HomeMy WebLinkAbout1965_09_07 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK CPLANNING BOARD HELD SEPTEMBER 7, 1965, IN THE ASSESSOR'S OFFICE OF THE TOWN OF MAMARONECK, 158 WEST POST ROAD, MA- MARONECK, N.Y. CALL TO ORDER The Chairman called the meeting to order at 8:25 pl.m. ROLL CALL Present: Mr. Fred L. Maggini, Chairman Mr. G. Norman Blair Mr. Lee Bloom Mr. Joseph Rigano Mr. Winfield James Also Present: Mr. Frederick F. Kellogg Town Engineer APPROVAL OF MINUTES The minutes of August 2, 1965 were presented, and on motion duly made and seconded, approved as sub- mitted. CWELCOME TO NEW MEMBER Mr. Winfield James, who was appointed to fill D. B. Follansbeers term, was welcomed to the Board by Mr. Maggini and the members of the Board. PUBLIC HEARING Baldwin Hills Subdivision The Chairman declared the hearing open and the secfetary presented for the record the affidavit of publication of the Notice of the Hearing, which was herewith received and filed. The Chairman inquired whether anyone present wished to be heard either in favor of or in opposition to this application, whereupon Mr. Kellogg reported that the plans were in order, and stated that the Attorney had advised that the bond, easements and other legal instruments were in order. Following some further discussion, on motion duly made by Mr. Bloom and seconded by Mr. Rigano, the following resolution was unanimously adopted: C 45q WHEREAS, Jason McKenna, Inc. , owner of premises shown on a map known as "Subdivision Map of Bald- win Hills", which is known as Block 207, Parcel 56 on the Tax Assessment Map of the Town of Mamaroneck, has filed with this Board an application for the approval of this plat and the accompanying construct- ion drawings for the construction drawings for the construction of roads, drains, sewers, water lines and all necessary improvements; and WHEREAS, a public hearing was duly held pursuant to the provisions of Section 276 of the Town Law after publication of notice thereof in the official newspaper of the Town of Mamaroneck, The Daily Times on August 26, 1965; and WHEREAS, this Board has examined the plans and deter- mined that the same are all satisfactory subject to the conditions hereinafter recited: NOW, THEREFORE, BE IT RESOLVED, that the application of Jason-McKenna, Inc. be and it hereby is granted, and the map known as "Sub- division Map of Baldwin Hills", made by Thomas John McEvoy and dated March 29, 1965, together with the construction drawings for all roads, drains, sewers, water lines, and all necessary improvements, be and they hereby are approved subject to the following • conditions: 1) That the applicant shall install all street improvements in accordance with the plans and specifications filed with this application and in accordance with the standards and specifica- tions and procedure acceptable to the appropriate Town Departments, all of which is more particular- ly set forth in Section 277 of the Town Law. 2) That no building permit shall be issued unless or until the applicant has furnished a bond in the amount of $180,000 for the completion of such im- provements, such bond to run for a term of theee years and to be issued by a bonding or surety company approved by the Town Board as to form, sufficiency and manner of execution. 3) That formal offers or deeds of cession to the public of all streets, highways or public places not marked with such notation on the plat be filed with the Planning Board in form satisfactory to the 45t Town Attorney to be held until such streets are formally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of the dedi- cation of any such street or highway nor waive the payment of necessary title charges and recording fees; but that such acceptance shall be based solely upon the adoption of a resolution by the Town Board. 4) That the applicant obtain approval of the exten- sion of the water mains shown on said construction drawings from the Westchester Joint Water Works, and the Town Board of the Town of Mamaroneck, and deposit with the Westchester Joint Water Works an amount sufficient to cover the cost of the installation and/ or inspection of said lines and appurtenances as esti- mated and required by the Manager of the said Water Works. 5) That easements for the installation, maintenance and service of water lines, sewers, drains and road- way items, and for the construction and maintenance of "off-street" sewers and drains, and such other easements as the Town Attorney may require, shall be delivered to the said Attorney in form satisfactory to him for recording prior to the installation of such above set forth items. 6) That lot #10 be reserved for park, recreation and related Town purposes and the owner shall furnish such deeds or other conveyances for such lot to the Town as the Town Attorney may require. and be it further RESOLVED, that upon compliance with the above set forth conditions, the Chairman of the Planning Board be and he hereby is authorized to sign the subdivision plat as evidence of the approval of same by this Board. LEATHER STOCKING LANE - Proposed Subdivision At the Chairman's direction the secretary read a communication from Lou-Simon, dated August 25, 1965 in which he requested a ninety day extension for the filing of a bond and if necessary, further requested that the Board advertise for a public hearing for a 90 day extension. This letter was ordered filed for the record. Mr. Simon appeared and explained that he had barely started working and therefore needed more time. 4501 (:) Following some further discussion, on motion by Mr. Bloom, seconded by Mr. Rigano the following resolution was unanimous- ly adopted: RESOLVED, that the secretary be and she is hereby authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, on or be- fore September 23, 1965 the following notice calling a Public Hearing: PUBLIC NOTICE PLEASE TAKE NOTICE, pursuant to Section 276 and 277 of the Town Law and in accordance with the Rules and Regulations of the Planning Board, The Planning Board will hold a public hearing at its next regular meeting on October 4, 1965 at 8:15 p.m. in the Office of the Assessor at the Town Offices, 158 West Boston Post Rpad, Mamaroneck, New York for the purpose of considering the application of Lou Simon for the approval of a proposed plat or subdivision plan as shown on map entitled "A Subdivision Map of Leather- Stocking Lane - A Portion of Section 2 - Glen Rock Estates" in the Town of Mamaroneck, West- () chester County, N.Y. made by Claude Latimer, P.E. L.S. , N.Y.S. License #5804 and Sal Spinelli, L.S. N.Y.S. License #23043, dated April 9, 1965. This application was reviewed at a Public Hearing on June 7, 1965, and is being resubmitted due to the expiration of the statuatory period of 90 days. PLEASE TAKE FURTHER NOTICE that at said public' hearing all persons interested will be given an opportunity to be heard. BY ORDER OF THE TOWN OF MAMARONECK PLANNING BOARD FRED L. MAGGINI, CHAIRMAN MURDOCK WOODS NO. 5 - Kolbert Drive A memo dated August 19, 1965 was sent to the Building Inspector from the Town Engineer, in which he suggested that hereafter no building permits or occupancy certifi- cates be issued at Kolbert Drive until otherwise advised by the Town Attorney and the Planning Board. SOUNDVIEW WOODS A discussion was held re status of Soundview Woods and it was noted that owners of said property had not made any recent application (within the past four years) for any consideration of said section 3 of Soundview Woods. 4613 EXCAVATION ORDINANCE Mr. Maggini presented sample excavation ordinances from the Town of Oyster Bay and other villages, and after some discussion it was agreed that the Town Engineer study said ordinances, modify and return to the Planning Board for their approval. BUDGET • The Chairman presented the budget request for 1966 and it was unanimously approved to remain the same as the 1965 budget.
