MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING
BOARD HELD JUNE 9, 1971, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The Chairman called the meeting to order at 8:20
P.M.

APPROVAL OF MINUTES
The minutes of the meeting of May 12, 1971 were pre-
sented and on motion duly made and seconded, approved
as submitted.
PRELIMINARY HEARING ON APPLICATION FOR SUBDIVISION - BLOCK
504 PARCEL 471 - DILLON ROAD
Mr. Doherty presented his plan to the Board for a
preliminary hearing on the subdivision of a lot into
two building lots. The lots in question are in an
R-10 Residential District and each lot is in excess
of the required 10,000 sq. ft.
Mr. Doherty said he intended to build a home for
his own use on one of the lots in question. Presently
Mr. Doherty lives in a house on an adjacent parcel
shown on the map.
Mr. Doherty stated that he proposed to dedicate the
10' strip of property shown on the map as an ease-
ment to the Town for the proposed roadway. The Town
would have 50' for a road when acquisition of the
Garito property is completed. This proposed road
would give the Town access to the Recreation area
and provide access for the dwellings on the private
street known as Premium River Road Extension. These
residents are now traveling over the proposed road-
way area and may have an easement by usage over the
years.
The Chairman asked the Town Engineer if there were
any drainage problems and Mr. Doherty said he intended
to raise the house a little to avoid any trouble.

Mr. Maggini questioned about the utilities and Mr.
Doherty stated that all the utilities were available
on Dillon Road. A question was raised by the Board
as to whether it is permissible to build over a County
sewer easement and it was pointed out that it is
allowed but the builder does so at his own risk and
must frame the building to bridge the easement.
After further discussion the Board decided that it
would be necessary for the members to go out and
look at the property before they,could advise Mr.
Doherty to go ahead with his final plans for the
Public Hearing.
OLD BUSINESS - BRIAR HILL SUBDIVISION
Mr. Maggini asked the Secretary to read a letter
addressed to him from the Town Attorney, Mr. John-
ston. Mr. Johnston said in his letter that residents
of the Town had attended a Town Board meeting to
complain about the condition of the road on Bonnie -
Way which Mr. Sumetz, the developer had not finished.
Mr. Johnston stated in his letter that he had tried
to contact Mr. Sumetz but had been unable to reach
him and suggested that in the future if Mr. Sumetz
appeared before the Board with any subdivision pro-
posal that he be made to file a bond for three times
the amount ordinarily required.
Mr. Widulski advised the Board that the road was
in the process of being paved and he had been informed
by the paving contractor it would be completed shortly.
REVISIONS TO ZONING ORDINANCE
The Board discussed the possibility of making some
changes in the Zoning Ordinance and because of the
problem the Town had encountered with the applica-
tion for the Kentucky Fried Chicken Restaurant on
the Boston Post Road the question had been raised
as to whether or not it would be advisable to require
restaurants to obtain a Special Permit the same as
gas stations, etc.
A suggestion was also made as to changing the build-
ing coverage in an OB and B district. Mr. Maggini
asked the members of the Board, Mr. Widulski and
Mr. Mercurio to think about any suggestions they
might have and the Board would discuss these changes
at another meeting.

There being no further business to come before this
meeting it was adjourned at 9:00 P.M.
