PRESENT: Supervisor Burton Justices Boyd and Collins Town Clerk Sherman Counsellor Gamble The minutes of the meetings of March 5th, March 8th, March 24th, April 2nd, April 16th, April 23rd, May 14th, May 30th, June 4th, and June 25th were read and upon motion approved. Communications from the Board of Appeals were received and read, stating that at their meetings the following applica- tions had been approved and the decision of the Building Commission reversed: 1. Appeal of E. J. Becker to erect a one family residence on the east side of Rocky Stone Avenue about 100 feet north of the inter- section of Rocky Stone Avenue and Valley Road within 30 feet of the street line. 2. Appeal of H. J. Relstab to erect a two car garage on the northeast corner of Forrest and Sheldrake Avenues within 30 feet of Sheldrake Avenue. 3. Appeal of Ellen V. Gesselin to erect a one family residence on the northeast corner of Highland Avenue and Highland Place within 30 feet of Highland Place. The communications also stated that rule 1 of the Board of Appeals of the unincorporated section of the Town of Mamaroneck be amended so as, to provide that the meetings of the Board shall be held at the weaver Street Fire House in- stead of at the office of the Town Clerk. After discussing the resolution changing the meeting place the matter was laid over for further consideration and the following resolutions were unanimously adopted: WHEREAS, the Board of Appeals has recommended to the 'Town Board that the appeal of E. J. Becker to erect a one family residence on the east side of Rocky Stone Avenue about 100 feet north of the intersection of Rocky Stone Avenue and Valley Road within 30 feet of the street line be granted and the decision of the Building Commission be reversed, provided that said building be constructed in accordance with the plot plan on file, therefore be it RESOLVED: that the 'Town Board, pursuant to Article 15, Section 26, of the Town Law, hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. MCLAUGHLIN Building Inspector (unincorporated section) The report of the Police Department for the month of June 1924 was received and read, showing 80 arrests and an amount of fines collected for said period amounting to $1430.00. The report was ordered noted in the minutes and placed on file. A communication from the Department of Education, _ State of New York, was received and read relating to the ncm.inating for the approval of the District Superintendent of Schools a person as Attendance Officer and the fixing of his compensation. The communication was ordered placed on file and the matter laid over for the next meeting. Mr. Michael Doherty and a delegation from Dillon Park were present to ascertain what action had been taken in reference to the petition for the change of the Zoning Ordinance affecting the south side of Boston Post Road between Premium River Road and Dean Place. Counsellor Gamble stated that the matters were now in shape awaiting the fixing of a date for a public hearing. Mr. Joseph L. Carlucci from Port Chester presented a petition and application for a bus line running from Chatsworth Avenue, Larchmont, to the New York Central Station at white Plains. The petition was ordered received, placed on file and the matter held over for a future meeting. Mrs. D. R. Schoenberger presented a claim amounting to $3. 18 as a refund for the erroneous payment of 1922 taxes. The matter was referred to Counsel. The Clerk presented estimates from Julian Frank and the R. A. Fife Corporation for Beatings in the auditorium of the weaver Street Fire House. It was voted that the matter be held over for the next meeting in order that the bidders may be requested to submit samples of chairs. The Supervisor spoke about the moving of the present police quarters from its present site to its proposed site at Edgewood Road, and after discussing the matter at length it was upon motion duly seconded RESOLVED: that the Supervisor be and he hereby is authorized and empowered to have a tentative sketch prepared for the police building on Edgewood Road. The following ordinance was presented by Counsellor and after due consideration the same was upon Roll Call unanimously adopted: AN ORDINANCE OF THE TOWN OF MAMARONECK IN RELATION TO THE SHUTTING OFF OF' THE WATER SUPPLY TO THE INHABITANTS OF THE TOWN OF MAD;tARONECK. The Town of Mamaroneck, through its Town Board, duly convened, does hereby ordain and enact: Section 1. It shall be unlawful for any water company or other corporation or individual to disconnect any residence or other building from a supply of water to such residence or other building in the Town of Mamaroneck during the pendency of any action or proceeding in any court of law or equity, because of the non- payment of any bill rendered for water supplied to such residence or other building based upon rates or charges which are the subject of litiga- tion in such action or proceeding, provided, how- - ever, that the customer otherwise responsible for the payment of such bill rendered, or any inhabi- tant or occupant of said residence or other building, shall deposit with the Town Clerk the amount of such bill rendered. Section 2. The Town Clerk shall hold all sums deposited with him under the provisions of this ordinance as a trust fund from which shall be deemed to have been brought into such action or proceeding, and such trust fund shall be disbursed according to the direction of the court in such action or proceeding. Section 3. Any corporation or individual violating any of the provisions of this ordinance shall be guilty of a misdemeanor _ and, upon conviction therefor, shall be liable to a fine not exceeding fifty dollars ($50) or imprisonment not exceeding six months, or both such fine and imprisonment. Section 4. It shall be lawful for the Town Clerk or the inhabitant or occupant of any such residence or other building which may have been disconnected from a supply of water for non-payment of any bill rendered as here- in provided, to turn any valve, cock, or other appliance used to effect such dis- connection, or to do any other act necessary to reconnect said residence or other building with its supply of water as soon as the de- posit referred to in Section 2 of this ordin- ance shall have been made with the Town Clerk. Section 5. This ordinance shall take effect ten days after the due publication thereof. The Supervisor reported that the Board of Trustees of the water Works District had been meeting from time to time and were about ready to adopt a tentative budget in the sum of $24,200.00 to defray the preliminary expenses of the Water District which would include all expenses already incurred and those to be incurred up to and including the submission of the proposition to the people for vote. He further stated that the Town ' s apportionment of said budget had been fixed in the sum of $2,420.00, and urged the adoption of a resolution to that effect . Whereupon the following resolution was offered and duly seconded, which upon Roll Call was unanimously adopted RESOLVED: that the sum of Two Thousand Four Hundred and Twenty ($2,420.00) Dollars is hereby appropriated as the proportionate share of the Town of Mamaroneck of the total appro- priation of $24,200.00 requested by the Board of Trustees of Westchester Joint Water Works No. 1, to be disbursed by said Board of Trustees for preliminary expenses according to the provisions of Chapter 599 of the Laws of 1924, and be it further RESOLVED: that this Board hereby approve and ratify the acts of the representative of this municipality in heretofore meeting and con- ferring with reference to the formation of said Westchester Joint Water Works No. 1, and hereby approve of the payments of the sums of money heretofore incurred by said representa- tive for preliminary expenses, all of which, however, to be included in the foregoing sum of $ 24,200.00.
