MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING
BOARD HELD SEPTEMBER 13, 1972, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The meeting was called to order by the acting Chair-
man, Mr. G. Norman Blair at 8:35 P.M.

Absent: Mr. Fred L. Maggini
Mr. James G. Couch
Also present: Mr. Charles R. Elfreich, Town Engineer
APPROVAL OF MINUTES
The minutes of the meeting of July 12, 1972 were
presented and on motion duly made and seconded, ap-
proved as submitted.
PUBLIC HEARING - REDUCTION OF BOND - SUBDIVISION AT END OF NORTH
BROOK ROAD
The Chairman asked the Secretary to read the Public
Notice.
PLEASE TAKE NOTICE that the Town of Mama-
roneck Planning Board pursuant to Section
276 and 277 of the Town Law will hold a
Public Hearing on September 13, 1972 in
the Council Room of the Weaver Street Fire-
house, Weaver Street and Edgewood Avenue,
Larchmont, New York at 8:15 P.M. on the
application of Mr. Alfred J. Poccia, owner
of the premises, for the reduction of the
performance bond required for the construc-
tion of streets, sewers, drains and other
improvements for a subdivision of land
located at the north end of North Brook
Road and known on the Tax Assessment Map
of the Town of Mamaroneck as Block 214
Parcels 364 and 545 and shown on a Map
entitled "Seconded Amended Subdivision
Map - End of North Brook Road" filed at
the Office of the County Clerk, County
of Westchester on August 27, 1971 as Map
Number 17539.
TAKE FURTHER NOTICE that all persons pre-
sent will be given an opportunity to be
heard.
Mr. Poccia appeared before the Board and stated
that he had originally posted a cash performance
bond in the amount of $9,000.00 and since he had
completed all of the work except the street lights
he was requesting the Board to reduce the bond to
$1,000.00. The Board asked Mr. Elfreich for his
comment and he said that Mr. Poccia had completed
all the work except the street lights. Mr. Elfreich
stated that Mr. Poccia had already purchased the
light fixtures but needed to purchase and install
the poles and the balance of $1,000.00 would cover
the remaining work to be done.
After further discussion the Board decided to recom-
mend to the Town Board that Mr. Poccia's bond be
reduced from $9,000.00 to $1,000.00 and the follow-
ing Resolution was hereby adopted to be sent to
the Town Board for their approval:
WHEREAS, on September 9, 1970 a Public
Hearing was held on a subdivision of land
located at the north end of North Brook
Road and known on the Tax Assessment Map
of the Town of Mamaroneck as Block 214
Parcels 364 and 545 and shown on a Map
entitled "Second Amended Subdivision Map -
End of North Brook Road" filed at the Of-
fice of the County Clerk, County of West-
chester on August 27, 1971 as Map number
17539; and
WHEREAS, a Resolution was passed at the
Public Hearing on September 9, 1970 that
no building permits shall be issued until
the applicant either furnishes a perform-
ance bond in an amount specified by the
Town Engineer or the applicant complete
the road and all public improvements and
subsequently the applicant posted a cash
bond in the amount of $9,000.00; and
WHEREAS, certain of this construction work
has been completed in a manner satisfac-
tory to the Town Engineer as set forth
in the minutes of the Planning Board meet-
ing on September 13, 1972 where he recom-
mends the requested reduction; and
WHEREAS, pursuant to Section 277 of the
Town Law, a Public Hearing was duly heard
by this Board on September 13, 1972, to
consider the request for reduction of the
Performance Bond from $9,000.00 to $1,000.00
and all present were given an opportunity
to be heard;

NOW, THEREFORE, BE IT
RESOLVED, that the Planning Board pursuant
to Section 277 of the Town Law and subject
to approval by the Town Board of the Town
of Mamaroneck, hereby reduces the amount
of said Performance Bond from $9,000.00
to $1,000.00 as recommended by the Town
Engineer; and be it
FURTHER RESOLVED, that certified copies
of this Resolution be sent to Mr. A. Poccia,
the applicant.
OLD BUSINESS
Mr. Elfreich informed members of the Board that
nothing had come in as yet from Mr. Lynton or Mr.
Domoto who had appeared before the Board at the last
meeting on July 12, 1972 when a Public Hearing was
held on their application. The Town Engineer told
the Board that he had checked the easement with Mr.
Johnston but the survey showing the one driveway
had not been submitted.
Mr. Elfreich, also, asked members of the Board if
they recalled ifanything had been done in reference
to the turn-around for fire trucks on the Laurel
Avenue subdivision that had been mentioned in the
minutes of the Planning Board meeting on November
13, 1968. After further discussion it was decided
that the members present could not recall if anything
further had been mentioned after the meeting of Novem-
ber 13, 1968.
ADJOURNMENT
There being no further business to come before this
meeting it was adjourned at 9:30 P.M.
