CALL TO ORDER The Chairman called the meeting to order at 8:20 p.m. ROLL CALL Present: Mr. Fred L. Maggini, Chairman Mr. Lee Bloom Mr. Joseph Rigano Mr. Winfield James Absent: Mr. G. Norman Blair Also Present: Mr. William P. Widulski, Town Engineer Mr. James Johnston, Town Attorney APPROVAL OF MINUTES The minutes of the meeting of September 6, 1966 were presented and on motion duly made and seconded, ap- proved as submitted. BONNIE BRIAR COUNTRY CLUB The following persons appeared: Mr. Franklin Odell, Jr. , P.E. Mr. Anthony Zock Mr. Nicholas Dales Mr. Thomas Byrne Communication received by Mr. Peter Kane, Supervisor in opposition from: Mr. & Mrs. J. William Piper 711 Weaver Street, Larchmont Mr. Odell presented the Board with the latest drawing showing the changes to be made in the present swim- ing pool. Mr. Zock, Mr. Dales and Mr. Byrne stated that they felt this change would make the pool safer for the children by separating the diving area from the swim- ming area in a new L shaped arrangement and they would be willing to accept any suggestions the Board could make. However, complete relocation of pool facilities made the costs prohibitive. After further discussion the Board suggested that audible and visual controls are requisite to any improvement or expansion of the present pool and they wanted to see another more complete plan with location of parking, trees, etc. as well as eleva- tion views. An appointment was made for the Board members to go look over the property before the next meeting. PUBLIC HEARING - LUNDY LANE The Chairman requested the Secretary to read the pub- lic notice. Mr. Mambrino requested that the Board grant an exten- sion of time as they were having difficulty with the title to the street. After some discussion the Board decided to grant Mr. Mambrino's request and the following Resolution was hereby adopted subject to the approval of the Town Board: WHEREAS, Alfred G. Mambrino, President of Fredvil Homes, Inc. , owner of premises shown upon maps known as Subdivision of Lundy Lane, Section 1 and 2, in the Town of Mamaroneck, Westchester County, New York, which is known as Block 502, Parcel 11 and Block 503, Parcels 490 and 634 on the Tax Assessment Map of the Town of Mam- aroneck has filed with this Board an ap- plication for the approval of this plat and the accompanying construction drawings for the construction of roads, drains, sewers, water lines, and all necessary improvements; and WHEREAS, a Public Hearing was duly held, pursuant to the provisions of Section 276 of the Town Law, after notice published in the official newspaper of the Town of Mamaroneck, the Daily Times, on April 22, 1966; and WHEREAS, pursuant to Section 276 of the Town Law, a further hearing was duly held by this Board on October 4, 1966 to con- sider the request for extension of time and all present were given an opportunity to be heard; and WHEREAS, this Board has examined the plans and determined that the same are all sat- isfactory; NOW, THEREFORE, BE IT RESOLVED, that the application of Alfred G. Mambrino, President of Fredvil Homes, Inc. , be and the same is hereby granted, and the maps known as Subdivision Maps of Lundy Lane, in the Town of Mamaroneck, Westchester County, New York are hereby approved, together with construction draw- () for all roads, drains, sewer, water lines and all necessary improvements, upon the following conditions: 1. That the applicants furnish a performance bond in the amount of $88,000.00 pursuant to Section 277 of the Town Law; such bond to run for a term of two years and to be issued by a bonding or surety company and be subject to approval of the Town Board as to the security and suffici- ency and manner of execution as provided in Section 277 of the Town Law, for the installation of all roads, drains, sewers, water lines and all necessary improvements as shown on the con- struction drawings. 2. That formal deeds of cession to the public of all streets, highways or public places and any necessary easements as shown on Subdivision Maps of Lundy Lane, fjin the Town of Mamaroneck, West- chester County, New York, be filed with the Planning Board in form satisfactory to the Town Attorney and that such shall be held until such streets are formally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of Mamar- oneck of the dedication of any such street or highway nor waive the payment of necessary charges, including title research and re- cording fees; but such acceptance shall be based solely upon the adoptions of a resolution by the Town Board. 3. That the applicants obtain approval from the Westchester Joint Water Works and from the Town Board, of the Town of Mamar- oneck, for the extension of the water mains as shown on said con- struction drawings and that au amount sufficient to cover the cost of the installation of said water lines and appurtenances as ��. rI estimated by the manager of said ® Water Works, be deposited with said Water Works. 4. That an easement for purposes of installation, maintenance and service of water lines and appur- tenances, in form satisfactory to the Town Attorney, be delivered to the said Attorney and recorded prior to the installations of said water lines and appurtenances. FURTHER RESOLVED, that upon compliance with the above conditions, the Chairman of the Planning Board is hereby authorized to sign such subdivision plat as evidence of the approval of same by this Board. MURDOCK WOODS - SECTION 5 Mr. Hughes appeared before the Board with a request for extension of time to November 15, 1966 to com- plete the work. The Board felt that work was pro- gressing and Mr. Widulski, the Town Engineer recom- mended that the bond be reduced from $200,000. to $20,000. Ito On motion duly made and seconded the following Res- olution was adopted subject to the approval of the Town Board: WHEREAS, on May 6, 1963, a Public Hearing was held on a subdivision known as Murdock Woods- Section 5; and WHEREAS, at that time a resolution was duly adopted by this Board setting a Per- formance Bond for the construction of roads, drains, etc. , in said subdivision in the amount of $200,000.00; and WHEREAS, certain of this construction work has been completed in a manner satisfactory to the Town Engineer; and WHEREAS, pursuant to Section 277 of the Town Law, a public hearing was duly held by this Board on July 6, 1966, to consider the request for reduction of the Performance Bond from $200,000.00 to $20,000.00 and all present were given the opportunity to be heard; 410 NOW, THEREFORE, BE IT RESOLVED, that the Planning Board pursuant �l % `f to Section 277 of the Town Law and subject to the approval of the Town Board of the Town of Mamaroneck recommends that the Town Board reduce the amount of said Per- formance Bond from $200,000.00 to $20,000.00 as recommended by the Town Engineer pro- vided all deeds for streets, easements, etc. are filed in a form acceptable to the Town Attorney. BALDWIN HILLS A letter was received from Mr. John Stahr, Chairman of the Town of Mamaroneck Recreation Commission call- ing attention to the fact that Baldwin Estates had promised to deed Lot No. 10 to the Town for public use but because of the changes in the grades this lot is unsuitable for the use for which it had been set aside. Mr. Stahr suggested that the Planning Board notify Baldwin Hills Development to ask that an alternate lot be appropriated. A letter was sent to Mr. Kretchmer, President of Baldwin Hills Deve- lopment, Inc. requesting that this be done. On the advice of the Town Attorney, Mr. Johnston it was decided that from a legal standpoint the Planning Board could not unilaterally change the Resolution from Lot 10 to another lot, and a letter was to be sent to Mr. Stahr advising him of this. MAP OF PRINCE WILLOWS The Board decided that these maps should be incor- porated as part of the Master Plan and that the pro- per Resolution should be adopted. COMMUNICATIONS A letter was received from Mrs. Betti Richard Matsch suggesting that because of the heavy traffic on Dur- ham Road the Town should build another road to ser- vice the new homes in Soundview Woods. Mr. Widulski, the Town Engineer had written to Mrs. Matsch advis- ing her that when construction is completed the amount of traffic will diminish and that when the Planning Board approved the subdivision it reserved the right of way for future street improvement, when all roads are completed and accepted by the Town Board.
