MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING BOARD HELD JANUARY
4, 1965, IN THE ASSESSOR's OFFICE OF THE TOWN OF MAMARONECK, 158 WEST POST ROAD,
MAMARONECK, NEW YORK.
CALL TO ORDER
The Chairman called the meeting to order at 8:25 p.m.

ALSO PRESENT: Anthony Quadrine, Councilman
MINUTES
On motion duly made and seconded, the minutes of the meeting of December 7, 1964
were approved as corrected.
NEW BUSINESS
Vacant lots on Laurel Avenue
Emil Severin, Larchmont Attorney, representing an unnamed absentee owner, and
Joseph Carducci, a possible prospective purchaser, appeared and questioned the Board
in aninformal and pre-preliminary manner regarding Block No. 124, Parcel 234, lo-
cated between Laurel Avenue and the Thruway, approximately 500 feet west of Weaver
Street.
Mr. Carducci stated that if he could get clear title to bed of the street in
front of the above premises, he would be willing to pay for the cost of installing
the street improvements.
Mr. Severin stated that a problem of clear title might exist because the back
yards of about 7 residents on Myrtle Blvd. are contiguous with the presently unim-
proved part of Laurel Avenue (paper street), which is in front of the vacant lots
that are of interest to Mr. Carducci.
Mr. Maggini and members of the Board advised Mr. Severin to check deeds of the
7 Myrtle Blvd. properties and to also contact the 7 residents on Myrtle Blvd. and
return to this Board in February with further information.
Murdock Woods, Section 5
Mr. P. M. Hughes, Jr., 369 Boston Post Road, Larchmont, appeared and submitted
plans and maps showing a proposed change to the course of brook, which change would
require new drainage easements.
Mr. Quadrine inquired as to whether the proposed change would have any adverse
affect on the drainage facilities as previously designed, and stated that he would
contact the Town Engineer and check out this question.
Following some discussion, and subject to Mr. Quadrine's above question being
satisfactorily answered; on motion duly made by Mr. Bloom and seconded by Mr. Blair

the following resolution was unanimously adopted:
RESOLVED, that the Secretary be and she is hereby is authorized to publish in the
official newspaper of the Town of Mamaroneck, The Daily Times, on or before Jsnuary
21, 1965 the following notice calling a public hearing to be held before this Board,
at a regular meeting thereof on February 1, 1965 to consider the approval of a Sub-
division entitled "Revised Subdivision Map Of A Portion Of Murdock Woods - Section 5",
by Thomas John McEvoy, Jr., dated November 20, 1964.
PUBLIC NOTICE
PLEASE TAKE NOTICE, that P. M. Hughes, agent for Stanart Development Co., Inc., owners,
has filed an application for consideration and approval of plans for the revised sub-
division of land known as "Revised Subdivision Map of a Portion of Murdock Woods -
Section 5" in the Town of Mamaroneck, Westchester County, New York, which is in patt;
of B1ock.4Q7.
TAKE FURTHER NOTICE, that the Town of Mamaroneck Planning Board, pursuant to Section
276 and 277 of the Town Law and in accordance with the Rules and Regulations adopted
by it and approved by the Town Board will hold a Public Hearing on Monday, February
1, 1965 in the Assessor's Office of the Mamaroneck Town Office, 158 W. Post Road,
Mamaroneck, New York at 8:15 p.m., at which time it will consider the proposed plat
or subdivision plan as shown on map entitled "Revised Subdivision Map of Murdock
Woods - Section 5 in the Town of Mamaroneck, Westchester County, New York" made by
Thomas John McEvoy, N.Y.S. license No. 39309 and dated November 20, 1964.
TAKE FURTHER NOTICE, that all persons present will be given an opportunity to be
heard.

REPORTS
Mr. Quadrine reported that Westchester County has recently made $90,000.00
in funds available in its 1965 budget for use in the construction of a new sani-
tary sewer to connect from the Prince Willows and Stonewall Lane Areas to a County
Sewer in Mamaroneck Avenue. These two areas are presently served by private septic
tank systems and the new $90,000.00 sewer (across Saxon Woods Park and the Westchester
Joint Water Works Resevoir) would be instrumental in making feasible the future con-
struction of lateral sewers in these two areas.
The secretary was instructed to prepare a letter to Raymond E May, advising
them of the substance of Mr. Quadrine's preceding report.
Decision of the Supreme Court - Novak vs.: Burchell, et al
A memo was read from James J. Johnston, Town Attorney, relating to this subject.
The above decision was discussed and the Planning Board felt that it did not
agree wholeheartedly with the decision by Judge Dillon. The Board expressed the
view, however, that they had no objection to the Town Board calling a Public Hearing
to consider the rezoning of the rear 200 feet of the Novak property.

It was agreed by the members of the Planning Board that Mr. Johnston, the Town
Attorney should convey their feelings to the Town Board, during its consideration
of a possible rezoning, which Mr. Johnston agreed to do.
ADJOURNMENT
There being no further business to come before this meeting it was adjourned
at 10:25 p.m.
