BOARD HELD JULY 10, 1968, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The Chairman called the meeting to order at 8:25 p.m.

APPROVAL OF MINUTES
The minutes of the meeting of June 12, 1968 were
presented and on motion duly made and seconded, ap-
proved as submitted.
PUBLIC HEARING
The Chairman declared the hearing open and the Sec-
retary presented for the record the affidavit of
publication of the notice of hearing.
The Chairman requested the Secretary to read the
Public Notice.
APPLICATION - WILD OAK ESTATES SUBDIVISION
Mr. Lawrence Kramer, Mr. Frank Geller and Mr. Vin-
cent DiPace appeared before the Board and presented
the final drawings. The Board looked over the plans
and decided the drawings were all in order. The
Board noted that Mr. Emanuelson's recommendations
had been incorporated in the new plan.
Mr. Kramer stated that they intended to put in a
new sewer line according to the plan but that the
lot at the extreme end of the subdivision may be
advantageously served by a gravity line connection
to the sewer line in the Nature Trail area rather
than pump up hill to the new sewer line. Because
the existing sewer line is on Town property it would
be necessary for the applicants to obtain permission
from the Town Board and they were so informed.
The Board pointed out that it would be necessary
to have street lighting and expressed the hope that
Consolidated Edison would place all the utilities
underground.

It was suggested that Mr. Widulski check with the
Fire Chief as to whether it is necessary to put in
another fire hydrant. The Town Engineer will deter-
mine the amount of the Performance Bond and notify
Mr. Kramer.
Mrs. Litchfield, Chairman of the Village of Mamaro-
neck Planning Board appeared at the meeting and looked
at the plans. Mrs. Litchfield stated that the Village
had no objection to the application.
The applicants were instructed to prepare the deeds
and present same to Mr. Johnston, the Town Attorney.
They were, also, advised to have their construction
drawings approved by the Health Department and Joint
Water Works before Mr. Maggini can sign the plan.
There was no one in oppostion to the application
and after a short discussion on motion duly made
and seconded it was decided the following Resolution
be adopted:
WHEREAS, Mr. Lawrence Kramer, Agent of
premises shown upon map known as "A sub-
division Map of Wild Oak Estates" in the
Town of Mamaroneck, Westchester County,
New York, which is known as Block 320 Par-
cels 430 and 426 on the Tax Assessment
Map of the Town of Mamaroneck, has filed
with this Board an application for the
approval of this plat and the accompany-
ing construction drawings for the construc-
tion of roads, drains, sewers, water lines,
and all necessary improvements; and
WHEREAS, a Public Hearing was duly held
pursuant to the provisions of Section 276
of the Town Law, after notice published
in the official newspaper of the Town of
Mamaroneck, the Daily Times, on July 5,
1968; and
WHEREAS, this Board has examined the plans
and determined that the same are all sat-
isfactory;
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr. Law-
rence Kramer, Agent, be and the same is
hereby granted, and the map known as "A
Subdivision Map of Wild Oak Estates", in
the Town of Mamaroneck, Westchester County,
New York is hereby approved, together with
construction drawings for all roads, drains,
sewers, water lines and all necessary improve-
ments, upon the following conditions:
1. That the applicants furnish a
performance bond in the amount of
$14,000.00 pursuant to Section
277 of the Town Law; such bond
to run for a term of two years
and to be issued by a bonding
or surety company and be subject
to the approval of the Town Board
as to the security and sufficiency
and manner of execution as pro-
vided in Section 277 of the Town
Law, for the installation of all
roads, drains, sewers, water lines
and all necessary improvements
as shown on the construction
drawings.
2. That the formal deeds of
cession to the public of all
streets, highways or public places
and any necessary easements as
shown on "A Subdivision Map of
Wild Oak Estates", in the Town
of Mamaroneck, Westchester County,
New York, be filed with the Plan-
ning Board in form satisfactory
to the Town Attorney and that
such shall be held until such
streets are formally accepted
by the Town Board, provided that
such delivery of such offers
or deeds shall not constitute
an acceptance by the Town of
Mamaroneck of the dedication
of any such street or highway
nor waive the payment of nece-
ssary charges, including title
research and recording fees;
but such acceptance shall be
based solely upon the adoption
of a Resolution by the Town Board.
3. That the applicants obtain
approval from the Westchester
Joint Water Works and from the
Town Board, of the Town of Mama-
roneck, for the extension of
the water mains as shown on said
construction drawings and that
an amount to cover the cost of
the installation of said water
lines and appurtenances as esti-
mated by the manager of said
Water Works, be deposited with
said Water Works.
4. That an easement for purposes
of installation, maintenance
and service of storm water lines
(drains) and appurtenances, in
form satisfactory to the Town
Attorney, be delivered to the
said Attorney and recorded prior
to the installation of said water
lines and appurtenances.
5. That if the applicants decide
to connect into the existing
sewer line which is on Town pro-
perty they obtain permission
from the Town Board.
FURTHER RESOLVED, that upon compliance
with the above conditions, the Chairman
of the Planning Board is hereby authorized
to sign such subdivision plat as evidence
of the approval of same by this Board.
OLD BUSINESS
There being no other matters on the agenda the Board
welcomed Mrs. Litchfield to its meeting and inquired
as to the status of the proposed "cluster" develop-
ment off Fenimore Road and adjacent to Country Road
in the Town of Mamaroneck. Mrs. Litchfield stated
that she had received a call from Mr. Guy Protano,
Jr. , one of the principal sponsors of the development
who informed her that with the application of the
Village Law Statue limiting the number of units to
that which would be accommodated by the standard
subdivision layout procedure, the proposed eighteen
units would then be reduced to some ten or eleven
making the cluster development uneconomical. There-
fore, Mrs. Litchfield stated the developers are con-
sidering appeal for office building use or some other
similar use with the cluster development idea dropped.
Mr. Potenza of the Westchester County Planning Office
presented members of the Board with copies of "West-
chester County Soil and Water Conservation District",
a pamphlet prepared by the District's Board of Dir-
ectors and the Westchester County Planning Office.
The proposed objectives of the Soil Conservation
District Board is to gather information on soil,
watershed and flood control and assist public agencies,
groups and individuals in planning as pertains to
the aforementioned categories.
ADJOURNMENT
There being no further business to come before this
meeting it was adjourned at 8:55 p.m.
