MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING
BOARD HELD MAY 12, 1971, IN THE COUNCIL ROOM OF THE WEAVER STREET
FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF MAMARONECK.
CALL TO ORDER
The Chairman called the meeting to order at 8:30
P.M.

APPROVAL OF MINUTES
The minutes of the meeting of April 14, 1971 were
presented and on motion duly made and seconded, ap-
proved as submitted.
APPLICATION FOR SPECIAL PERMIT - AUTO GLASS AND REPAIR SHOP -
2430 BOSTON POST ROAD - BLOCK 503 PARCEL 421
Mr. Joseph Minniti, an Attorney of 100 Mamaroneck
Avenue, New York, who represented Mr. Donald Ritacco,
the applicant said that he had reviewed a copy of
a petition signed by the residents of Sherwood Drive
which had been presented to the Town Board. Mr.
Minniti said that the petitioners were mostly con-
cerned about noise, fumes and the possibility of
an unsightly condition or a "junk yard" and the pro-
perty owners likely to suffer the most would be Mr.
and Mrs. Perrault whose property adjoins the proposed
site. Mr. Minniti said he had discussed the objec-
tions with the Perraults and that Mr. Perrault had
agreed his objection to fumes was not substantial.
In regard to the objection to noise Mr. Ritacco has
agreed to air condition the building so that the
doors will be closed in the summer. It was further
pointed out by Mr. Minniti that repairing cars was
not as it had been a number of years ago in that
it was only necessary to drill a small hole in the
damaged part and most times it was more advantageous
to remove the damaged part and put in a new one.
Mr. Perrault also agreed that because the work would
only be done on a 9 to 5 Monday through Friday basis
they would be able to use their premises in the rear

of the property on week-ends without noise and un-
sightliness. Mr. Ritacco also agreed to put a 6'
fence and 6' hemlocks along the rear line of the
property to screen the view of his site. Mr. Minniti
pointed out that Mr. Ritacco has an agreement with
the Village of Larchmont to remove abandoned cars
and store them without charge but that he would now
agree to remove them to the Village of Larchmont.
Mr. Ritacco agreed that parts will be either stored
or covered, and he would take care of the drainage
problem to eliminate the swamp area. Mr. Ritacco
has offered to sell Mr. Perrault the 25' strip that
adjoins his property at cost.
Mr. Minniti concluded by saying that Mr. and Mrs .
Perrault had withdrawn their objections and were
unable to attend the meeting becuase of other com-
mitments. Mr. Minniti had asked Mrs. Clifford who
lives above Mr. Ritacco's present business to attend
the meeting and Mrs. Clifford said she had lived
there for quite a while and had never had any com-
plaints about Mr. Ritacco's operation. Mr. Berko-
witz, who is the General Manager of an adjacent busi-
ness said he has thirty employees and there has never
been any complaints about noise, etc. from Mr. Rit-
acco's business activities.
The Chairman commended Mr. Mercurio on his report
in reference to the application. The Board discussed
the drainage and Mr. Maggini raised a question about
the sanitary sewer. The Chairman pointed out that
there is an easement for the drainage pipe and if
the sanitary sewer is there it will be necessary
to have an easement for that too. The Board requested
Mr. Ritacco to put in a catch basin at the location
of the present open ditch to drain the existing yards.
Mr. Widulski said that the drain should be at the
rear of the property and a regular street catch basin
constructed or a manhole with a grate top. The Engineer
stated that the es i pipes should be closed at the ends
to eliminate rubbish being stuffed in at the ends,
also an easement for maintenance and repair should
be granted to the Town over the existing drain.
After further discussion the Board decided to send
their recommendations to the Town Board approving
the application but with conditions regarding the
air conditioning, the 6' fence and 6' hemlocks, in-
door storage of parts and the drainage with an ease-
ment over the existing pipes to the Town.
DAITCH SHOPWELL - PALMER AVENUE - PARKING ON HARRISON DRIVE
Mr. Bozell, who is the Chairman of the Traffic Com-
mission for the Village of Larchmont appeared before
the Board. Mr. Bozell stated that the original plan
for Daitch Shopwell which is located in the Village

of Larchmont shows 90 parking spaces and upon reco-
mmendation of the County Traffic Engineer some spaces
were eliminated leaving a number of spaces which
he did not feel was enough. Mr. Bozell said that
the Village of Larchmont has no Ordinance that re-
quires a certain amount of parking spaces and that
he had asked the Architect about adding a second
story to the proposed building in order to provide
additional parking but it would cost about another
$75,000.00 and was not incorporated in the plan.
The new proposal requests that the Town allow the
builder to widen the pavement to 40 feet on the por-
tion of Harrison Drive adjacent to the proposed Daitch
Shopwell site. Mr. Bozell pointed out that Daitch
Shopwell was willing to pave the street and since
Mr. Bozell had spoken to Mr. Widulski they had decided
on parallel parking for 8 or 9 cars. It was pointed
out by the Board that the parking plan would have
to be approved by the Police Commission who had juris-
diction over parking. The Board agreed to recommend
to the Town Board that Harrison Drive be paved to
a 40 foot width.

There being no further business to come before this
meeting it was adjourned at 10:00 P.M.
