HomeMy WebLinkAbout1973_01_10 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING BOARD HELD JANUARY 10, 1973, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF MAMARONECK. CALL TO ORDER The meeting was called to order by the Chairman at 8:15 P.M. ROLL CALL Present: Mr. Fred L. Maggini, Chairman Mr. Joseph Rigano Mr. G. Norman Blair Mr. Edward J. Cibulay Absent: Mr. James G. Couch Also present: Mr. Charles R. Elfreich, Town Engineer APPROVAL OF MINUTES The minutes of the meeting of December 13, 1972 were presented and on motion duly made and seconded, ap- proved as submitted. OLD BUSINESS - "THE FAIRWAYS" Mr. Munn Brewer, an Attorney of 188 East Post Road represented the applicants and stated that the deve- lopers had agreed to make a cash donation of $9,000.00 for park and recreational purposes. Mr. Brewer said that the applicants had also reached an agreement with the Town Board and that the Town would complete the portion of Barnwall Lane that lies outside of the property being developed by the applicant. Mr. Brewer had requested that the Planning Board amend the Resolution that had been passed at the meeting of June 14, 1972, and presented Mr. Maggini with a copy of a letter dated January 10, 1973 addressed to Mrs. Christine Helwig, the Supervisor. In his letter Mr. Brewer discussed the water line and said he had spoken to Mr. George Straub of the Westchester Joint Water Works. Mr. Brewer said that Mr. Straub had told him that as soon as a test was made he would advise him whether or not the water pressure would meet the minimum requirements of the Board of Fire Underwriters without constructing a line in Barnwall Lane. The Board decided that Mr. Elfreich would contact Mr. Straub and check on the water lines. Mr. Maggini asked the Secretary to read the correspondence between Mrs. Helwig and Mr. Brewer. After further discussion the Board decided to amend the Resolution of June 14, 1972 as follows: (Paragraph No. 3 to read) 3. That no building permits shall be issued for the construction of any buildings in Section One until the applicants complete all the roadways,utilities and all public improvements or post a cash deposit and/or performance bond in an amount specified by the Town Engineer for the completion of such improvements, such bond to run for a term of one year and to be issued by a bonding or surety company approved by the Town Attorney as to form, sufficiency and manner of execution. (Paragraph No. 4 to read) 4. That the applicant in lieu of dedicating land for a recreation area donate a sum to the Town, such sum to be determined by the Town Board and placed in a trust fund pending development of one or more park or play areas to be used exclusively for the development of such neighborhood park, playground or recreation areas, in- cluding the acquisition of the land. (Paragraph No. 6 to read) 6. That the applicants shall install all street improvements in accordance with the plans filed with this application and in accordance with the standards and speci- fications and procedure acceptable to the appropriate Town Departments, and any revisions which are noted on the final plans. PUBLIC HEARING - "GRIFFEN ESTATES" The Chairman asked the Secretary to read the Public Notice. PLEASE TAKE NOTICE that the Town of Mama- roneck Planning Board pursuant to Section 276 and 277 of the Town Law will hold a Public Hearing on January 10, 1973 in the Council Room of the Weaver Street Firehouse, Weaver Street and Edgewood Avenue, Larchmont, New York at 8:15 P.M. on the application for the approval of a subdivision of a lot located on the south side of Griffen Avenue and known on the Tax Assessment Map of the Town of Mamaroneck as Block 341 Parcel 16 and shown on a subdivision map as "Griffen Estates being a resubdivision of certain lots as shown on Map of Sankay Realty Company Inc." TAKE FURTHER NOTICE that all persons pre- sent will be given an opportunity to be heard. Mr. Gabriel Senor, a Consulting Engineer-Surveyor of 872 Scarsdale Avenue, Scarsdale, New York who represented the applicant at the preliminary hear- ing appeared with Mr. Paul Corvino, the applicant and presented the final subdivision map and the con- struction plans for the extension of Carriage House Lane. The Board pointed out that the developer would have a problem with drainage on Lot #4 and Mr. Corvino said he would build a high ranch house with a 3` crawl space underneath. The Board advised the ap- plicant that the construction drawings would have to be approved by the Westchester Joint Water Works, Westchester County Health Department and the Town Engineer and that it would be necessary for the deve- loper to post a bond for the road improvements. Mr. Elfreich, the Town Engineer stated he would deter- mine the amount that would be necessary for the per- formance bond and notify the applicants accordingly. The Board discussed whether or not it would be advis- able to ask the applicant in lieu of dedicating land for a park or play area to donate a sum of money to be placed in a trust fund pending the development of one or more park or play areas but decided it would be impractical. After further discussion the Board decided to approve the application and the following Resolution was duly adopted: WHEREAS, Mr. Paul Corvino, owner of the premises located on the south side of Griffen Avenue and known on the Tax Assess- ment Map of the Town of Mamaroneck as Block 341 Parcel 16 and shown on a sub- division map as "Griffen Estates being a resubdivision of certain lots as shown on Map of Sankay Realty Company Inc.' has filed with this Board an application for the approval of the subdivision of this plat; and WHEREAS, pursuant to Section 276 and 277 of the Town Law, a Public Hearing was held on January 10, 1973 after notice was published in the official newspaper of the Town of Mamaroneck, the Daily Times; and WHEREAS, this Board has examined the plans and determined that the same are all sat- isfactory; } NOW, THEREFORE, BE IT RESOLVED, that the application of Mr. Paul Corvino be approved subject to the follow- ing conditions: 1. That the applicant shall install all street improvements in accordance with the plans filed with this application and in accordance with the stan- dards and specifications and procedure acceptable to the appropriate Town Departments, and any revisions which are noted on the final plans. 2. That no building permits shall be issued until the ap- plicants either furnish a per- formance bond and/or post a cash deposit in an amount speci- fied by the Town Engineer for the completion of such improve- ments, such bond to run for a term of one year and to be issued by a bonding or surety company approved by the Town Attorney as to form, sufficiency and manner of execution or com- plete the road and all public improvements. 3. That formal offers or deeds of cession to the public of all streets, highway, easements or public places indicated on the plans filed with the Plann- ing Board shall be in form sat- isfactory to the Town Attorney and shall be held by said Attor- ney until such streets are for- mally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of the dedication of any such street, highway, easements, or public places, nor waive the payment of nec- essary title changes and record- ing fees, but that such accept- ance shall be based solely upon the adoption of a Resolution by the Town Board. FURTHER RESOLVED, that upon compliance with the above conditions, the Chairman of the Planning Board is hereby authorized to sign such subdivision map as evidence of approval of the same.
