CALL TO ORDER The meeting was called to order by the Chairman at 8:30 P.M. ROLL CALL Present: Mr. Fred L. Maggini, Chairman Mr. Joseph Rigano Mr. G. Norman Blair Mr. Edward J. Cibulay Absent: Mr. Howard W. Hand, Jr. Also present: Mr. William P. Widulski, Town Engineer APPROVAL OF MINUTES The minutes of the meeting of April 8, 1970 were presented and on motion duly made and seconded ap- proved as submitted. The minutes of the Special Meeting of April 24, 1970 were presented and on motion duly made and seconded approved as corrected. PUBLIC HEARING - APPLICATION OF MR. SIDNEY DOHERTY - BLOCK 504 PARCEL 353 Mr. Sidney Doherty presented his application to the Board and the following also appeared in reference to the subdivision: Mr. Anthony Mauro, the prospective purchaser of the lot Mrs. Phyllis Wittner, 6 Pheasant Run Dr. and Mrs. Matthew Scharff, 25 Pryer Manor Road Mr. and Mrs. James D.Edwards, 4 Pheasant Run Mr. John J. Lee, 1 Pheasant Run Mr. Bryan E. Doherty, Doherty Place Mr. George G. Wallace, 53 Dillon Road Mr. William Kantor, 8 Pheasant Run Mr. Tony Buccino, 56 Dillon Road Mrs. R. Aebi, 34 Pryer Manor Road Mr. Frank Adamo, 30 Dogwood Lane The Board pointed out that it would be necessary for the applicant to give the Town an easement for the drain and an easement for the road so that at some future date the Town can widen and raise Dillon Road. The neighbors present who are adjoining property owners were concerned because Mr. Doherty was leav- ing a 30 foot strip next to the proposed lot and felt that at some future date Mr. Doherty might put in a road for access to the property he owns in the rear of the proposed subdivided lot. Mr. Widulski said that it would be necessary to have 50 feet for a road. Mr. Adamo spoke about the drainage problem that they have had for a long time. Mr. Widulski stated that the Town's responsibility was only a small part and the remaining portion was the problem of the City of New Rochelle. The Town Engineer said that he had discussed this problem with the New Rochelle City Engineers and that the Town of Mama- roneck was formulating a Six Year Capital Budget which included drains, road widening and other work. Mr. Adamo also spoke about the fill and general unsightliness of the area. Mr. Widulski said that the next item on the agenda was the proposed Pro- perty Maintenance Ordinance which was intended to give the Town officials the power to correct these conditions. Some of the neighbors discussed the danger on Dillon Road where the road is narrow in front of the pro- posed lot and the Board pointed out that at the previous meeting they had discussed the future rais- ing and widening of Dillon Road. After further discussion the Chairman stated that since he had given everyone an opportunity to speak and all the problems had been discussed the Public Hearing was closed. The application was approved and the following Reso- lution duly adopted: WHEREAS, Mr. Sidney Doherty, owner of the premises located on the south side of Dillon Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 504 Parcel 353 has filed with this Board an application for the approval of a subdiv- ision of this plat; and WHEREAS, pursuant to Section 276 of the Town Law, a public hearing was held on May 13, 1970 after notice was published in the official newspaper of the Town of Mamaroneck, the Daily Times; and WHEREAS, this Board has examined the plans and determined that the same are all sat- isfactory; NOW, THEREFORE, BE IT RESOLVED, that the application of Mr. Sid- ney Doherty be approved subject to the following conditions: 1. That a ten (10) foot ease- ment for the existing drainage ditch to be prepared in form sat- isfactory to the Town Attorney and to be delivered to said Attorney, be granted by the ap- plicant to the Town of Mamaroneck. 2. That a ten (10) foot easement along the entire property front- age for roadway widening and sim- ilar improvements be prepared in form satisfactory to the Town Attorney and to be delivered to said Attorney, be granted by the applicant to the Town of Mamaroneck. FURTHER RESOLVED, that upon compliance with the above conditions the Chairman of the Planning Board is hereby authorized to sign such subdivision plat as evidence of the approval of same by this Board. PROPOSED PROPERTY MAINTENANCE ORDINANCE The Town Board had requested the Planning Board to make their recommendations to the proposed Property Maintenance Ordinance and the Board made the follow- ing suggestions: 1. Can one and two family houses be in- cluded and if not any one or two family dwelling that is used for commercial pur- poses. 2. Can the section on water include the property owners responsibilty for maintain- ing streams. 3. Can a height limitation be placed on growth of grass and weeds. 4. Can a limit be placed on the length of time construction material is stored on a construction site. 5. Any parking areas where products are sold for "carry-out" purposes, receptacles should be placed on the property. 6. In regard to penalties the Chairman suggested that the penalty be made so that for each additional day the party was in violation the penalty would be raised.
