MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING
BOARD HELD NOVEMBER 14-, 1973, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEW00D AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The meeting was called to order by the Chairman at
8:15 P.M.
ROLL CALL
Present: Mr. Fred L. Maggini, Chairman
Mr. G. Norman Blair
Absent: Mr. Joseph Rigano
Mr. Edward J. Cibulay
Also present: Mr. Charles R. Elfr-each, Town Engineer
Miss Susan Gallion, Westchester County
Department of Planning
The Chairman explained that because only two members
were present they could only "listen to the appli-
cants".
PRELIMINARY HEARING - SUBDIVISION OF LOT - BLOCK 216 PARCEL 334
The applicant, Mr. Jan Brassem of 23 Myrtle Blvd. ,
was represented by Mr. Hunter Meighan, an Attorney
of 100 Mamaroneck Avenue, Mamaroneck, New York.
Mr. Meighan stated that the lot meets all the require-
ments of a buildable lot and the utilities such as
water, sewer, etc.are all available. The Chairman
pointed out that there were no problems and a Public
Hearing could be set up for the next meeting.
After further discussion the Chairman advised the
Secretary to advertise for a Public Hearing at the
next meeting on December 12, 1973.
PRELIMINARY HEARING - SUBDIVISION OF LOT - BLOCK 346 PARCEL 244
Mr. Edward Spellman the applicant of 1036 Old White --
Plains Road, was represented by Mr. Joseph Glatthaar,
an Attorney of 175 Main Street, White Plains, New
York. Mr. Glatthaar pointed out that the lot in
question has 18,000 sq. ft. instead of the required
20,000 sq. ft. and that Mr. Spellman had been granted
a variance but because the prospective builder had
not been able to go ahead with the construction the
variance had expired. Mr. Ernest Santoro of-1616
James Street, Mamaroneck, who is the builder, showed
the Board the plans for the anticipated house and
stated that the water is already there. It was pointed
out that the plan meets all the requirements of the
County Health Department for the septic field and
that the applicant is aware of the drainage problem
but that Mr. Santoro intends to fill in the lot -

will alleviate the problem.
After further discussion the Chairman instructed
the Secretary to prepare the notice for the Public
Hearing to be held at the next meeting.
OLD BUSINESS - OLD WHITE PLAINS ROAD - BLOCK 325 PARCEL 81
Mr. Ronald Picket stated that in addition to the
house already on the lot they wanted to provide for
three more building lots and if the Board allowed
the subdivision the developer would be willing to
resurface the present road and that the Town as owner
of 75% of the road would continue its maintenance.
Mr. Picket said that under the Town Law Section 280(a)
Deerfield Lane qualifies as a Town road.
Mr. Hunter Meighan, an Attorney of 100 Mamaroneck
Avenue, represented Rr.Mandell who resides at 3 Deer-
field Lane and stated that his client does not feel
he wants to give up the 25 ft. that the developer
is asking for to make up the 50 ft. road that the
Town requires to meet their standards. Mr. Meighan
said that he does not believe Mr. Hamilton of 2-Deer-
field Lane is interested in giving up the 25 ft.
either.
Mr. George Greenberg of 1009 Old White Plains Road
stated that the developer's surveyor has trespassed
on his property by digging holes. Both Mr. Green-
bert and Mr. John Gilgut of 1007 Old White Plains
Road expressed concern over the septic tanks which
would be installed. Mr. Elfreich, the Town Engineer
assured the neighbors that the Westchester County
Health Department would not approve the septic-fields
if they did not meet the County specifications.
Mrs. John Johnson of 1011 Old White Plains Road ex-
pressed concern about the holes that were being dug
sad stated that they were "deep". Mrs. Johnson said
that the holes were marked by a pile of rocks and
a red flag which drew the attention of the children
in the neighborhood. Mrs. Johnson and Mr. Barker
of Deerfield Lane both expressed concern about- the
type of buildings Mr. Spencer expected to develop.
Mr. Maggini assured them that the--buildings would
have to meet Town standards. Mrs. Mandell said she
was worried about the drainage that-would affect
both her property and the Hamiltons. Mr. Elfreich
said that it would be necessary for the developer
to take care of the extra drainage and because of
the drainage ditch on the north side of the road
and the elevation of the crown of the road to pre-
vent the water from coming across the road the drain-
age will be improved.
After further discussion the Board advised the ap-
plicants to write a letter to the Board and when
they received a decision from Mr. Johnston, the Town
Attorney in writing they would make their conclusion.

There being no further business to come before this
meeting it was adjourned at 9:15 P.M.
