MINUTES OF THE REGULAR MEETINGS OF THE BOARD OF FIRE COMMISSIONERS AND THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD ON THE 1ST DAY OF FEBRUARY, 1984, IN THE COUNCIL ROOM AND THE AUDITORIUM OF THE WEAVER STREET FIREHOUSE, TOWN OF MAMARONECK. CONVENE REGULAR MEETING The regular meeting of the Town Board was called to order by Deputy Super- visor Caroline Silverstone at 7:55 P.M. in the Auditorium. Present were the following: Deputy Supervisor Caroline Silverstone Councilman Thomas R. Amlicke Councilman Lawrence A. Lerman Supervisor Dolores A. Battalia and Councilman Lee H. Bloom were not in attendance at this meeting because the Supervisor was attending a train- ing session in Albany and Councilman Bloom was out of town on business. Town Administrator Stephen V. Altieri, Counsel to the Town Steven M. Sil- verberg, and Assessor George Derderian were also present. On motion by Councilman Amlicke, seconded by Councilman Lerman, it was unanimously RESOLVED, that this Board immediately recess into Executive Session in the Council Room to discuss pending litigation. Pending certiorari settlements and the Perritano litigation were dis- cussed, and the Board received specific information on each matter from the Assessor and the Counsel to the Town. On motion duly made and seconded, the Executive Session was unanimously adjourned. CALL TO ATTENTION - Location of Exits Deputy Supervisor Silverstone pointed out to those assembled the loca- tion of exits in the auditorium as required by law for public gatherings. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner Silverstone at 8:22 P.M. in the auditorium. Present were the following: Commissioner Caroline Silverstone Commissioner.Thomas R. Amlicke Commissioner Lawrence A. Lerman Commissioner Dolores A. Battalia and Commissioner Lee H. Bloom were not in attendance at this meeting. - 1 - 029 Also present were: Dorothy S. Miller, Town Clerk Carol A. Acocella, Deputy Town Clerk Stephen V. Altieri, Town Administrator Steven M. Silverberg,. Counsel to the Town Carmine A. DeLuca, Comptroller George Derderian, Assessor L. Douglas Fletcher, Fire Chief P. Thomas Leddy, Highway Superintendent 1. Claims In Commissioner Bloom's absence, Commissioner Amlicke presented fire claims for authorization of payment, and on a motion made by Commissioner. Lerman and seconded by Commissioner Amlicke, it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's office: AAA Emergency Supply $ 201.80 Dri-Chem Extinguisher Co. 191.50 tt 29.00 Exterminating Services Company 18.24 Group Health Insurance 157.92 Larchmont Auto Parts Distributors 21.85 I & T Plumbing 47.45 McGovern, Connelly & Davidson 2,632.40 Lawrence Heat & Power Corp. 1,139.72 Leonard Newman Agency, Inc. 791.00 New York Telephone Company `65.38 New York Telephone Company 876.42 New York Telephone Company 9.00 Portronix Communications 266.00 Town of Mamaroneck General Fund 107.25 Town of Mamaroneck Professional Fire Fighters Association 102.18 Kenneth Valle 147.00 $6,804.11 Commissioner Amlicke requested that the Comptroller provide the Board members with a brief explanation of each claim presented for payment. He also asked about the status of the analysis of the 1983 repairs to fire vehicles. ADJOURNMENT There being no further business to come before this Commission, on motion by Commissioner Amlicke, seconded by Commissioner Lerman, this meeting was declared adjourned at 8:29 P.M. RECONVENE REGULAR MEETING At this time on motion duly made and seconded, it was unanimously re- solved that the regular meeting be reconvened. - 2 - 030► APPROVAL OF MINUTES Because there was not a quorum, the minutes of the January 19, 1984, Town Board Meeting were not presented and were tabled until the February 15, 1984, meeting. AFFAIRS OF THE TOWN 1. Proposed Certiorari Settlements: a) Vermillion Building Corp. vs. Town of Mamaroneck Pursuant to the information submitted by the Assessor, on motion by Coun- cilman Amlicke, seconded by Councilman Lerman, it was unanimously RESOLVED, that in accordance with the terms recommended by the Assessor, this Board hereby authorizes the settlement of certiorari pro- ceeding - Vermillion Bldg. Corp. vs. Town of Mamaroneck - for assessment years 1979 through 1983. b) Fenmar Realty Corp. vs. Town of Mamaroneck Pursuant to the information submitted by the Assessor, on motion by Coun- cilman Lerman, seconded by Councilman Amlicke, it was unanimously RESOLVED, that, in accordance with the terms recommended by the Assessor, this Board hereby authorizes the settlement of certiorari pro- ceeding - Fenmar Realty Corp. vs. Town of Mamaroneck - for assessment years 1981 through 1983. 2. Salary Authorization - Intermediate Account Clerk (Comptroller's Office) The Deputy Supervisor reported that a long-time employee in the Comptrol- ler's Office is retiring, and after canvassing the appropriate civil ser- vice eligibility list, a candidate has been selected to replace Catherine D'Agostino. Thereafter, on motion by Councilman Amlicke, seconded by Councilman Lerman, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to hire Susan Colucci of 14 Sweetfield Circle, Yonkers, New York, as Intermediate Account Clerk at an annual salary of $15,885. 3. Salary Authorization - School Crossing Guard On motion by Councilman Amlicke and seconded,by Councilman Lerman, it was unanimously RESOLVED, that this Board hereby authorizes the hiring of Angelina Caggiano of 825C Larch- Ill mont Acres, Town of Mamaroneck, for the posi- tion of substitute school guard, replacing Joy Aronson, and that she be compensated at the rate of $26.00 per day, effective January 23, 1984. - 3 - 031 4. Set Date for Public Hearing - Local Law to Set Fire Limits As requested by the Deputy Supervisor, Mr. Altieri explained the need for this Board to consider limitations on construction materials to be used within certain areas of the Town. On motion by Councilman Lerman, seconded by Councilman Amlicke, it was unanimously RESOLVED, that this Board hereby sets February 15, 1984, at 8:15 P.M. as the date and time for a Public Hearing on proposed Local Law #1-1984 en- titled "Fire Limits"; and it is further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in The Daily Times, the Notice of said Hearing as required by law. WRITTEN COMMUNICATIONS 1. Deputy Supervisor Silverstone stated that the Town has sent letters to the State Department of Transportation and Metro-North advising of the urgent need for repair of the Weaver Street Bridge. She further noted that a request was made to the County Department of Public Works for paving and resurfacing on Palmer Avenue. ORAL COMMUNICATIONS 1. Marsha Korchoff re Rock Ridge Road The Town Administrator reviewed the current status of the Rock Ridge Road matter with respect to Con Edison and the pending installation of the previously agreed to fence and also noted the recent presence of Town Highway personnel on the street for the purpose of sewer main- tenance. Mrs. Doris Keiser, Mrs. Marsha Kirchoff, William Roehr, Wendel Price, William Eng, Jerry and Marilyn Glaser, all Rock Ridge Road residents, addressed the Board relative to the continuing problem of construction workers using Rock Ridge Road and private property for ingress to the site and saturating the street with their parked cars. The matter of this Board's monitoring and follow-up on this matter and continued support of the Rock Ridge Road residents' concerns, especi- ally in relation to timely notification of various Mamaroneck Village meetings, was discussed. Mr. Altieri advised that the developer, Mr. Loewentheil, has been put on notice that the Town will install the fence on February 9th if he does not put it up by February 8th. Another aspect of this matter discussed at length was the hazardous and inconvenient situation of workers' cars parked on both sides of Rock Ridge Road with residents requesting a solution to the use of Rock Ridge Road as a path to the construction site; the impact of the developer's failure to live up to the agreement with the Town; and posting of notices prohibiting Rock Ridge Road as an access. Each of the three Board members present answered questions posed by the audience. Counsel, Steven Silverberg advised that he will look into all proposals made this evening and submit recommendations to the Town Board. - 4 - 032 2. Arthur Gasparini re Freedom of Information and Open Meetings Law Mr. Gasparini presented a prepared statement, which he submitted to the Town Clerk as part of the record of this Meeting, criticizing the contents of a recent memorandum written by the Town's Counsel and the Board's agenda work sessions. Both Deputy Silverstone and Councilman Lerman clarified the reason for Mr. Silverberg's memorandum and the need for the agenda work sessions. Mr. Silverberg advised that he regretted Mr. Gasparini's misunderstand- ing of his memorandum and said it was written in answer to many questions. 3. Arthur Gasparini re Fuel Oil Bids Some discussion followed Mr. Gasparini's notation of his follow-up on the above captioned subject. He stated that he learned that fuel oil is not purchased on a firm price basis and suggested that the Town look into purchasing from an agency which buys in bulk. Both the Town Ad- ministration and Comptroller stated that no one can purchase fuel oil at a firm price for a year and clarified the Town's procedure for pur- chasing fuel oil. As was stated previously, the Town will be looking into alternatives with respect to the purchase of fuel oil. 4. Ralph Fisher re Town Audit Report Some discussion followed Mr. Fisher's query as to the accuracy of a re- cent newspaper article regarding the above noted report. Deputy Super- "' Silverstone advised that the report is available in the Town Clerk's Office and presented Supervisor Battalia's statement, noting that she has asked department heads to respond to items in the audit and that the mat- ter can be discussed at the meeting of February 15th. 5. Leonard Martin re Response to Budget Committee Mr. Martin asked if a response to the Budget Committee's letter would be forthcoming. He was advised that the matter would be referred to the Supervisor. THE TOWN CLERK Regular Reports The Clerk presented the report of the Building Inspector's Office for the month of January, 1984. She also reported the receipt of the State Comptroller's Report of Exami- nation of the Town of Mamaroneck for the year ended December 31, 1982. Mrs. Miller reported that Assemblyman Perone and Senator Pisani have fol- lowed up on the possible conflict of usage of voting machines by Mamaro- neck and Larchmont Villages on March 20th and the Town for the April 3rd Primary Election. She further advised that, since the State Legislators have provided an interpretation of the law, she will be working with the two Village Clerks to insure a smooth transition of voting machines fol- lowing the Village elections. - 5 - 033 Mrs. Miller reported that she has followed up on Councilman Lerman's suggestion for various documents to be available in the two public libraries and has so discussed that matter with Mrs. Dougherty of the Larchmont Public Library. She noted that Mrs. Dougherty advised that since she already provides access to the Town Code and Town Budgets, acute lack of space would prevent her from accepting minutes. Mrs. Miller noted she has yet to talk to Mrs. Poundstone at the Mamaroneck Free Library. THE DEPUTY SUPERVISOR Mrs. Silverstone reported that the new Town Prosecutors have begun work; that the Annual Meeting of the Joint Sanitation Commission will be held on Friday, February 3rd, at 10:00 A.M. in the Supervisor's Office fol- lowing a meeting with representatives of the County at which time the matter of the County's proposed use of the Larchmont-Mamaroneck transfer station will be discussed; and that the next Agenda Work Session will be held on Tuesday, February 14th at 7:30 A.M. The Deputy Supervisor stated that since each Board member will act as liaison to approximately eight Boards, Commissions, organizations, etc. , taking up many evenings, that explains the reason for varying times for Board related meetings. 1. Proclamation - American History Month 2. Proclamation - Boy Scouts Month 3. Proclamation - Black History Month Deputy Supervisor Silverstone presented the proclamations, annexed hereto, which have been issued by the Supervisor. REPORTS OF THE COUNCILMEN 1. Pool Re-opening Councilman Amlicke referred to the letter written by John Ibelli and him- self which was published in The Daily Times on this date with respect to the above captioned matter. He reviewed the specific problems that had been encountered during the repairs to the pool. He further advised that it is hoped that a re-opening party can be held to celebrate the refur- bished pool. 2. Joint Planning Board Councilman Amlicke reported that he had attended the first meeting of the newly constituted Joint Planning Board. He noted that the Larchmont Vil- lage representatives are current commission chairmen and the Mamaroneck Town representatives are former Supervisor Christine Helwig, former Plan- ning Board Chairman, Norman Blair, and Town Historian Burton Meighan. Mr. Amlicke further noted that the group has started reviewing future developments in light of compatibility with this area and that they asked that assistance be provided them with a representative from the Conserva- tion Advisory Commission. His suggestion was for C.A.C. Chairman, Alan Mason, to be that representative. It was decided that the matter would be tabled and referred to the Supervisor for consideration at the next Town Board Meeting. - 6 - 034 Councilman Lerman 1. Organization Liaison Councilman Lerman announced that he has been appointed liaison to all Civic and Neighborhood organizations and invited them to contact him. Town Clerk Town Administrator - 7 - 033 Whereas, The Congress of the United States by Joint Resolution has designated February as American History Month, III and Whereas, it is in part through the study of American History that we can honor our debt to the wisdom, faith and sacrifice of those who came before us, and Whereas it is in part through study and appreciation of our American heritage that we can preserve our freedom and independence for future generations, and Whereas, in commemoration of the birthdays of two stalwart Am erican patriots and presidents, George Washington and Abraham Lincoln, the Daughters of the American Revolution are sponsoring February as American History Month throughout our nation, Now, Therefore,. III I, Dolores A. Battalia, Supervisor of the Town of Mamaroneck of the State of New York, do hereby proclaim the month of February, 1984, as American History Month throughout the Town of Mamaroneck. In Witness Whereof, I have hereunto set my hand and caused the Seal of the Town of Mamaroneck to be affixed this 27th day of January in the year of our Lord nineteen hundred and eighty-four and the two hundred and eighth year of the independence of the United States of America. Battalia Supervisor III For the Town Council Dated: January the 27th, 1984 036 PROCLAMATION BLACK HISTORY MONTH WHEREAS, Black History Month is celebrated each year in Ill February; and WHEREAS, it is important for the public to be made aware of the achievements and contributions by Black Americans to their Country, their Community and every part of society; and WHEREAS, said contributions and achievements have not only been in the fields of music, sports and civil rights, but also in fields like medicine, science, exploration, industry, politics and the field of battle; and WHEREAS, since February is set aside to focus on black heritage and to study and appreciate the contri- butions of Black Americans; NOW THEREFORE, BE IT RESOLVED, that I, Dolores A. Battalia, Supervisor of the Town of Mamaroneck, do hereby proclaim the month of February, 1984 as BLACK HISTORY MONTH throughout the Town of Mamaroneck and invite all of its residents to join in the celebration of Black History Month and salute the Black history- makers, past and present. Battalia Supervisor For the Town Board Date: February 1, 1984 037 Whereas, the success of Scouting for Cub Scouts, Boy Scouts and Explorers depends on our community organizations; and Whereas, there are eight: churches and synagogues, :schools and parent-teacher associations, service and fraternal clubs, and other community organizations that have been chartered in our area by the Boy Scouts of America to use the Scouting program; and Whereas, the volunteer leaders selected by these chartered organizations are performing an outstanding ser- vice for boys and young men and women; and Whereas, the Westchester-Putnam Council of the Boy Scouts of America and its corps of dedicated volunteer leaders are providing necessary support to the leaders in the Cub Scout packs, Boy Scout troops, and Explorer posts; therefore be it Resolved, that I, Dolores A. Battalia, extend sincere appreciation to our community organizations that use the Scouting program and to their volunteer leaders; and be it further Resolved, that I proclaim the week of February 5 to 11 as Scouting Anniversary Week and urge our citizens to join with me in expressing appreciation to the community organizations and their volunteer Scout- ing leaders for bringing the Spirit of Scouting to our young people.
