OF THE TOWN OF MAMARONECK, HELD MAY 2, 1960, IN THE
OFFICE OT THE TOWN ASSESSOR, 158 WEST POST ROAD,
TOWN OF MAMARONECK.
CALL TO ORDER
The Chairman called the meeting to order at 8:15 p. m.

Maurice Friedlander, Town Engineer
MINUTES
The minutes of the meeting of April 4, 1960, were approved
as corrected.
PUBLIC HEARING--ROBINS NEST, JOSEPH GREENSTEIN
The secretary presented the affidavit of publication of
notice of public hearing as published in the Daily Times,
on April 27, 1960.
The Chairman declared the hearing open and inquired
whether any person present wished to be heard.
Thomas J. McEvoy, Jr. , representing Mr. Greenstein,
appeared and submitted plans for the subdivision to be
known as Robins Nest.

The Board examined the plans and asked Mr. Greenstein if there
was room for a driveway on Lot 5. Mr. Greenstein answered
in the affirmative.
The Chairman then asked Mr. Friedlander, if in his estimation
the plans were in order. Mr. Friedlander said that they were.
Mr. Thomas Ashton , 59 Harrison Drive, a member of the
Board of Directors of the Pinebrook Home Owners Association,
then appeared and stated that he felt this subdivision would
present a drainage problem. He stated that his property
would be particularly affected. Mr. Ashton requested the
Board to delay their decision for a week to give the Pinebrook
Association time to further study the subdivision.
Mr. Maggini, asked Mr. Ashton how many members were on
the Board of Directors of the Pinebrook Association and the
answer was 6.
Following further discussion and after ascertaining that no
other persons wished to address the Board, on motion duly
made and seconded, it was unanimously
RESOLVED that the Public Hearing on Robins Nest
be, and it hereby is, closed.
Upon motion by Mr. Bloom, seconded by Mr. Rigano the
following resolution was unanimously adopted:
WHEREAS, Jody Dwellings, Inc. , Joseph Greenstein,
president, 60 Overhill Road, New Rochelle, N. Y. ,
owners of a subdivision known as Robins Nest found
on a map known as "Subdivision Map of Robins Nest
in the Town of Mamaroneck, New York, Westchester
County" made by Thomas J. McEvoy, New York
State License #21387 and dated April 22, 1960, has
filed with this Board an application for the consideration
of plans and specifications for the construction of roads, etc.
on Robins Nest which is in Block 501, Parcel 125 on
the Tax Assessment Map of the Town of Mamaroneck; and
WHEREAS, a public hearing was duly held pursuant to
the provision of Section 276 of the Town Law after
notice published in the official newspaper of the Town
of Mamaroneck, The Daily Times, on Wednesday
April 27, 1960; and

WHEREAS, this Board has examined the plans and
specifications and determined that same are all
satisfactory, subject to the conditions hereinafter
recited,
NOW, THEREFORE, BE IT
RESOLVED , that the application of Jody Dwellings,
Inc. , Joseph Greenstein, president, be and same
is hereby granted subject to the following conditions:
1. Applicant must obtain permission to
connect Lot 5 to the New Rochelle sewer
in Shadow Lane and furnish proof thereof.
2. Applicant must finish construction of
road and appurtenances to east end of
Shadow Lane as shown on map filed with
this application, or
alternatively, that a performance bond sufficient to
cover the full cost of the same as estimated by the
Town Engineer shall be furnished to the Town by the
applicant, and that no building permit shall be
issued unless or until such conditions are completed
or a performance bond is given.
2. That in the event the performance bond be given
such performance bond shall be in the amount of
$19, 195. 00 and be issued by a bonding or surety
company approved by the Town Board as to form,
sufficiency and manner of execution for the term
not to exceed three years.
3. That formal offers or deeds of cession to the
public of all streets, highways or public places
not marked with such notation on the plat be filed
with the Planning Board in form satisfactory to the
Town Attorney to be held until such streets are
formally accepted by the Town Board, provided
that such delivery of such offers or deeds shall
not constitute an acceptance by the Town of the
dedication of any such street or highway nor
waive the payment of necessary title charges
and recording fees; but such acceptance shall be
based solely upon the adoption of a resolution
by the Town Board.

FURTHER RESOLVED that upon compliance with
the above conditions, the Chairman of the Planning
Board is hereby authorized to sign such subdivision
map as evidence of the approval of the same by the
Town Board.
COMMUNICATIONS
1. Charles A. Newbergh---Soundview Woods Bond
The secretary read a letter from Charles A.
Newbergh, president of Soundview Woods, Inc. ,
requesting consideration of the extension of the
bond for $155, 740. 00 which had expired
April 8, 1960.
Mr. Delius, read a letter from the Continental Casualty
Company , bonding company concerned with the above bond.
Mischa Lazoff, attorney representing Everready Factors and
Auburn Affiliated, appeared and again requested that this
bond not be extended.
Following further discussion, the secretary was requested to
write Mr. Newbergh and advise him that the Board would
take no action on this matter at the present time.
NEW BUSINESS---BRIAR DEL HOMES
Anthony J. Vileno, representing Briar Del Homes, appeared
and requested the Planning Board to consider changing the
dimensions of one of the lots in the Briar Del Subdivision,
thereby enabling him to build two houses rather than one.
The Board advised Mr. Vileno that they would study the
matter and write him in the near future of their decision.
On the advice of the Town Atthrney the secretary was instructed
to write Mr. Vileno and advise him that this request for a
change in the dimensions of a lot was matter for the Zoning
Board of Appeals.
ADJOURNMENT
There being no further business to come before this meeting
it was adjourned at 10:20 p. m.

it would appear to me that when a Prslinni*ary Plan is filed either
before or at a Pleasing board meeting that It be referred to the
Town Engineer for study and a written report covering his recommendations
as is the adequacy of the proposed utilities and drainage, layout etc
sad any suggestions he wishes to make be sent to the Chairman
sad secretary.
Is accordance with your own rules, be should also estimate the
amount of the performa*te bend at this time.
The Pleasing board then would be in a osition to study this report
is advance of its next meeting and make a firm decision at that time .
and to authorise the adverttsemsrt for a public hearing. if its suggestions
are contained in the final plans.
That of course would necessitate these final plans being filed sufficiently
in advance ear that I could be advised by the Engineer that they conform
