HomeMy WebLinkAbout1964_06_22 Planning Board Minutes 1 MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING BOARD HELD JUNE 22, 1964, IN THE CONFERENCE ROOM OF THE TOWN OFFICES, 158 WEST POST ROAD, MAMARONECK, NEW YORK, CALL TO ORDER The Chairman called the meeting to order at 8:35 p.m. PRESENT: Fred L. Maggini, Chairman Joseph Rigano Lee Bloom D. B. Follansbee ABSENT: G. Norman Blair ALSO PRESENT: Frederick F. Kellogg, Jr., Town Engineer MINUTES On motion duly made and seconded, the minutes of the meeting held June 8, 1964 were approved as presented. PUBLIC HEARING - CARRIAGE HOUSE LANE The secretary presented the affidavit of publication of notice of the Public Hearing as published in the Daily Times, June 12, 1964, The Chairman declared the hearing open and inquired whether any person present wished to be heard. Since there was no one present to oppose the subdivision, Mr. Maggini asked Mr. Kellogg the amount he recommended be set for the performance bond. Mr. Kellogg stated he had discovered one man hole, at approximately station 3 + 00 on Well House Lane, omitted on plan due to an oversight, but had covered same in his estimate. Mr. Kellogg suggested said man hole be added to the construction plans. This was agreed to by Mr. Shroder, Mr. Kellogg then reported the bend Should be in:the amount of $195,000.00. William Shorder, agent for Edward Basso, thought this amount was extremely high and Russell Clune, attorney for Edward Basso, asked the Board to consider reducing the bond as Mr. Shroder had an estimate of $75,000.00 from some of his contractors. Mr. Shroder had nothing in writing to present to the Board to justify the $75,000.00 amount and it was further noted that the $75,000.00 amount might not include the various rock and contingency items for which Mr. Kellogg had provided for. Mr. Shroder also expressed concern as to whether he would be able to get an insurance company to write the bond in this amount. Mr. Kellogg explained, in detail, how he arrived at the etimated $195,000.00 figure. Following some further discussion Mr. Rigano suggested the Board follow Mr. Kellogg's recommended amount of $195,000.00 and the other members of the Board concurred. Mr. Kellogg explained to Mr. Shroder and Mr. Clune that after certain items such as rock removal and other underground work, where unestimable con- tingency items might be fohnd, were completed, a public hearing as provided in Section 277 of the Town Law might be held wherein a reduction of the $195,000.00 amount could be publicly considered. Mr. Clune then delivered to the Board, drafts of 3 legal instruments namely an easement from Radlo Realty Co., Inc. for sewer purposes, an easement from E. Basso, over lots 1,2,3 & 4, for sewer and utility purposes and also a deed for the beds of the three 407 streets within the proposed subdivision. As the Town Attorney was absent, Mr. Kellogg agreed to deliver and discuss these instruments with the Town Attorney who would in turn reply to Mr. Clune. Mr. Clune stated publicly his willing- ness to amend and revise the drafts of these instruments to conform with the Town Attorney's requirements on this subject. Whereas, upon motion by Mr. Bloom, seconded by Mr. Rigano the following resolution was unanimously adopted: WHEREAS, Edward Basso owner of premises shown upon a map known as Subdivi- sion Map of Carriage House Lane in the Town of Mamaroneck, Westchester County, New York made by Thomas John McEvoy, N.Y.S. License No. 39309 and dated February 27, 1964, which is known as Block 340 Parcel 413 on the Tax Assessment Map of the Town of Mamaroneck, have filed with this Board an application for the approval of this plat and the accompanying construction drawings for the construction of roads, drains, sewers, water lines and all necessary improvements; and WHEREAS, a Public Hearing was duly held, pursuant to the provisions of Sec- tion 276 of the Town Law, after notice published in the official newspaper of the Town of Mamaroneck, The Daily Times, on June 12, 1964; and WHEREAS, this Board has examined the plans and determined that the same are all satisfactory, NOW, THEREFORE, BE IT RESOLVED, that the application of Edward Basso, be and the same is hereby granted, and the map hereinable referred to; together with the construction drawings for all reads, drains, sewers, water lines and all necessary im- provements, are hereby approved, upon the following conditions: 1. That the applicant furnish a performance bond in the amount of $195,000.00 pursuant to Section 277 of the Town Law; such bond to run for a term of 2 years and to be issued by a bonding or surety company and be subject to approval by the Town Board as to the security and sufficiency and manner of execution as provided in Section 277 of the Town Law; the conditions of such bond to be as stated in Section 277 of the Town Law, for the in- stallation of all roads, drains, sewers, water lines and all necessary improvements as shown on the construction drawings. 2. That formal deeds of cession to the public of all streets, highways or public places as shown on the map hereinable referred to be filed with the Planning Board in form satisfactory to the Town Attorney and that such shall be held until such streets are formally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of Mamaroneck of the dedication of any such street or highway nor waive the payment of necessary charges, including title search and recording fees; but such acceptances shall be based solely upon the adoption of a resolution by the Town Board. 3. That the applicants obtain approval from the Westchester Joint Water Works and from the Town Board of the Town of Mamaroneck, for the extension of the water mains as shown on said construction drawings and that an amount sufficient to cover the cost of the installation and/or inspection of said water lines and appurtenances as estimated and required by the manager of said Water Works, be deposited with said Water Works. 408 4-41 4. That an easement for purposes of installation, maintenance and service of water lines and appurtenances in the streets and elsewhere, and easements for construction and maintenance of "off-street" sewers, drains, other utility items and such other easements as the Town Attorney may require, in form satisfactory to the Town Attorney, be delivered to the said attorney and recorded prior to the installation of such water lines, appurtenances, sewers, drains, and other utility items. FURTHER RESOLVED, that upon compliance with the above conditions, the Chair- man of the Planning Board is hereby authorized to sign such subdivision plat as evidence of the approval of same by this Board. WENDY MANOR SUBDIVISION The secretary stated a status inquiry had been received from The Travelers Insurance Company on June 9, 1964, the bonding company covering Maple Hill Construction Co., Inc. and had been answered on June 10, 1964. A copy of each letter was received and filed for the record. ADJOURNMENT There being no':bmsfngss`pegding before the Board, it was decided to call this meeting of June 22, 1964 a regular meeting and bypass the July 6, 1964 meeting due to vacations, etc. The next meeting to be on August 3rd. There being no further business to come before this meeting it was adjourned at 9:10 p.m. 409
