NING BOARD HELD OCTOBER 13, 1971, IN THE COUNCIL ROOM OF THE
WEAVER STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE,
TOWN OF MAMARONECK.
CALL TO ORDER
The Chairman called the meeting to order at 8:20
P.M.

APPROVAL OF MINUTES
The minutes of the meeting of July 14, 1971 were
presented and on motion duly made and seconded,
approved as submitted.
PRELIMINARY HEARING ON SUBDIVISION OF BLOCK 333 PARCELS 836,
837 AND PART OF 880 - "THE FAIRWAYS"
Mr. Munn Brewer, an Attorney, of 188 East Post Road,
White Plains, New York, represented Mr. and Mrs.
Cannella, Mr. Philip Quadrini and Mr. Carmine Sic-
uranza, the owners of the subject property.
Mr. Brewer presented a preliminary plan to the Board
and explained that a similar application had been
presented to the Board several years ago but the
applicant and the Board had not arrived at an under-
standing regarding the provision for recreation.
The previous application was never followed through
and never carried beyond preliminary presentation.
Mr. Brewer stated that he had a copy of a letter
Mr. Cannella had sent to Mr. Johnston, the Town Attor-
ney on July 8, 1969 when an easement had been delivered
to the Town with the condition that any future sub-
division of the surrounding land would not require
a contribution of any land for recreation purposes
and any cash contribution for such purposes would
be limited to not more than $300. per building lot.
Mr. Cannella pointed out to the Board that each par-
cel contained approximately 5 acres and each build-
ing lot was 20,000 square feet or more.
After further discussion the Board advised the ap-
plicants to have their final plans drawn up and ap-
proved by the Town Engineer, Health Department, Water
Department Superintendent before they return for
the Public Hearing. The Board decided they would
prefer to abide by their rule that had been adopted
regarding park or play areas but would check with
Mr. Johnston, the Town Attorney, as to whether the
Town had accepted Mr. Cannella's condition as stated
in his letter of July 8, 1969. It was pointed out
that only the Town Board pursuant to Section 277
of the Town Law could set the amount of money to
be set up as a trust fund for neighborhood park,
playground or recreation purposes.

The Town Board had referred the application of Mr.
Gene Sogioka to the Planning Board for their recom-
mendations. The applicant had requested permission
from the Town Board to use a portion of Town property
for a parking area in the front of his dwelling.
Mr. Sogioka had been granted a variance by the Zon-
ing Board to construct an off-street parking area
with the condition that he obtain permission from
the Town Board as part of the parking facility would
be located on Town property. The space available
in the front yard was 16' with most spaces requir-
ing 20', some 4± of the vehicle would overhang Town
sidewalk area.
Mr. Sogioka stated that his lot is 50' x 100' and
on the side of the house there is a 15' retaining
wall. The applicant said he has a two car garage
in the rear of his property but rents the right-of-
way from Mr. Bryan Doherty who wishes to terminate
the lease to build on the land and will only permit
one car to use the driveway at present. The Board
noted that the two adjacent properties have off-street
parking areas in the front yards and that Mr. Doherty
had submitted a preliminary application for the sub-
division of the property on which the driveway is
located. The Board advised Mr. Sogioka that if the
driveway was used as a public way he may have con-
tinuing use and to check this out with his Attorney.
The Board decided that if Mr. Doherty submits his
final plans for the subdivision the matter of the
driveway easement will be discussed. The Planning
Board also decided that although they do not favor
the parking proposal whereby vehicles back out into
the section of Dillon Road between two curves that
if a satisfactory arrangement for the use of the
easement to the present garage cannot be executed
they see no other alternative but to recommend the
granting of the parking space as requested.

Mr. Robert J. Marcus, an Attorney, of 30 Villa Road
represented Mr. Clement Barone and Mr. and Mrs.
Frank Tricarico of 771 Forest Avenue who own the
property on the opposite side of the Sheldrake River
from the Badger Day Camp. Mr. and Mrs. Richard
A. Granger of 88 Briarcliff Road, Mr. Donald Bouchard
of 769 Forest Avenue and Mr. Ginsberg of 775 Forest
Avenue all appeared to review the application.
Mr. John Collins of 119 Rockland Avenue who owns
the Badger Day Camp proposes to build a wall along
a portion of the bank of the Sheldrake River on
his property. Mr. Collins had constructed a wall
which the Town Board had requested be removed until
a permit was obtained and the Board noted that the
wall had been removed by the applicant.
Mr. Collins engaged Dolph Rotfeld Associates of
512 Mamaroneck Avenue, White Plains, New York to
investigate and report on the feasibility of con-
structing the wall. According to the sketch sub-
mitted by Mr. Rotfeld's office the new wall will
be set back about 5' from the original wall and
the stream will be widened.
The Town Engineer, Mr. Widulski, pointed out that
the proposed wall will not effect the flow of the
Sheldrake River but before any construction is started
a land surveyor or professional engineer should
layout the location in the field to be approved
by the Town Engineer. Mr. Widulski stated that
one of the conditions of the application should
be that Mr. Collins remove the rock along the bed
of the brook and along the bank to upland areas
and that any brush or dead trees along the Badger
Day Camp property at the stream bank be removed
to improve the streams capacity. The Board voted
to recommend Town Board approval with the afore-
mentioned listed as conditions to the permit.
OLD BUSINESS - PERMITTED SPECIAL USE
The Supervisor had requested Mr. Maggini make a
report on suggestions the Planning Board could give
for changing the permitted "Special Use" category.
The Board decided that they did not think there
should be any change. Under certain suggested re-
visions where all required parking, traffic condi-
tions, etc. would require a Special permit, the
effect would be to eliminate all business and in-
dustrial zoned districts and create one Special
Use district.
