HomeMy WebLinkAbout1966_08_02 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING BOARD HELD AUGUST 2, 1966, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, MAMARONECK, NEW YORK. CALL TO ORDER The Chairman called the meeting to order at 8:20 p.m. ROLL CALL Present: Mr. Fred L. Maggini, Chairman Mr. Lee Bloom Mr. Joseph Rigano Mr. G. Norman Blair Mr. Winfield James Also Present: Mr. William P. Widulski, Town Engineer Mr. James Johnston, Town Attorney APPROVAL OF MINUTES The minutes of the meeting of July 6, 1966 were pre- sented and on motion duly made and seconded, approved as corrected. PUBLIC HEARING - REDUCTION OF PERFORMANCE BOND - LEATHERSTOCKING LANE The Chairman requested the Secretary to read the Public Notice and declared the hearing open. Mr. Vileno, builder and owner of Leatherstocking Lane appeared with his Attorney, Mr. Harold Blass. Mr. Blass requested that inasmuch as they felt the work was completed they would like to have the bond discharged so they could pay the contractor. The street lights and monuments have all been installed but the road has not been accepted. The problem is a question of the pavement settling. As soon as this has been corrected and certain other work com- pleted such as street signs and shoulder•fill the bond will be discharged. A memo was read from Mr. Widulski, the Town Engineer, recommending the bond be reduced to $3,000.00. After a short discussion the Board agreed to the reduction of the Performance Bond to $3,000.00 subject to the approval of the Town Board and providing all ease- ments, deeds, etc. , have been filed to the satisfac- tion of the Town Attorney. The following Resolution was duly adopted to be sent to the Town Board for its approval: fvJ WHEREAS, on October 4, 1965, a Public Hear- ing was held on a subdivision known as Leatherstocking Lane; and WHEREAS, at that time a resolution was duly adopted by this Board setting a Performance Bond for the construction of roads, drains, etc. , in said subdivision in the amount of $64,000.00; and WHEREAS, certain of this construction work has been completed in a manner satisfactory to the Town Engineer as set forth in a memo- randum from him herewith filed recommending the requested reduction; and WHEREAS, pursuant to Section 277 of the Town Law, a public hearing was duly held by this Board on March 1, 1966, to con- sider the request for reduction of the Performance Bond from $64,000.00 to $30,000.00; and all present were given the opportunity to be heard; and WHEREAS, pursuant to Section 277 of the Town Law, a further hearing was duly held by this Board on August 2, 1966, to con- sider the request for reduction of the Performance Bond from $30,000.00 to $3,000.00; and all present were given the opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED, that the Planning Board pursuant to Section 277 of the Town Law and subject to the approval of the Town Board of the Town of Mamaroneck, recommends that the Town Board reduce the amount of said Per- formance Bond from $30,000.00 to $3,000.00 as recommended by the Town Engineer pro- vided all deeds for streets, easements, etc. are filed and accepted by the Town Attorney; and be it further RESOLVED, that certified copies of this Resolution be sent to Mr. Anthony Vileno, builder and owner of Leatherstocking Lane. LAUREL AVENUE Correspondence was received from Meighan & Necarsul- mer regarding the contract to purchase premises on Laurel Avenue by their client, Mr. Joseph Carducci. The Board received a copy of a title report showing interests in the street right-of-way to be held by adjoining property owners except for an interest of -41 the Laurel Avenue Realty Corporation and a question concerning a deed back in 1893. Mr. Hunter Meighan represented Mr. Carducci. The Board decided that they still felt they would not accept a 25 foot width street and inasmuch as the title report fails to indicate certain transfer of property from the Town to purchasers, a further title search could be made. The Secretary was in- structed to so inform Meighan and Necarsulmer. PUBLIC HEARING - REVISED MAP OF MURDOCK WOODS - SECTION 5 The Chairman requested the Secretary to read the Public Notice and declared the hearing open. It appeared that there was no one to represent Sal- drian Developers, Inc. , owners and developers of Murdock Woods, Section 5, and the Board discussed the situation on this subdivision. Mr. Johnston had been in touch with Mr. Strausberg, one of the principals in connection with this sub- division and advised that Mr. Strausberg apologized for the statement attributed to Mr. Goldstein and Mr. Hughes to the effect that they would abandon the project. Mr. Strausberg stated they had no authority to make such a statement and gave his per- sonal assurance that the work would be completed. The Board decided that the revised map would be ap- proved after completion of the work. "COMPREHENSIVE MASTER PLAN" The members of the Planning Board received their copies of the Comprehensive Master Plan. Some of the members of the Planning Board had reviewed the Master Plan during its formation and the Secretary was instructed to write a memo to the Town Board advising them of their approval of same. MISCELLANEOUS A motion was duly made, seconded and approved that the Secretary send a memo to the Town Board request- ing their authority to approve subdivision plats with- out streets.
