CALL TO ORDER The meeting was called to order by the Chairman at 8:15 P.M. ROLL CALL Present: Mr. Fred L. Maggini, Chairman Mr. Joseph Rigano Mr. G. Norman Blair Mr. James G. Couch Absent: Mr. Edward J. Cibulay Also present: Mr. Charles R. Elfreich, Town Engineer Mr. Joseph Potenza and Miss Susan Gallion from the Westchester County Department of Planning APPROVAL OF MINUTES The minutes of the meeting of May 9, 1973 were pre- sented and on motion duly made and seconded, approved as submitted. The Chairman asked the Secretary to read the public notice. PUBLIC HEARING - REVISED SUBDIVISION MAP - "GRIFFEN ESTATES" Application of Mr. Paul Corvino for the approval of a revised subdivision map known as "Griffen Estates being a resubdivision of certain lots shown on Map of Sankay Realty Company, Inc. Town of Mamaroneck, Westchester County, New York" located on the south side of Griffen Avenue and known on the Tax Assess- ment Map of the Town of Mamaroneck as Block 341 Par- cel 16. Mr. Corvino presented his application to the Board and the Board stated that the drawings were all in order. A question was raised as to who was the owner of the property and Mr. Corvino stated that he paid the taxes. The Chairman had received a letter from the Town Attor- ney stating that the Board should ascertain the ap- plicant's position as to whether he is the owner or purchaser under contract and if the purchaser under contract he should present the contract or if he is a developer speaking on behalf of the owner he should exhibit to the Board written authority to represent r the owner. After further discussion the Board advised Mr. Cor- vino that the drawings were satisfactory and they would approve the application subject to his estab- lishing the ownership of the subdivision. The ap- plication was therefore approved subject to certain conditions as listed in the following Resolution that was duly adopted: WHEREAS, Mr. Paul Corvino has filed an application for the approval of a revised subdivision map known as "Griffen Estates being a resubdivision of certain lots shown on Map of Sankay Realty Company, Inc., Town of Mamaroneck, Westchester County, New York" located on the south side of Griffen Avenue and known on the Tax Assess- ment Map of the Town of Mamaroneck as Block 341 Parcel 16; and WHEREAS, pursuant to Section 276 and 277 of the Town Law, a Public Hearing was held on June 13, 1973 after notice was published in the official newspaper of the Town of Mamaroneck, the Daily Times; and WHEREAS, this Board has examined the re- vised plan and determined that the same are all satisfactory; NOW, THEREFORE, BE IT RESOLVED, that the application of Mr. Paul Corvino be approved subject to the follow- ing conditions: 1. That the applicant establish that he is either the owner of the property, the purchaser under contract and if the purchaser under contract present the con- tract to the Board or show written authority that he is thh deveMper speaking on behalf of the owners. 2. That the applicant shall install all street improvements in accordance with the plans filed with this application and in accordance with the standards and specifications and procedure acceptable to the appropriate Town Departments, and any revi- sions which are noted on the final plans . 3. That no building permits shall 7 be issued until the applicants either furnish a performance bond and/or post a cash deposit in an amount specified by the Town Engineer for the completion of such improvements,such bond to run for a term of one year and to be issued by a bonding or surety company approved by the Town Attorney as to form, sufficiency and manner of execu- tion or complete the road and all public improvements. 4. That formal Offers or deeds of cession to the public of all streets, highways, easements or public places indicated on 'the plans filed with the Plan- ning Board shall be in form sat- isfactory to the Town Attorney and shall be held by said Attor- ney until such streets are for- mally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptanceby the Town of any dedication of any .such street, highway, easements, or public places, nor waive the payment of necessary title changes and recording fees, but that such acceptance shall be based solely upon the adoption of a Resolution by the Town Board. 5. That the applicants obtain approval from the Westchester Joint Water Works and from the Town Board of the Town of Mama- roneck for the extension of the water mains as shown on said construction drawings and that an amount sufficient to cover the installation of said water lines and appurtenances as esti- mated by the Manager of said Water Works, be deposited with said Water Works. 6. That applicants obtain ap- proval of the Westchester County Health Department for all public water supply facilities and pub- lic sanitary sewers to serve all structures intended for human occupancy constructed in said subdivision. FURTHER RESOLVED, that upon compliance with the above conditions, the Chairman ' of the Planning Board is hereby authorized to sign such subdivision map as evidence of approval of the same. The Chairman asked the Secretary to read the next Public Notice. PUBLIC HEARING - REDUCTION OF BOND - SAXON GLEN SUBDIVISION Application of Felix Contracting Corporation for reduction of the Performance Bond for the subdivi- sion known as Saxon Glen located on Old White Plains Road and known on the Tax Assessment Map of the Town of Mamaroneck as Block 330 Parcel 1 and shown on Maps entitled "Saxon Glen Section One" and "Saxon Glen Section Two" filed at the Office of the County Clerk, County of Westchester on January 22, 1968 as Map Numbers 15765 and 15766. Mr. Felix Petrillo presented his application to the Board. Mr. Elfreich, the Town Engineer stated that almost all of the improvements on the subdivision had been finished and he had sent a memo to members of the Planning Board with a breakdown of the items that needed to be completed in the amount of $8,000.00. The present bond is in the amount of $60,000.00 and Mr. Petrillo had requested it be reduced to $5,000.00. After further discussion the Board decided to reco- mmend to the Town Board their approval of the reduc- tion of the bond to $8,000.00 and the following Reso- lution was duly adopted: WHEREAS, pursuant to Section 276 of the Town Law on November 8, 1967 a Public Hear- ing was held on a subdivision known as Saxon Glen Subdivision; and WHEREAS, at that time a Resolution was duly adopted by this Board setting a Per- formance Bond for the construction of roads, drains, etc., in said subdivision in the amount of $60,000.00; and WHEREAS, certain of this construction work has been completed in a manner satisfac- tory to the Town Engineer and the Town Superintendent of Highways as set forth in a memorandum herewith filed recommending the bond be reduced to $8,000.00 and all persons present were given the opportunity to be heard; NOW, THEREFORE, BE IT r RESOLVED, that the Planning Board pursuant to Section 277 of the Town Law and subject to the approval by the Town Board of the Town of Mamaroneck, hereby reduces the amount of said Performance Bond from $60,000.00 to $8,000.00 as recommended by the Town Engineer; and be it FURTHER RESOLVED, that certified copies of this Resolution be sent to Mr. Felix Petrillo, Vice President of Felix Contract- ing Corporation. OLD BUSINESS - SUBDIVISION - "RE-SUBDIVISION OF LOTS 30-31 632 SECTION TWO "ROCK RIDGE" R.0.8047 AND PART OF COMMUNITY PARCEL MAP OF ROCK RIDGE" - BLOCK 325 PARCEL 81 Mr. Picket, who is the prospective purchaser of the dwelling that is at present on the subdivision said that if the developer is required to put in a 26' wide road with curbing and a cul-de-sac it would cost him about $15,000.00 and that it could possibly amount to more if rock excavation and tree removal were involved. Mr. Picketstated that other roads in the Town of Mamaroneck do not meet the standards and also if Miss LaGuardia had been advised when she purchased the property to have separate deeds they could probably have built houses without apply- ing for a subdivision. Mr. Picket further stated that they would be willing to put an asphalt topping on the existing road if the Town would continue to provide service as it has been doing. After further discussion the Board decided they would try to arrange a meeting with a representative of the Town Board, the Town Attorney, some members of the Planning Board and Mr. Elfreich to discuss what solution can be made to the problem so that the sub- division can be approved. WESTCHESTER COUNTY PLANNING BOARD Mr. Joseph Potenza of the Westchester County Plan- ning Board introduced Miss Susan Gallion who will be their representative at future meetings of the Planning Board. Mr. Potenza spoke to the Board and presented literature regarding the jurisdiction of the Westchester County Planning Board with reference to Section 451 of the Westchester County Administra- tive Code. Miss Gallion assured the Board that if they had any problems relating to the Westchester County Department of Planning she would be willing to help if possible.
