planning Board is hereby authorized to sign such subdivision map as evidence of the approval of the same by the Planning Board. There followed a brief discussion on the Proposed Requirements for the Approval of Subdivision Plats and it was on motion by Mr. Bloom, seconded by Mr. Maggini unanimously RESOLVED that a Public Hearing be held on May 1, 1961 on the Proposed Revised Regulations for the Approval of Subdivision Plats in the Town of Mamaroneck, New York. The secretary was instructed to advertise the Public Hearing in the Daily Times, such advertisement to read as follows: PUBLIC NOTICE PLEASE TAKE NOTICE that the Town of Mamaroneck Planning Board will hold a public hearing on May 1, 1961, in the Assessor's Office, 158 W. Post Road, Mamaroneck, N. Y. at 8:15 p. m. for the purpose of approving the Proposed Revised Regulations for the Approval of Subdivision Plats 299 in the Town of Mamaroneck, Westchester County, N. Y. copies of which may be obtained at the office of the Town Clerk, 158 W. Post Road, Mamaroneck, N. Y. where they are on file. TAKE FURTHER NOTICE that all persons present will be given an opportunity to be heard. BY ORDER OF THE TOWN OF MAMARONECK PLANNING BOARD. Fred. L.
