BOARD HELD APRIL 24, 1970, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The meeting was called to order by the Chairman at
7:30 P.M.
ROLL CALL
Present: Mr. Fred L. Maggini, Chairman
Mr. Joseph Rigano
Mr. G. Norman Blair
Mr. Howard W. Hand, Jr.
Mr. Edward J. Cibulay
APPLICATION FOR SWIMMING-WADING POOL - MONROE NURSERY SCHOOL -
685 WEAVER STREET
Mr. Maggini explained that he had called this meeting
to resume discussion of the application of Mr. Liber-
tella for a special permit to install a swimming-wad-
ing pool on his premises located at 685 Weaver Street
used as a Nursery School.
Following a review of the plans and the answers for-
warded by Mr. Libertella in reply to eight questions
addressed to him by Mr. Maggini in his letter of
April 16th on behalf of the Planning Board subsequent
to its meeting of April 8, 1970 with the applicant,
copies hereto appended, in response to the Chair's
question as to the Board's pleasure, on motion duly
made and seconded, it was
RESOLVED, that this Board hereby recommends
that the application of Adam Libertella,
owner of the Nursery School dba Weaver
Day Camp, Inc. , for a special permit to
construct a swimming-wading pool on his
premises located at 685 Weaver Street and
known on the Tax Assessment Map of the
Town of Mamaroneck as Block 103 Parcel 5,
be approved.
Upon polling the Board, the vote on the foregoing
Resolution was as follows and the Resolution there-
fore declared duly adopted by a majority vote of
4 "ayes to one "Nay".

Mr. Hand voting Aye
Mr. Cibulay voting Aye

Mr. Rigano stated that while he favored approval of
the application, he did have some concerns about the
161 following items:
1. The proposed addition of the 7 to
8 year old group to the nursery school
age group (up to 6 years of age) .
2. The overcrowding of the area result-
ing from the addition of such group.
3. The creation of hazardous traffic
1 conditions on Weaver Street caused by
the in-and-out traffic to the said premises.
Mr. Maggini also stated for the record his reasons
for voting against the application's approval were
as follows:
1. That approval of this application ,would
constitute an enlargement and extension of
a non-conforming use of property located
in a residential area.
2. That an additional hazardous traffic
situation would be created on Weaver Street.
3. That the proposed dressing rooms and
showers would be inadequate for the pro-
posed child load.
4. That the approval of the application
would be increasing a commercial usage
in a highly restricted and rather expen-
sive one-family residential area. •
The Board directed that pursuant to Section 432 of
the Zoning Ordinance, a report of its recommendations
on the subject application be forwarded to the Town
Board.
ADJOURNMENT
There being no further business to come before this
Special Meeting it was adjourned.
