BOARD HELD APRIL 11, 1973, IN THE COUNCIL ROOM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET AND EDGEWOOD AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The meeting was called to order by the Chairman at
8:15 P.M.
ROLL CALL
Present: Mr. Fred L. Maggini, Chairman
Mr. Joseph Rigano
Mr. G. Norman Blair
Mr. Edward J. Cibulay
Absent: Mr. James G. Couch
Also present: Mr. Charles R. Elfreich, Tewn Engineer
APPROVAL OF MINUTES
The minutes of the meeting of March 14, 1973 were
presented and on motion duly made and seconded, ap-
proved as submitted.
SECOND PRELIMINARY HEARING - "AMENDED SUBDIVISION MAP OF SECTION
2, ROCKRIDGE AND WESTERLY PORTION OF LOT 7" - BLOCK 325
PARCEL 81
Mr. Anthony R. Spencer of 240 Orienta Avenue, Mama-
roneck, the applicant was represented by his Attorney,
Mr. Benjamin I. Taylor of 209 Harrison Avenue, Har-
rison, New York.
Mr. Charles R. Elfreich, the Town Engineer, reported
that he had spoken to Mr. James J. Johnston, the
Town Attorney and Mr. Johnston had stated that the
Planning Board did not have the authority to approve
the subdivision with frontage on Deerfield Lane as
it is not a dedicated road. It was pointed out again
that a portion of the road was owned by the Town
and Mr. Johnston had suggested that if the developer
was interested in improving the complete road all
the way through according to Town specifications,
which would involve buying additional property, the
Planning Board would be in a position to consider
the application.
The Board asked Mr. Spencer if he had obtained any
indication from the Westchester County Health Depart-
ment as to whether they would approve the septic
tanks. Mr. Spencer said that Mr. Weber of the County
Health Department had informed him that they could
not review the application until approval was obtained
from the Planning Board.
The Board assured the applicant that they wanted
to cooperate and would like to see the land developed
but they caanot violate the law. Mr. Maggini advised
Mr. Taylor to contact Mr. Johnston and see what could
be worked out.
PRELIMINARY HEARING - SUBDIVISION OF LAUREL AVENUE EXTENSION
Mr. Joseph Carducci, the applicant, appeared before
the Board with his surveyor, Mr. Thomas McEvoy.
The applicant stated that he intended to extend Laurel
Avenue and add three extra lots. Mr. Elfreich ex-
plained that he had discussed the application with
Mr. Johnston and Mr. Johnston said that he was of
the opinion that when the previous application for
the subdivision on Laurel Avenue had been approved
a restriction had been placed on the property. The
Town Attorney said that he would like to study the
files on the old subdivision. Mr. Elfreich informed
Mr. Carducci that as soon as he hears from Mr. John-
ston he would notify him.
OLD BUSINESS - STERN AND LYNTON PROPERTY - FENIMORE ROAD
Mr. Elfreich had the linen for Mr. Maggini to sign
for the as-built subdivision plan showing the one
driveway for the two houses on Fenimore Road. Mr.
Maggini asked Mr. Elfreich to make a note on the
linen to indicate that the permits were on file from
the County Health Department for permission to con-
nect to the County trunk sewer and when it was ready
to let him know and he would come into the Town Office
to sign the linen.
ADJOURNMENT
There being no further business to come before this
meeting it was adjourned at 9:00 P.M.
