HomeMy WebLinkAbout1987_04_22 Town Board Regular Minutes 174 MINUTES OF THE REGULAR MEETINGS OF THE TOWN BOARD AND BOARD OF FIRE COMMISSIONERS OF THE TOWN OF MAMARONECK, HELD ON THE 22nd DAY OF APRIL, 1987 IN THE COURT ROOM AND THE CONFERENCE ROOM OF THE TOWN CENTER, 740 WEST BOSTON POST ROAD MAMARONECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Tbwn Board was called to order by Supervisor Battalia at 8:45 P.M. in the Court Room. Present were the following members of the Board: Supervisor Dolores A. Battalia Councilman Thomas R. Amlicke Councilwoman Caroline Silverstone Councilman Lawrence A. Lerman Councilman Stephen C. Chapin It was announced by Supervisor Battalia that prior to the meeting, a reception was held to honor the volunteers of the Town. She and the Board members then extended their thanks to the volunteers for the wonderful job they have done and urged them to continue their good work. CALL TO ATTENTION - Location of Exits As required by law for public gatherings, Supervisor Battalia pointed out the location of exits to those assembled. ill Also present wore: Patricia A. Thomas Leddy, Highway Superintendent 175 April 22, 1987 BOARD OF FIRE COMMISSIONERS On motion by Commissioner Silverstone, seconded by Commissioner Chapin, the meeting of the Board of Fire Commissioners was called to order by Commissioner Battalia. APPOINTMENT OF TOWN ATTORNEY It was announced by Supervisor Battalia that since Attorneys Hoffman and Silverberg were only serving in the capacity as Counsel to the Zoning and Planning Boards, it was necessary to obtain Counsel to handle the affairs of the Town as well. She continued that Councilman Amlicke and Councilwoman Silverstone served on a committee to find a new attorney and, out of the 30 to 40 applications received, it was their recommendation that Edward Lieberman be hired to fill that vacancy. The process used in choosing a new attorney and Mr. Lieberman's credentials were then presented by Councilman Amlicke, and on his motion, seconded by Councilwoman Silverstone, it was unanimously RESOLVED, that Edward M. Lieberman, of 45 Knollwood Road, Elmsford, New York, be, and he hereby is, appointed to serve as Counsel to the Town of Mamaroneck, to be compensated at an annual salary of $30,000; and be it FURTHER RESOLVED, that the Administrator be, and he hereby is, authorized to execute said retainer agreement with Counsel to the Town. At this time, Supervisor Battalia requested that Attorney Lieberman join the Board members and be seated at the dais. 2. DISCUSSION - COURT HOUSE PROPERTY The status of the Town-owned Old Court House property was discussed by Supervisor Battalia after which she asked for comments from the members of the Board. Councilman Chapin stated that he viewed the premises as surplus property and did not feel that the Town should be in the real estate business. He added he was in favor of selling the property but retaining that portion of it located direcly behind the existing home since the Town might be able to use it as a leaf composting site in the future. Councilman Lerman stated that since Mamaroneck is a land-poor Town, he was not in favor of selling the property, but rather keeping it as a low-impact recreational area such as a park. - 3 - • 177 April 22, 1987 It was stated by Councilman Amlicke that he was in agreement with Councilman Chapin as far as selling the house and placing the property back on the tax rolls but he also suggested that the house be sold with just sufficient land, and with the remaining property being preserved. There are more different opinions now than there were a few years ago, stated Councilwoman Silverstone, adding that both the Planning Board and the Joint Planning Commission agreed that the premises should be maintained under the present zoning classification as a residential home and she was in agreement with that. She was also of the opinion that the Town did not belong in the real estate business and stated that she joined in voting to sell the premises but with the Town maintaining ownership of the back parcel. It was Councilman Chapin's opinion that the proceeds from the sale of the property could be used to defray the cost of dredging the duck pond. Mr. Oberg of 1214 Palmer Avenue, stated that selling the Court House was a worthy suggestion as the Town has not faced up to its maintenance responsibilities. Some concerns arose relating to the use of some of the Court House land as a composting site and the Supervisor pointed out that the Peekskill site could not be utilized and the other land fill sites closed, adding that all municipalities were facing a crisis. She also pointed out that approximately $100,000 a year could be saved on leaf compositing if the site could be utilized for that purpose. Mr. Anton Schramm stressed that the area in question was too small for composting and the smell would be horrendous. In answer to a question raised by Mr. Arthur Gasparini, the Administrator offered that if the Court House was razed, either five or six homes could be built on the site without infringing on the building housing the Volunteer Ambulance Corps. Mrs. Anita Wilson of 70 Howell Avenue pointed out the present problems with traffic in the area and said that more traffic would be added with the addition of any new homes. To answer Mrs. Wilson's question, Mr. Altieri explained that zoning regulations do not apply to a municipal use. Mr. Paul Hoffman conveyed that he thought the property was an eyesore and also that he was concerned that the R-15 zoning classification be maintained. Mrs. Catherine Hines of 1281 Palmer inquired if any brokers were involved in this situation to which the Supervisor answered that none were involved and that the Town. Assessor had looked at the house and he would set a selling price. - 4 - 178 April 22, 1987 Mrs. Mary Carlson of 17 North Chatsworth stated that some time ago, the Planning Board looked into an historic designation being established for the Court House but it was never followed through on. IIIThereafter, on motion by Councilwoman Silverstone, seconded by Councilman Chapin, with Councilman Lerman voting nay, it was RESOLVED, that this Board hereby authorizes the Town Administrator to commence arrangements for the sale of the premises known as the Old Court House property, more specifically designated as Block , Parcel , of the Town of Mamaroneck, but excluding the land situate, lying or being located directly behind the existing building; and be it FURTHER RESOLVED, that this sale is subject to a Permissive Referendum and the Town Clerk is hereby directed to publish same. NOT ON THE AGENDA: 16 NORTH CHATSWORTH AVENUE - PARKING ISSUE Supervisor Battalia stated that in order to accommodate those residents of the North Chatsworth area who were in attendance, the parking issue would be discussed at this time. The Supervisor explained that she was in receipt of a letter from Mr. Burton Meighan wherein he apprised the Town that the 16 North Chatsworth building was eliminating the parking of vehicles by the neighboring tenants in order to utilize the parking spaces for their own residents. She continued that Mayor Curnin was contacted and overnight parking spaces were now available at the Larchmont Railroad Station and that a list of available parking in Town-owned lots was sent to Mr. Meighan. The owner of 16 North Chatsworth was contacted, Supervisor Battalia stated, and a request for an extension of time for the parkers was made. She further outlined steps the Town III was taking in order to accommodate the residents and said the Traffic Committee was requested to investigate the matter at their May 7th meeting. Diagonal parking on Myrtle Boulevard was suggested by Councilwoman Silverstone with the Supervisor adding that 24 hour and overnight parking in Lot #3 for senior citizens and handicapped persons would also be looked into, with any remaining spaces being made available to others. - 5 - 179 April 22, 1987 Attorney Lieberman was then requested by the Supervisor to ascertain whether the handicapped could be designated to qualify for discounted permits and whether assigned parking spots could be designated for them. III The Town has tried to make parking available as best it could, Supervisor Battalia explained, and she informed the residents that they would be notified the next time this item was on the agenda and also when she received a reply fran the owner of 16 North Chatsworth regarding the extension of time. 4. AUTHORIZATION - SEWER CONNECTION AGREEMENT - VILLAGE OF SCARSDALE A sewer connection agreement with the Village of Scarsdale, the developers of 465 Mamaroneck Road and the Town was presented by Administrator Altieri and he explained the proposal for providing sewer service to the proposed eight-home development on Mamaroneck Road in the Village of Scarsdale. He stated that since there were no Village sewer mains at that location, the developers requested that they be allowed to connect to the Town's sewer main on Stonewall Lane. III The sanitary sewer system would require a pump station but the Town would in no way be responsible for its operation or maintenance, or for the connecting sewer main, the Administrator advised, adding that the proposal was reviewed by the Malcolm Pirnie firm and they determined that the sewer main on Stonewall Lane had sufficient capacity for the additional eight homes. The firm also made a series of technical recommendations for the construction of the connecting sewer main which would provide for its efficient operation, Mr. Altieri submitted. There was some question raised by Councilman Chapin as to the location of the sewer connection to which Administrator Altieri offered that the developer would arrange for the easement. Councilman Chapin was of the opinion that the Town should be reimbursed by the developer for the charges it incurred for the consultant and attorney. III Councilman Amlicke noted that the wording in the contract was unclear and also said he felt that the $100 connection fee was too low. In answer to Councilwoman Silverstone's question, the Administrator stated that this fee would be more than what other residents paid for the sewer tax and said it was set at $100 per year because the current agreement did not provide for any increases in the charge. - 6 - I.80 April 22, 1987 Supervisor Battalia stated that she thought that the Village of Scarsdale should be accommodated considering they recently permitted those Town residents, who live on the borderline, access to their recreational facilities but her only concern was that the Town not be placed in a position where these 8 homeowners would pay less than other homeowners in the district and suggested that a formula be established such as the sewer district tax rate plus a surcharge of "X" amount. Some language changes in the agreement were discussed together with the formula that should be established and the Supervisor stated that the matter would be placed on the agenda for May 6th in order to allow time for the Administrator to discuss the changes with the Village of Scarsdale. 3. PRESENTATION - NEW TOWN TAX BILL Since the new tax statement presented a number of questions, stated Supervisor Battalia, it has been revised and so that it now separates the County and Town charges as well as accooplishing the task of better informing the taxpayers of the portion of tax charged that is actually a Town tax. 5. REPORT OF BIDS - POLICE UNIFORMS CLEANING OF POLICE UNIFORMS STREET SWEEPING SERVICES STREET LINE PAINTING Police Uniforms: Of the two bids received for providing Police uniforms, Administration Altieri recommended that it be awared to the lowest bidder, Valhar Chemical. However, Councilman Amlicke stated that he thought the price too high and on his motion seconded by Councilman Lerman, it was unanimously RESOLVED, that the bid submitted by Velhar Chemical of Greenwich, Connecticut, for providing the annual uniform issue for the uniformed employees of the Town of Mamaroneck Police Department be, and it hereby is, rejected as being too high. - 7 - s 182 April 22, 1987 Thereafter, he requested authorization to enter into the contract with Three D Maintenance and on motion by Councilwoman Silverstone, seconded by Councilman Lerman, it was RESOLVED, that Three D Maintenance of Elmsford, New York, is hereby awarded the contract for providing street- sweeping services for the streets within the Town of Mamaroneck; and be it FURTHER RESOLVED, that the Administrator be, and he hereby is, authorized to enter into said contract with Three D Maintenance for furnishing the street- sweeping service. Street and Parking Lot Painting: Annually, the Town contracts for the painting of lines on streets and in parking lots and only one bid was submitted by M&S Striping, Administrator Altieri announced, adding that in the past, a second bid had always been received from a firm in Massachusetts. Thereafter, he recommended that M&S be awarded the contract and, on motion by Councilman Amlicke, seconded by Councilman Lerman, it was unanimously RESOLVED, that M&S Striping of Mamaroneck, New York, is hereby awarded the contract for painting street and parking lot lines in the Town of Mamaroneck; and be it FURTHER RESOLVED, that the Town Administrator be, and he hereby is, authorized to enter into said contract with M&S Striping for the painting of street lines and parking lot lines in the Town of Mamaroneck. 6. AUTHORIZATION - APPOINTMENT OF BOOKKEEPING MACHINE OPERATOR Approximately three years ago, Gaily Sheehy was hired as a provisional bookkeeping machine operator in the Town Comptroller's Office and after successfully passing the Civil Service test for her title, Administrator Altieri recommended that she be permanently appointed to that position. Thereafter, on motion by Councilman Lerman, seconded by Councilman Amlicke, it was unanimously - 9 - 181 April 22, 1987 Cleaning of Police Uniforms: It was requested by Administrator Altieri that both of the bids received be rejected in order for the Town to revise the specifications so that they are more in line with the Town's PBA Contract, which according to Article 17, Section 2, requires that the Town enter into a contract with a local establishment maintaining a convenient outlet for the cleaning and laundering of police uniforms. Following a brief discussion, on motion by Councilman Amlicke, seconded by Councilwoman Silverstone, it was unanimously RESOLVED, that the two bids which were submitted by RJD Uniform Rentals of West Haverstraw and Excelsior Cleaners of Larchmont for the cleaning of Police Uniforms be, and they hereby are, rejected; and be it FURTHER RESOLVED, that specifications for cleaning and laundering police uniforms be revised pursuant to Article 17, Section 2 of the Police Benevolent Association's contract with the Town of Mamaroneck. Street Sweeping Services: At the last Town Board meeting, further information was requested before awarding a street-sweeping contract for the Town's streets, Administrator Altieri explained, adding that a cost breakdown was revised to reflect the adjusted purchase price of a new street sweeper and the operating costs involved. The reasons under consideration for converting to contracted street-sweeping services were outlined by the Administrator as follows: 1) A savings in personnel cost; 2) Increase in the availability of existing manpower; 3) Continuous service being provided; 4) The overall costs being less. Under the contract, the streets would be swept 70 to 80 days a year, Mr. Altieri explained, and Councilman Chapin stated that would be approximately $41,000 per year or $208,000 over a five-year period. The Administrator continued that with maintenance costs, for the Town to own its own sweeper, it would be over $232,000 for the same five-year period. It was suggested by Councilman Chapin that a Town-owned machine be shared with the Village of Larchmont but the Supervisor stated that the machine would be needed at the same times of the year so it would be very difficult to share any services with the Village, to which Administrator Altieri added that the Village was purchasing their own machine. - 8 - i8q April 22, 1987 RESOLVED, that Gail Sheehy be, and she hereby is, permanently appointed as a Bookkeeping Machine Operator in the Town Comptroller's Office. 7. DISCUSSION - CAPITAL BUDGET RE: STRATEGIC PLANNING An analysis of the Town's debt service for the years 1987 through 1992 was presented by Administration Altieri and he explained that the analysis included all existing debt service broken down by project, and anticipated debt service based on the Capital Improvement Schedule included in the 1987 Budget. Included in the category of anticipated debts, the Administrator stated, were the upcoming inflow and infiltration project, mandated by the State of New York, the proposed dredging of Gardens Lake, and the purchase of equipment for the Highway and Sanitation Departments. The rates could change, the Administrator said, but for the purpose of projecting anticipated debt of the Town, a 7% interest rate was used for long-term debt and 5% for short- term debt. Administrator Altieri concluded by saying that the total outstanding debt at present was $8,308,318 which was approximately 10 to 11% of the total operating budget and significantly below the total debt service capacity allowed under New York State statute. Supervisor Battalia thanked Mr. Altieri for his informative presentation and stated that no formal action would be taken at this time. 8. AUTHORIZATION TO ESTABLISH CAPITAL PROJECTS AND TRANSFER OF FUNDS - CAPITAL PROJECT #87-1 - CAPITAL PROJECT #87-2 - TOWN CENTER Capital Project #87-1 Administrator Altieri requested authorization to establish Capital Project #87-1 for the purchase of automobiles for the Police Department and Administration, and also for the transfer of funds for these purchases. - 10 - 184 April 22, 1987 Following a brief conversation, on motion by Councilman Lerman, seconded by Councilman Amlicke, it was unanimously RESOLVED, that this Board hereby authorizes the establishment of Capital Project #87-1 for the purchase of automobiles for the Police Department and Administration; and be it FURTHER RESOLVED, that this Board hereby authorizes the transfer of funds in the amount of $66,000 from the General Fund Part Town into the Capital Projects Fund; and be it FURTHER RESOLVED, that this Board also authorizes the transfer of funds in the amount of $10,000 from the Federal Revenue Sharing Account into the Capital Projects Fund. Capital Project #87-2 The Administrator then requested authorization to establish Capital Project #87-2 for the purchase of an automobile for the Fire Chief, and also for the transfer of funds for the purchase. Thereafter, on motion by Councilman Lerman, seconded by Councilman Amlicke, it was unanimously RESOLVED, that this Board hereby authorizes the establishment of Capital Project #87-2 for the purchase of an automobile for use by the Town Fire Chief; and be it FURTHER RESOLVED, that this Board hereby authorizes the transfer of funds in the amount of $12,000 from the Fire District Budget into the Capital Projects Fund. Town Center Action on this matter was deferred to the May 6th meeting. 9. AUTHORIZATION - BOND RESOLUTIONS It was the consensus of the Board that this matter be put over to the May 6th meeting. - 11 - 18.E April 22, 1987 At this time, the order of the agenda was changed and Items #10 and #12 were discussed together: 10. SALARY AUTHORIZATION - Recreation and 12. SALARY AUTHORIZATION - Police Department Recreation A memorandum for salary authorization was submitted by William V. Zimmermann, Superintendent of Recreation and, on motion by Councilwoman Silverstone, seconded by Councilman Amlicke, it was unanimously RESOLVED, that as provided for in the 1987 Town Budget, this Board hereby authorizes the hiring of the following individual, to be effective and at the salary so stated: Joelle Healy, Office Temporary, $5/hour, retroactive to April 6, 1987. Police Department Salary authorization for five patrolmen in the Police Department was requested by Administrator Altieri and, on motion by Councilwoman Silverstone, seconded by Councilman Amlicke, it was unanimously RESOLVED, that Martin J. Pfeiffer of Bronx, New York be, and he hereby is, appointed as a Probationary Police Officer of the Town of Mamaroneck Police Department, to be compensated at an annual salary of $23,000, effective April 23, 1987; and be it FURTHER RESOLVED, that Dominick J. Forti, Jr. of Larchmont, New York be, and he hereby is, appointed as a Probationary Police Officer of the Town of Mamaroneck Police Department, to be compensated at an annual salary of $23,000, effective April 24, 1987; and be it FURTHER RESOLVED, that Sabbatino Delango, Jr. of Yonkers, New York be, and he hereby is, appointed as a Probationary Police Officer of the Town of Mamaroneck Police Department, to be compensated at an annual salary of $23,000, effective April 27, 1987; and be it - 12 - 186 April 22, 1987 FURTHER RESOLVED, that Jason T. Lassiter of Peekskill, New York be, and he hereby is, appointed as a Probationary Police Officer of the Town of Mamaroneck Police Department, to be compensated at an annual salary of $23,000, effective April 28, 1987; and be it FURTHER RESOLVED, that Linda Carozza, of Yorktown Heights, New York be, and she hereby is, appointed as a Probationary Police Officer of the Town of Mamaroneck Police Department, to be compensated at an annual salary of $23,000, effective April 29, 1987. 11. ORGANIZATION OF BI-CENTENNIAL COMMITTEE It was announced by Supervisor Battalia that this matter would be put over to the May 6th meeting and she then requested that Councilman Amlicke contact the two Villages in order that this be made a tri-municipal effort. 13. RESOLUTION RE: STATE FUNDING FOR LWRP IMPTNTATION A request to adopt a LWRP funding resolution was received from the Coastal Zone Management Commission and on motion by Councilman Lerman, seconded by Councilman Amlicke, the following resolution was unanimously adopted: WHEREAS, the Town Board of the Town of Mamaroneck authorized a Local Waterfront Revitalization Program with the New York State Department of State; and whereby the Town Board and the Coastal Zone Management Commission will prepare and adopt further programs to implement its Local Waterfront Revitalization Program, which will be submitted to the New York State Department of State for approval; and WHEREAS, adequate funding should be included in the New York State Executive Budget for fiscal year 1987-88 to provide funding support to local governments with eligible Local Waterfront Revitalization Programs; and WHEREAS, the Town Board wishes to express its firm support for the inclusion of at least 2.0 million dollars in the New york State Executive Budget to implement Local Waterfront Revitalization Programs; - 13 - 187 April 22, 1987 NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Mamaroneck does hereby request the Legislature of the State of New york to include 2.0 million dollars in the New York State Executive Budget for fiscal year 1987-88 to implement Local Waterfront Revitalization Programs; and be it FURTHER RESOLVED, that the Town Clerk is hereby directed to forward this Resolution to the New York State Legislature immediately. PROCLAMATION - MENTAL HEALTH MONTH The following Proclamation, designating the month of May as Mental Health Month, was presented and read by Councilman Lerman as follows: WHEREAS, a substantial number of people in the United States will suffer directly or indirectly from the consequences of mental illness during their lifetimes; and WHEREAS, community based mental health programs are a necessary component in prevention, early detection, and ongoing care; and WHEREAS, meeting the mental health needs of children is of particular concern to our society; and WHEREAS, the elderly are especially vulnerable to the ravages of mental illness; and WHEREAS, changes in family life have brought new stress in daily living to all members of our society, requiring innovative approaches to prevention and treatment; and WHEREAS, the Mental Health Association of Westchester County has taken a leadership role with regard to winning community acceptance of the mentally ill and the development of vital services; II/ and WHEREAS, the residents and government of the Town of Mamaroneck have always played an active role in promoting needed services. - 14 - 188 April 22, 1987 NOW, THEREFORE, BE IT RESOLVED, that the month of May, 1987 be proclaimed II/- MENTAL HEALTH MONTH throughout the Town of Mamaroneck. THE TOWN CLERK Regular Reports The Town Clerk's Report together with the Building and Plumbing Report for the month of March, 1987 were submitted by the Town Clerk. - 15 - 189 .. April 22, 1987 THE SUPERVISOR Reports 1. requested the local newspapers to notice the Special III Fire District Election scheduled for April 28th. 2. urged the community to complete and return the survey they received from the Recreation Department. 3. once again extended her thanks to the volunteers and they wonderful job they do and thanked everyone for their help with the reception held earlier in the evening. REPORTS OF THE COUNCIL No reports were presented at this time. ADJOURNMENT III On motion by Councilwoman Silverstone, seconded by Councilman Amlicke, it was unanimously resolved that the Board recess into Executive Session at 12:00 A.M. to discuss personnel matters.
