BOARD HELD JUNE 14, 1967, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The Chairman called the meeting to order at 8:20 p.m.

APPROVAL OF MINUTES
The minutes of the meeting of May 10, 1967 were pre-
sented and on motion duly made and seconded, approved
as corrected.
The Chairman requested the Secretary to read the
application for Public Hearing.
PUBLIC HEARING - NORTH BROOK ROAD
The following persons appeared in favor of this ap-
plication:
Mr. Alfred Poccia, applicant
Mrs. Lily S. Siegel, 3 North Brook Road
Dr. John L. Frascella, 7 North Brook Road
The Chairman declared the hearing open and Mr. Poccia
appeared in behalf of his application.
Mr. Maggini stated that the Board had discussed the
32' radius on the cul-de-sac with the Fire Chief
and they did not like it.
Mrs. Siegel and Dr. Frascella both stated that they
felt the houses would improve the area and that at
the present time the fire trucks and other vehicles
have to back up to turn around. Dr. Frascella was
concerned as to whether or not the large oak tree
on one of the lots was to be preserved. Mr. Poccia
assured the Board that he would try if at all pos-
sible to leave the tree.
Following further discussion the Board decided that
Mr. Poccia and Mr. Widulski should get together to

see what could be done about increasing the diameter
of the cul-de-sac before they could give final ap-
proval to the subdivision.
BRIAR HILL - SECTION 2 - SUBDIVISION
The following persons appeared in reference to this
application:

Mr. Sumetz presented the Board with a revised map.
A notice had been sent to residents of the surround-
ing properties to inform them that the Board was
considering the application of Mr. Sumetz for per-
mission to build 8 more houses.
Mr. Gagliardi submitted a memorandum to the Board
which was filed for the record in reference to the
sewer situation. Mr. Gagliardi and the other resi-
dents claim that they have sewer back-up in their
cellars and the sewer at the present time is not
adequate to take care of the homes that have already
been built in the subdivision. The present residents
cannot see how the sewer in its present condition
could possibly be adequate to take care of additional
homes. Mr. Bloom pointed out that the Planning Board
did not have jurisdiction over the existing sewers
and actually it was a matter for the Town Board.
Mr. Widulski had gone up to the subdivision and a
"dye test" was given to all the homes. The lines
on Bonnie Way were in good condition and about 50%
full. The normal is about 75% or 3/4 full. Mr.
Widulski pointed out that the sewer system would
be adequate if there was no infiltration.
Mr. Martin spoke about the surface water that over-
flows into the yards from the brook. It was pointed
out that the work that the Town had done in back of
Dr. and Mrs. Haralambie's house and any work the
Town had done on the brook which was on property
owned by an individual home owner was not the Town's
responsibility but only done "out of the goodness
of their hearts".
The Secretary was asked to write a memo to the Town
Board recommending they give serious thought to re-
lieving the sewerage overflow problem on Bonnie Way
and that it be considered a part of next year's bud-
get.
The Board, also, stated that they felt Mr. Sumetz
had done a good job and had always been cooperative.
After further discussion a motion was made, moved
and seconded that the subdivision known as Briar
Hill - Section 2 Subdivision be approved and the
following Resolution duly adopted:
WHEREAS, Adam A. Sumetz has filed an ap-
plication for the approval of plans for
the construction of improvements of the
streets, sewers, drains, etc. , in Briar
Hill - Section 2 which is a subdivision
found on a map known as "Subdivision Map
of Briar Hill - Section 2" in the Town of
Mamaroneck, Westchester County, New York
known on the Tax Assessment Map of the Town
of Mamaroneck as Block 105 Parcel 10, and
WHEREAS a Public Hearing was duly held pur-
suant to the provisions of Section 276 of
the Town Law after notice published in the
official newspaper of the Town of Mamaroneck,
the Daily Times on May 3, 1967; and
WHEREAS, on May 10, 1967 a Public Hearing
was held but decision was reserved for the
next regular meeting of the Planning Board;
and
WHEREAS, at the regular meeting held on
June 14, 1967 the Board examined the plans
and reviewed comments made by the neighbor-
ing property owners and has determined that
the plans, as revised, are all satisfactory
NOW, THEREFORE, BE IT
RESOLVED, that the application of Adam A.
Sumetz be approved subject to the follow-
ing conditions:
1. That the applicant shall
install all street improvements
in accordance with the plans
filed with this application and
in accordance with the standards
and specifications and procedure
acceptable to the appropriate
Town Departments, and any revi-
sions which are noted on the
final plans.
2. That no building permit shall
be issued until the applicant
has furnished a performance bond
in an amount specified by the
Town Engineer for the completion
of such improvements, such bond
to run for a term of two years
and to be issued by a bonding
or surety company approved by
the Town Board as to form, suf-
ficiency and manner of execution.
3. That formal offers or deeds
of cession to the public of all
streets, highways, easements
or public places indicated on
the plans filed with the Plan-
ning Board shall be in form sat-
isfactory to the Town Attorney
and shall be held by said Attor-
ney until such streets are for-
mally accepted by the Town Board,
provided that such delivery of
such offers or deeds shall not
constitute an acceptance by the
Town of the dedication of any
such street, highway, easements,
or public place, nor waive the
payment of necessary title charges
and recording fees; but that
such acceptance shall be based
solely upon the adoption of a
Resolution by the Town Board.
FURTHER RESOLVED, that upon compliance
with the above conditions, the Chairman
of the Planning Board is hereby authorized
to sign such subdivision map as evidence
of approval of the same.
MURDOCK WOODS PETITION
A letter was received from Mr. Johnston advising
Mr. Maggini of a petition from the residents of
Murdock Woods regarding Parcel A. The Secretary
was advised to write a memo to the Town Attorney
asking him to advise the petitioners that the
Planning Board is of the opinion that Parcel A
should be held by the Town and possibly at some
future date could be used for "public streets or
avenues" pursuant to the Resolution of the Planning
Board dated May 6, 1963.
BALDWIN HILLS PETITION
Mr. Johnston in his memo to the Planning Board, also,
referred to a petition from the residents of the
Baldwin Hills Subdivision. The Secretary was in-
structed to write a memo to the Town Board and send
a copy to Mr. Johnston recommending that for the
present the Town maintain ownership of Lot #10.
The lot should be improved and possibly at some
future time the Town should consider disposing of
the Lot or using it for other purposes.
