mMINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLAN-
NING BOARD HELD NOVEMBER 3 , 1964, IN THE TOWN ENGINEER 'S
OFFICE OF THE TOWN OF MAMARONECK, 158 WEST POST ROAD, MAMARO_-

CALL TO ORDER
The chairman called the meeting to order at 8: 18 p.m.

MINUTES:
On motion duly made and seconded, the minutes of the
meetingheld October 5, 1964 were approved as

OLD BUSINESS

U-y Garit Lane Proposed Subdivision - The final plans for the

proposed subdivision were submitted by Nicholas Garito,
owner of same, which were studied and discussed. Two minor
d5 changes relating to a drainage swale and a sewer lateral
were suggested as noted on the plan, which Mr. Garito agreed
to incorporate along with certain additional minor corrections.
® Whereupon, on motion made by Mr. Blair and seconded by Mr.
m Rigano, the following resolution was unanimously adopted:
RESOLVED, that the Secretary be and she hereby is author-
ized to publish in the official newspaper of the Town of
Mamaroneck, The Daily Times, on or before November 27 , 1964,
the following notice calling a public hearing to be held be-
fore this Board, at a regular meeting thereof on December 7,
1964, to consider the subdivision of Garit Lane:
PUBLIC NOTICE
PLEASE TAKE NOTICE, that Nicholas and Alfonzina Garito,
owners, have filed an application for consideration and
approval of plans for the subdivision of land known as
Subdivision Map of Garit Lane in the Town of Mamaroneck,
Westchester County, New York, which is in Block 402 , parcel
43.

TAKE FURTHER NOTICE, that the Town of Mamaroneck Planning
Board, pursuant to Section 276 and 277 of the Town Law and
in accordance with the Rules and Regulations adopted by it
and approved by the Town Board will hold a Public Hearing
on Monday, December 7, 1964 in the Assessor ' s Office of the
Mamaroneck Town Office, 158 W. Post Road, Mamaroneck, New
York at 8: 15 p.m. at which time it will consider the Pro-
posed Plat or subdivision Plan as shown on "Subdivision
Map of Garit Lane in the Town of Mamaroneck, Westchester
County, New York" made by Thomas John McEvoy, N.Y.S. Li-
cense No. 39309 and dated October 16, 1964.
TAKE FURTHER NOTICE that all persons present will be given
an opportunity to be heard.
BY ORDER OF THE TOWN OF MAMARONECK PLANNING BOARD.

Ser-val Auto Services Co. - The secretary presented an
extract of the minutes of a regular meeting of the Town
Board held on October 21, 1964, referring an application
of Serval Auto Services Co. for a special permit to con-
struct an addition at the rear of the present car wash
building, to this Board for study and report prior to the
Town Board meeting of November 4, 1964, which was here-
with ordered, received and filed.
Mr. Ciro LaBarbera, applicant, and his attorney, Mr. William
S. Brill, appeared and presented their views in this matter.
And thereupon, since it was the opinion of this Board
following further discussion, that the said application
falls under Section 340 of the Zoning Ordinance and accord-
ingly, this Board has no jurisdiction with respect thereto,
and the application should properly be made to the Zoning
Board of Appeals, on motion by Mr. Bloom, seconded by Mr.
Rigano, the following resolution was adopted unanimously:
WHEREAS, the application of Ciro LaBarbera for a special
permit to extend the use of his premises at 434 Boston Post
Road, Town, by constructing an addition at the rear of the
present structure, was referred to this Board by the Town
Board for study and report ;
and
WHEREAS, in the opinion of this Board, the subject applica-
tion should properly be made to the Zoning Board of Appeals
of the Town of Mamaroneck pursuant to Section 340 of the
Zoning Ordinance ;

NOW, THEREFORE, BE IT

RESOLVED, that this Board hereby recommends that the Town Board
take such action as is appropriate to refer the application of
Ciro LaBarbera to the Zoning Board of Appeals ;
and be it further
RESOLVED, that a copy of this resolution be forwarded to the
Town Board prior to its meeting on November 4, 1964.
Carriage House Lane
Mr. Kellogg reported that field changes in the sewer profile
of Carriage House Lane were made so that Lots 3 , 4, 5 , 6 and
22 can now be served by a gravity sewer rather than the eject-
or system as originally planned. This was accomplished by
deepening the sewer manhole at Station 5 + 31.80 and running
from that manhole in a northerly direction at a down-hill
slope. Also a 4" diameter fiber pipe under-drain was in-
stalled paralleling this revised sewer. These changes were
made possible by encouraging the developer to dig a 12 foot
deep test hole at Station 8 + 05 wherein no rock was discover-
ed; thereby making the revision feasible.
"As built" drawings will be forth-coming at a later date.
NEW BUSINESS:
At the Chairman's direction, the Engineer was directed to for-
ward a request to the Zoning Board of Appeals for its recommend-
ations regarding revisions of any provisions of the Zoning Ordi-
nance, if necessary, in line with the review thereof, to be
made by the Planning Consultants, Raymond & May.
ADJOURNMENT
There being no further business to come before this meeting it
was adjourned at 10: 00 p.m.
