HomeMy WebLinkAbout1965_02_01 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING BOARD HELD FEBRUARY 1, 1965, IN THE ASSESSOR'S OFFICE OF THE TOWN OF MAMARONECK, 154 WEST POST ROAD, MAMARONECK, NEW YORK. CALL TO ORDER The Chairman called the meeting to order at 8:20 p.m. PRESENT: Fred L. Maggini, Chairman Lee Bloom Joseph Rigano ABSENT: G. Norman Blair D. B. Follansbee ALSO PRESENT: Frederick F. Kellogg, Town Engineer Anthony Quadrine, Councilman MINUTES: On motion duly made and seconded, the minutes of the meeting of January 4, 1965 were approved as presented. PUBLIC HEARING - "Revised Subdivision Map of a Portion of Murdock Woods - Section 5" The Chairman declared the hearing open and inquired whether any person present wished to be heard. The Secretary presented the affidavit of publication of notice of the Public Hearing as published in the Daily Times, January 21, 1965. There was no one present to oppose the subdivision. Thomas John McEvoy appeared representing Stanart Development Co. , Inc. Following some further discussion and on motion duly made and seconded the follow- ing resolution was unanimously adopted: WHEREAS, P.M. Hughes, agent for Stanart Development Co. , Inc. , owner of premises shown upon a map known as "Revised Subdivision Map of a Portion of Murdock Woods - Section 5", in the Town of Mamaroneck, Westchester County, New Ydrk made by Thomas John McEvoy, N.Y.S. License No. 39309 and dated November 20, 1964, which is known as part of Block 307 on the Tax Assessment Map of the Town of Mamaroneck, has filed with this Board an application for the approval of this plat and the accompanying construction drawings for the construct- ion of roads, drains, sewers, water lines and all necessary improvements, and WHEREAS, a Public Hearing was duly held, pursuant to the provisions of Section 276 of the Town Law, after notice published in the official newspaper of the Town of Mamaroneck, The Daily Times, on January 21, 1965; and WHEREAS, no lot sizes, shapes or areas on the revised map were different than those shown on the preceding original map entitled "Subdivision Map of Murdock Woods, Section 5, Town of Mamaroneck, Westchester County, New York" and approved at a meeting held May 6, 1963 and filed in the office of the Clerk of the County of Westchester on June 25, 1963 as Map # 13725 and, 425 WHEREAS, no street lines changed and, WHEREAS, the principal change was the relocation of a drainage easement from the rear and side lines of several lots to the front line of those lots; also includ- edwere several new driveway bridges of such size and capacity as to be consistent hydraulically and architecturally with other bridges previously approved downstream on the same water courses and, WHEREAS, the present bond in amount of $200,000.00 issued by the Continental Casualty Co. (Bond #752692 dated June 19, 1963) is deemed to be sufficient in amount so as to include either the original piping and easement scheme or' scheme concomitant with the pending application, NOW, THEREFORE BE IT RESOLVED, that the application of P. M. Hughes be and the same is hereby granted and the map herein above referred to; together with the construction drawing (as revised) for all roads, drains, sewers, water lines and all necessary improvements, are here- by approved, upon the following conditions: 1. That the term and the amount of the performance bond furnished by the owners pursuant to Section 277 of the Town Law remain unchanged by this approval. 2. That deeds, easements or such other instruments relating to streets, highways, easements or public places as shown on the map herein above referred to, all accompanied by such title search or searches as the Town Attorney may require, be filed with the Planning Board in form satisfactory to the Town Attorney and that such instruments shall in- clude an encumbrance upon said street, highway, easements and/or pub- lic places so as to require the owner, his heirs, successors, or assigns to be obligated to install all necessary roads, drains, sewers, water lines and all other necessary improvements and further that such de- livery and recording of such :instruments shall not constitute a formal acceptance of the Town of Mamaroneck of the dedication of any such street highway, easement or public place, but such formal acceptance shall be based solely upon the adoption of a resolution by the Town Board. 3. That this Board waives the usual procedure involving an approval by the Westchester Joint Water Works by reason of the said fact that the water lines on the revised drawings are identical with the water lines previously approved by said water works. Carriage House Lane The Secretary reported that a letter had been received from Carriage House Lane, Inc. , requesting a reduction in bond. The said letter was read aloud and the Engineer was instructed to prepare the estimate for the revised bond and for same estimate to be presented by the March 1st. meeting. The Engineer was fur- ther instructed to write a letter to Carriage House Lane, Inc. , and advise them of the Board's action. It was noted that the letter from Carriage House Lane, Inc. had been received as recently as the morning of this meeting. This letter was re- ceived and filed for the record. Baldwin Property Pre-Preliminary request by Jason-McKenna Corporation 426 Thomas John McEvoy presented a sketch, copies of which he had previously de- livered to the Planning Board Members and he informally explained that the sketch represented his preliminary thinking regarding a future proposed subdivision on the Baldwin property. Mr. Maggini commented on a steep 12% grade at the cul-de-sac of the proposed street. It was the feeling of the Board that the lots around this cul-de-sac should be restudied and that efforts be made by the owner to increase the lot size near the cul-de-sac and to shorten length of the cul-de-sac. The members present generally concurred with Mr. Maggini's suggestion by reason of the extremely steep grades on the lots themselves near the end of the cul-de-sac. Mr. McEvoy stated that he would restudy this cul-de-sac and its surrounding lots, and hoped to have the revised studies ready by the next Planning Board meeting. REPORTS Mr. Quadrine reported that he was continuing investigating the request by the Planning Board members regarding the Planning Board's wishes to be covered by appro- priate accident and/or liability insurance.
