HomeMy WebLinkAbout1963_05_06 Planning Board Minutes 1 MINUTES OF A REGULAR MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK, HELD MAY 6, 1963, IN THE CONFERENCE ROOM OF THE TOWN OFFICES, 158 WEST POST ROAD, MAMARONECK, NEW YORK. CALL TO ORDER The Chairman called the meeting to order at 8:15 p.m. PRESENT: Fred L. Maggini, Chairman Joseph Rigano G. Norman Blair Lee Bloom D. B. Follansbee ALSO PRESENT: Town Attorney John L. Delius Councilman Joseph W. Cook, Jr. Town Engineer Frederick F. Kellogg, Jr. , Acting Secretary MINUTES The minutes of the meetings of March 4 and April 1, 1963 were approved as presented. PUBLIC HEARING - MURDOCK WOODS, SECTION 5 The secretary presented the affidavit of publication of notice of Public Hearing as published in the Daily Times, April 30, 1963 . The Chairman declared the hearing open and inquired whether any person present wished to be heard. Mr. Goldstein, representing the developers of Murdock Woods, Sec- tion 5 appeared and submitted plans for the approval of the Board. Mr. Delius, Town Attorney, advised Mr. Goldstein that he was to have the title to the bed of the street searched and then delivered to Mr. Delius . Mr. Delius pointed out that it is most important that title to Kolbert Lane be "Clear" where it goes beyond the subdivision lots and abuts Murdock Road. It was noted that the design and drawings appeared to be clearly and neatly prepared. Mr. Kellogg, Engineer, reported that the amount of the bond re- quired would be $200,000.00. The Engineer also acknowledged, on behalf of the Planning Board, receipt of the Westchester County Health Dept. approval and the Engineer's Report submitted by Nicholas Penna, P.E. , that dealt with the sewer system and ejector. Following some further discussion and study the following resolu- tion was adopted unanimously: 381 1 WHEREAS, Meyer B. Goldstein, agent for Mansol Developers, Inc. , and Stanart Development Co. , Inc. , and Leland Hall, Secretary for Paubet Enterprises, owners of premises shown upon a map known as Subdivision Map of Section 5, Murdock Woods, Town of Mamaroneck, which is known as Block 304, Parcel 443 and Block 304, Parcel 546 on the Tax Assessment Map of the Town of Mamaroneck, have filed with this Board an application for the approval of this map and the plans and specifications for the construction of roads, drains, sewers, including a sewer pumping station; and WHEREAS, a public hearing was duly held, pursuant to the provisions of Section 276 of the Town Law, after notice pub- lished in the official newspaper of the Town of Mamaroneck, the Daily Times, on April 30, 1963 ; and WHEREAS, this Board has examined the plans and specifications and determined that the same are all satisfactory, NOW, THEREFORE, BE IT RESOLVED that the application of Meyer B. Goldstein, agent for Mansol Developers, Inc. and Stanart Development Co. , Inc. and Leland Hall, Secretary for Paubet Enterprises, be and the same is hereby granted, and the map known as "Subdivision Map of Murdock Woods, Section 5, Town of Mamaroneck,Westchester County, New York" made by Thomas John McEvoy, N.Y.S. License #39309 and dated February 28, 1963 ; together with the construction drawings for all utilities and improvements, including drains, roads, sewers, including a sewer pumping station, are hereby approved, upon the following conditions: 1. That the applicants furnish a performance bond in the amount of $200,000.00, pursuant to Section 277 of the Town Law; such bond to run for a term not to exceed three years and to be issued by a bonding or surety company and be subject to approval by the Town Board of the security and sufficiency and manner of execution as provided in Section 277 of the Town Law; the condition of such bond to be as stated in Section 277 of the Town Law, for the installation of all improvements and utilities as shown upon the plans and construction draw- ings . 2. That formal offers or deeds of cession to the public of all streets, highways or public places not marked with notation on the plat and easements for drain and sewer as shown on "Subdivision Map of Murdock Woods, Section 5, Town of Mamaroneck, Westchester County, New York" made by Thomas John McEvoy, N.Y.S. License #39309 and dated February 28, 1963, be filed with the Planning Board in form satisfactory to the Town Attorney to be held until such streets are formally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of Mamaroneck of 382 the dedication of any such street or highway nor waive the payment of necessary charges, including title search and recording fees; but such acceptance shall be based solely upon the adoption of a resolution by the Town Board. FURTHER RESOLVED, that upon compliance with the above conditions, It the Chairman of the Planning Board is hereby authorized to sign such subdivision map as evidence of the approval of same by this Board. l® Z PRELIMINARY PLAN - LUNDY LAND - Viggo Borgen, Loreto Poccia W Mr. Borgen submitted plans for a proposed subdivision to be known Was Lundy Lane. Ll.. d5 The problem of a retaining wall was raised,said wall to be behind the properties of E. J. McDonnel, 22 Harrison Drive, C. B. Monroe, 32 Harrison Drive and A. Novick, 20 Harrison Drive. O Messrs. McDonnel, Monroe and Novick stated that they would have C) no objections to surveyors entering their back yards to obtain cross m section surveys and data as set forth on page 20 of the Planning Board Regulations adopted May 3 , 1961. The problem of drainage in the entire area was recognized, however, this problem is not as yet solved. The applicants Mr. Borgen and Mr. Poccia agreed to study lowering the proposed profile and certain other changes. It was agreed that the Board would notify Mrs. Monroe if and when Mr. Borgen and Mr. Poccia submit further proposals to the Planning Board. HIGH RIDGE ROAD - Alfred Poccia Mr. Poccia appeared and discussed alternate treatments to the High Ridge Road situation. Mr. Poccia will seek approval of a neighbor, a Mrs. Camp, in order to get such clear title, as would allow him to construct a cul-de-sac and to abandon an earlier proposed exten- sion of High Ridge Road. COMMUNICATION - GLEN ROCK ESTATES A letter from Joseph W. Gleicher, President of Glen Rock Estates, requesting that the bond for Glen Rock Estates be reduced to $5,000.00 was read. U.1 If) A discussion followed as to the conditions of the subdivision, etc. Q The Engineer recommended that the bond be reduced to $14,000.00. U.1 0 65 Following this discussion it was, 383 0 C) 00 RESOLVED, that a Public Hearing on the reduction for the bond of Glen Rock Estates be held at the next regular meeting of this Board on June 3, 1963. FURTHER RESOLVED that the secretary be authorized and directed to publish a notice of Public Hearing on or before the 28th of May 1963, such notice to read as follows: PUBLIC NOTICE PLEASE TAKE NOTICE, that Joseph W. Gleicher, President of Glen Rock Estates, 55 Liberty Street, New York, New York has asked for a reduction of the performance bond on a subdivision known as Glen Rock Estates, which was approved by this Board on October 6, 1958. TAKE FURTHER NOTICE that the Town of Mamaroneck Planning Board pursuant to Section 277 of the Town Law will hold a public hearing on Monday, June 3, 1963, in the Town Offices, 158 W. Post Road, Mamaroneck, N.Y. at 8:15 p.m. for the purpose of considering this application. TAKE FURTHER NOTICE, that all persons present will be given an opportunity to be heard.
