BOARD HELD DECEMBER 12, 1973, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The meeting was called order by the Chairman at
8:15 P.M.

APPROVAL OF MINUTES
The minutes of the meetings_of July 11 and November
14, 1973 were presented and on motion duly made and
seconded, accepted as submitted.
PUBLIC HEARING - SUBDIVISION OF LOT - BLOCK 216 PARCEL 334
Application of Mr. Jan C. Brassem for the approval
of a subdivision of a lot located at 23 Myrtle Boule-
vard and known on the Tax Assessment Map of the Town
of Mamaroneck as Block 216 Parcel 334 and shown on
the copy of a Survey filed in the Westchester County
Clerk's Office, Division of Land Records on October
10, 1973 as Map No. 1949.
Mr. Jan C. Brassem of 23 Myrtle Boulevard, the owner
of the property in question, was represented by Mr.
Hunter Meighan, an Attorney of 100 Mamaroneck Ave-
nue. Mr. Meighan stated that the applicant wanted
to subdivide the lot alongside of his house to pro-
vide for a separate building lot and the lot in ques-
tion complies with all the zoning regulations. The
Chairman asked whether the driveway was to be relo-
cated and it was pointed out that the driveway for
the existing house would be moved from the proposed
separate lot.
Mr. Robert J. Marcus of 30 Villa Road, an Attorney,
pointed out that there was sufficient area to make
the proposed lot have a 75 ft. frontage instead of
the 60 ft. as suggested.
Mr. William Von Zehle of 1 Windsor Street said that
he did not think another house would fit into the
neighborhood aesthetically. The Board pointed out
that they were not concerned with the type of house
and they only had jurisdiction over whether the pro-

posed lot was a buildable lot.
After further discussion the Board decided to approve
the subdivision and Mr. Elfreich said he would request
Mr. Brassem's Surveyor to submit the revised map
showing where the relocated driveway would be situated.
After the new drawing is received and stamped by
the Westchester County Health Department, the Chair-
man will sign the map.
The Board therefore approved the application and
the following Resolution was duly adopted:
WHEREAS, Mr. and Mrs. Jan Brassem, owners
of the premises located at 23 Myrtle Boule-
vard and known on the Tax Assessment Map
of the Town of Mamaroneck as Block 216
Parcel 334 and shown on the copy of a
Survey filed in the Westchester County
Clerk's Office, Division of Land Records
on October 10, 1973 as Map no. 1949 have
filed with this Board an application for
the approval of the subdivision of this
plat; and
WHEREAS, pursuant to Section 276 and 277
of the Town Law, a Public Hearing was
held on December 12, 1973 after notice
was published in the official newspaper
of the Town of Mamaroneck, the Daily Times;
and
WHEREAS, this Board has examined the plans
and determined that the same are all sat-
isfactory;
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr.
and Mrs. Jan Brassem be approved subject
to the approval of the Westchester County
Health Department.
FURTHER RESOLVED, that upon compliance
with the above, the Chairman of the Plan-
ning Board is hereby authorized to sign
such subdivision map as evidence of the
approval of same.
PUBLIC HEARING - SUBDIVISION OF LOT - BLOCK 346 PARCEL 244
Application of Mr. Edward Spellman for the approval
of a subdivision of a lot located on the southwesterly
side of Old White Plains Road and known on the Tax
Assessment Map of the Town of Mamaroneck as Block
340 Parcel 244 and shown on the Survey of a Parcel
of land dated June 3, 1969.
Mr. Edward Spellman of 1036 Old White Plains Road
was represented by Mr. John Ferguson, an Attorney,
of 175 Main Street, White Plains, New York. Mr.
Ferguson said that his client wanted to subdivide
the adjoining lot on his property and the lot con-
tains 18,762 sq. ft. The proposed building will
comply with the Zoning Regulations and there is
an existing drainage easement that was on the pro-
perty prior to Mr. Spellman's purchase of the land.
Mrs. Richard Selig of 7 Bruce Poad said she felt
that there was too much water there now and another
cesspool will not help. The Board pointed out that
the septic system was the jurisdiction of the West-
chester County Health Department and Mr. Elfreich
said that the Town would like to put in an entire
new system which will alleviate any flooding. The
Town Engineer stated that they would need an ease-
ment from Mrs. Selig and he had sicussed the situa-
tion with Mrs. Selig previously.
Mr. Monte-Sano of 8 Bruce Road stated that he felt
another house would bring down the appearance of
the houses already there and would not fit into
the character and aesthetics of the neighborhood.
Mr. Monte-Sano said that he could not see what Mr.
Spellman's hardship was and Mr. Spellman replied
that his hardship was in the fact that when he had
purchased the property he was told that the lot
in question was a buildable lot. Mr. Spellman pointed
out that the frontage of the proposed lot is only
approximately 4 ft. less than the frontage of the
other portion of the lot where his house is located.
After further discussion the Board decided that
they:would approve the subdivision subject to the
approval of the County Health Department for the
septic and Mr. Elfreich said he would contact Mr.
Spellman's Surveyor to request him to submit a draw-
ing showing the two lots.
The Board therefore approved the application and
the following Resolution was duly adopted:

OLD BUSINESS - LAUREL AVENUE EXTENSION
Mr. Elfreich advised the Board that he had written
a letter to Mr. Grout of the New York State Depart-
ment of Transportation requesting that they a issue
a Certificate of Necessity for the 25 ft. right-of-
way on Laurel Avenue.
OLD BUSINESS - OLD WHITE PLAINS ROAD - BLOCK 325 PARCEL 81
Mr. Elfreich informed the membersof the Board that
he had received a copy of a letter sent to Mr. Spencer
from the Westchester County Department of Health
disapproving individual sewerage systems for the
subdivision. The County Health Department stated
in their letter that they would reconsider the pro-
posal if the lot lines are delineated as well as
the precise areas designated for sewerage absorption
and drilled wells.
The Board said they want total improvements before
they will give their approval.
ADJOURNMENT
There being no further business to come before this
meeting it was adjourned at 9:10 P.M.
