Present were the following members of the Board: Supervisor Dolores A. Battalia Councilman Thomas R. Amlicke Councilwoman Caroline Silverstone Councilman Lawrence A. Lerman Councilman Stephen C. Chapin On motion by Councilwoman Silverstone, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board recess into III Executive Session in the Conference Room to discuss recreational matters. Thereafter, on motion by Councilman Chapin, seconded by Councilwoman Silverstone, it was unanimously resolved to adjourn the Executive Session at 8:35 P.M. CALL TO ATTENTION - Location of Exits At this time, Supervisor Battalia pointed out to those assembled the location of exits as required by law for public gatherings. Marra, Recording Secretary 053 05 December 17, 1986 BOARD OF FIRE COMMISSIONERS On motion by Commissioner Silversone, seconded by Commissioner Chapin, the meeting of the Board of Fire Commissioners was called to order by Commissioner Battalia at 8:40 P.M. in the Court Room. Present were the following members of the Commission: Commissioner Dolores A. Battalia Commissioner Thomas R. Amlicke Commissioner Caroline Silverstone Commissioner Lawrence A. Lerman Commissioner Stephen C. Chapin 1. APPOINTMENT - TOWN PROSECUTOR Supervisor Battalia stated that another resume had been received for the position of Town Prosecutor and that a decision would be made shortly. 2. ADOPTION OF 1987 BUDGET Supervisor Battalia opened the meeting to the public and Dr. Mitroff voiced his objection to any salary increases for the Town Board members. Mr. Paul Hoffmann questioned the status of the Old Court House and the monies allocated for its repair to which Councilman Lerman reminded the Board that they had assured the neighboring property owners that the appearance of the Old Court House would be maintained. He added that the residents have waited patiently and if the funds for this were eliminated from the budget, the residents might have to wait a long time to see it repaired. Administrator Altieri offered that the disposition of the property has not yet been decided and if repairs are necessary, $3,000 would be allocated for that purpose. Mr. Hoffmann then stated that he would like to see the property remain residential and not go commerical. Councilman Amlicke asked Mr. Hoffmann what his main concerns were regarding the premises to which Mr. Hoffmann stated that the grounds of the property were being maintained but that the house was in need of repair; that it was mainly the matter of aesthetics. Pursuant to Mr. Hoffmann's request, Supervisor Battalia requested that the Administrator Altieri check into the. matter of the cars which were being parked at the Old Court House. Supervisor Battalia stated that a date would be set at the next meeting as to when this matter would be placed on the agenda. Mr. Gasparini inquired if the disposition of the Old Court House would be decided in Executive Session to which Supervisor Battalia replied in the negative. Turning to another matter in the Budget, Administrator Altieri stated that additional staff support was needed for the CZ MC and CAC and it was recommended, that due to the expanded duties of these committees, additional monies be appropriated. Supervisor Battalia inquired about the status of the CZM Grant to which Administrator Altieri stated that nothing had been received as yet. - 3 - 055 December 17, 1986 Another item brought up by Administrator Altieri was an additional capital improvement expense for the replacement of a police vehicle which was totaled in an accident. Mr. Glaser inquired what amount was allocated for the Hommocks Ice Rink to which Mr. DeLuca replied that just the regular operating costs were appropriated. Thereafter, on motion by Councilman Lerman, seconded by Councilwoman Silverstone, with a unanimous vote of the Board, it was RESOLVED, that the 1987 Preliminary Budget for the Town of Mamaroneck be and it hereby is adopted as the 1987 Budget for the Town of Mamaroneck. The question of the adoption of the foregoing resolution was duly put to a vote which resulted as follows: Ayes: Supervisor Battalia Councilman Amlicke Councilwoman Silverstone Councilman Lerman Councilman Chapin (A copy of said 1987 Budget is attached hereto.) At this time, the order of the agenda was changed, and the following item was discussed: 14. AUTHORIZATION - BUDGET TRANSFERS Mr. DeLuca explained that certain transfers from revenues and surplus were required in order to close the books for 1986 and he requested permission to do same. Administrator Altieri stated that after the close of the year end, a report will be presented to the Board and, on motion by Councilman Amlicke, seconded by Councilwoman Silverstone, it was unanimously RESOLVED, that the Town Comptroller be, and he hereby is, authorized to make certain transfers from revenues and surplus in order to close the books for the 1986 calendar year. 3. DISCUSSION - HOMMOCKS ICE RINK Supervisor Battalia stated that the Hommocks Ice Rink has been a subject of discussion for many years and that the time has come to take some initial steps with regard to its future. - 4 - 056 December 17, 1986 Supervisor Battalia went on to say that a good deal of work has gone into the decision-making process of what should be done with the rink and what alternatives were available at the least possible cost. She added that no one wanted to see the rink close but for the Town to finance a new facility at the present time was impossible. Supervisor Battalia noted that any decision regarding the future of the ice rink would be held in abeyance until some other avenues could be researched further, such as the possibility of a fund-raising program being established. Mr. Glaser stated that the Supervisor had mentioned everything that was in his notes and he continued by reading from his papers which he had also presented at a previous Board meeting. At this time, Councilman Lerman extended his thanks to Mr. Domenic Ruggiero for the many, many hours he expended in connection with the future of the ice rink and he stated that Mr. Ruggiero's volunteerism should be acknowledged and there followed a round of applause from the Board members and the audience as well. Supervisor Battalia extended her personal thanks to Mr. Ruggiero and everyone else who was connected with this undertaking and stated that there will be further reports regarding the future of the ice rink. 4. RECONMETDATION OF BURGULAR ALARM COMMilith Administrator Altieri stated that surveys were sent to current licensed alarm users in the Town of Mamaroneck and the responses indicated that approximately one hundred residents were interested in connecting to an alarm system panel operated by the Police Department. In answer to a question raised by Councilwoman Silverstone, Councilman Amlicke stated that the Police Commissioner was of the opinion, based on current subscribers, that the alarm panel could be handled by the desk officer, and he added that the alarm companies would be the ones marketing the system. Councilwoman Silverstone then questioned what would happen if two hundred more people signed up for the alarm system, to which Councilman Amlicke replied that the more people, the more revenue received. In answer to Councilman Chapin's question, Councilman Amlicke stated that the system would be computerized and it would dial the resident's home automatically so the desk officer in the Police Department would not be required to make the verification call when an alarm came in. - 5 - C December 17, 1986 Thereafter, on motion by Councilman Lerman, seconded by Councilman Amlicke, it was unanimously RESOLVED, that the Town Administrator be, and he hereby is authorized to submit proposals for the installation of an alarm system panel for the Town of Mamaroneck Police Department. 5. INCREASE IN FIRE HYDRANT RENTAL RATES Adminstrator Altieri said that the Board had requested additional information regarding the fire hydrant rental rates and stated that in a communication he received from Mr. Hock of the Westchester Joint Water Works, it was explained that all revenues derived from hydrant rentals in the Town were directly credited to the Town and none of the revenues would be shared with other municipalities. Thereafter, on motion by Councilwoman Silverstone, seconded by Councilman Amlicke, it was unanimously: RESOLVED, that this Board hereby approves the recommended increase in fire hydrant rentals from the quarterly rate of $31.25 per hydrant to the quarterly rate of $34.00 per hydrant, to be effective January 1, 1987; and BE IT FURTHER RESOLVED, that this Board hereby approves the recommended increase in fire hydrant rentals from the quarterly rate of $34.00 per hydrant to the quarterly rate of $37.50 per hydrant, to be effective January 1, 1988. 6. TRAFFIC SIGN PLANS - HOWELL PARK Administrator Altieri presented the recommendation of the Traffic Committee to install two "Stop" signs and a "No Thru Traffic" sign in the Howell Place vicinity and Mr. Paul Hoffmann, representing the residents of the Howell Park area, stated that six stop signs had been requested in order to deter persons from using their road as a shortcut in order to avoid a traffic light. Mr. Hoffmann explained that there was an average of 3.6 children per household with most of them being under 12 years of age. He said that cars flew through their area and he was concerned about the safety of the children. Councilwoman Silverstone stated that, according to the New York State Department of Transportation, stop signs are not used to slow traffic down and Councilman Amlicke stated that the Police Commissioner concurred with that. - 6 - 053 December 17, 1986 The question of enforcment of the "No Thru Traffic" signs was raised and it was the consensus of the Board that it was next to impossible to enforce. After further discussion, Councilman Amlicke suggested that this matter be referred back to the Traffic Committee with specific recommendations, and also requested that the Police Commissioner be present at that meeting. Supervisor Battalia indicated that the next Traffic Committee meeting was scheduled for January 13, 1987 and she requested that Councilman Amlicke obtain a copy of the traffic report which Mr. Zavell indicated he would make obtainable to Mr. Hoffmann. 7. AUTHORIZATION - AGREEMENT WITH WESTCHESTER COUNTY DEPARTMENT OF PUBLIC SAFETY DRUG ENFORCEMENT Administrator Altieri presented several communications concerning the formation of a Drug Enforcement Administration Task Force in the Westchester County area and he recommended that the agreement be executed. When questioned by Councilman Amlicke as to how many days, weeks or months this would involve, Administrator Altieri replied that the Police Commissioner had recommended Patrolman Robert Koziak be enrolled in this program and that it would require one or two days a month for a period of not less than one year. - Supervisor Battalia stated that when the Task Force was first proposed, she thought it was a very good idea and, on motion by Councilman Lerman, seconded by Councilman Amlicke, it was unanimously RESOLVED, that the Town Supervisor be, and she hereby is authorized to executive the agreement with the Drug Enforcement Administration Westchester County Task Force. 8. APPROVAL OF WATER MAINS - OLD ROAD DEVELOPMENT John P. Seligman, Esq. stated that on October 8, 1986, the Planning Board granted Final Site Plan Approval for the Old Road Development to construct eleven homes, and Attorney Silverberg added that the resolution required that approval be obtained from the Town Board and the Westchester Joint Water Works for the construction of the water mains and, on motion by Councilwoman Silverstone, seconded by Councilman Lerman, it was unanimously - 7 - ©59 December 17, 1986 RESOLVED, that the Town Board hereby approves the construction of water mains for the Old Road Development Company project as shown on the subdivision construction drawings as submitted to and approved by the Town of Mamaroneck Planning Board, dated October 8, 1986. 9. SCHEDULE PUBLIC HEARING - PLUMBING CODE Attorney Silverberg stated the Board had requested that the Plumbing Code be revised and he recommended that it now be scheduled for a Public Hearing and, on motion by Councilwoman Silverstone, seconded by Councilman Lerman, it was unanimously RESOLVED, that this Board hereby sets Wednesday, January 21, 1987 at 8:15 P.M. as the date and time for a Public Hearing on the proposed Plumbing Code; and BE IT FURTHER RESOLVED, that the Town Clerk be, and she hereby is, authorized to publish in The Daily Times, the Notice of said Hearing as required by law. 10. RESOLUTION - DISTRIBUTION OF NYS REVENUE SHARING FUNDS Supervisor Battalia stated that in a communication she received from the Genesee Association of Town Officers, it was requested that that the Town Board take a stand on State Revenue Sharing and the need for a new distribtuion formula for the Town's fair share and, on motion by Councilman Amlicke, seconded by Councilwoman Silverstone, the following resolution was unanimously adopted: WHEREAS, New York's towns and villages subsidize the cities of the State with the present system of distribution of State Revenue Funds; and WHEREAS, towns only receive 16 and 1/2 cents for every dollar per capita that cities receive; NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Mamaroneck does hereby urge the State to enact a new distribution formula for New York State Revenue Sharing Funds which more equitably distributes funds amongst the municipalities. - 8 - 0 December 17, 1986 11. AMENDMENT TO SUBDIVISION REGULATIONS Attorney Silverberg stated that there was a loophole in the Town's exisiting Subdivision Regulation and, in order to prevent another occurence of someone subdividing property without having to obtain the Town's approval, he strongly recommended the Board accept the proposed regulation and, on motion by Councilwoman Silverstone, seconded by Councilman Amlicke, the following resolution was unanimously adopted: BE IT RESOLVED, that Section 3, Subdivision of the Subdivision Plat Regulations of the Planning Board of the Town of Mamaroneck be amended to read as follows: SUBDIVISION - means the division of any parcel of land into two (2) or more plots, lots, sites or other divisions of land for immediate or future sale or for building development. 12. AUTHORIZATION - MEMBERSHIP IN WESTCHESTER COUNTY VILLAGE OFFICIALS ASSOCIATION Administrator Altieri stated that in recent years, many important issues have arisen that require the cooperation of both Towns and Villages in establishing a united front to deal with high levels of government such as the County of Westchester and the State, and now the Westchester County Village Officials Association has extended its membership to include Towns. It was Mr. Altieri's recommendation that the Board authorize the Town's participation and, on motion by Councilwoman Silverstone, seconded by Councilman Amlicke, it was unanimously RESOLVED, that this Board hereby authorizes the expenditure for annual membership dues in the amount of $400 for the Town of. Mamaroneck to become a member of the Westchester County Village Officials Association. 13. SALARY AUTHORIZATIONS - RECREATION POLICE DEPT. Recreation Department Administrator Altieri submitted a memorandum for salary authorization from William V. Zimmermann, Superintendent of Recreation, and on motion by Councilwoman Silverstone, seconded by Councilman Lerman, it was unanimously - 9 - December 17, 1986 RESOLVED, that as provided for in the 1986 Town Budget, this Board hereby authorizes the hiring of the following individuals, to be effective and at the salaries so stated: Susan Vanderslice, Alternate Cashier/ Office Assistant, $5.25/hour, effective 12/20/86. Jeffrey Baumblatt, Alternate Rec. Attendant, Hammocks Ice Rink, $4.25/hour effective 12/20/86. Thomas Kirchoff, Rec. Attendant, Hammocks Ice Rink, $3.50/hour, effective retroactive to 12/13/86. Police Department Administrator Altieri presented four requests for salary authorization from Police Commissioner Dallas and, on motion by Councilman Amlicke, seconded by Councilwoman Silverstone, it was unanimously RESOLVED, that Patrolman Michael III Cindrich be, and he hereby is, promoted to Detective in the Town of Mamaroneck at an annual salary of $35,275 effective December 23, 1986; and BE IT FURTHER RESOLVED, that Patrolman Robert Koziak be, and he hereby is, promoted to Detective in the Town of Mamaroneck at an annual salary of $35,275 effective December 23, 1986; and BE IT FURTHER RESOLVED, that Deborah Woods be, and she hereby is, appointed as a Probationary Police Officer in the Town of Mamaroneck at an annual salary of $23,000 effective January 2, 1987; and BE IT FURTHER RESOLVED, that Dominick Forti be, and he . hereby is, appointed as a Probationary Police Officer in the Town of Mamaroneck at an annual salary of $23,000 effective January 3, 1987. 14. AUTHORIZATION - BUDGET TRANSFERS This item was taken up earlier in the agenda under Item #2. - 10 - 062 December 17, 1986 15. CORRECTION TO ASSESSMENT ROLL - NY TELEPHONE CO. Attorney Silverberg stated that because of the breakup of AT&T, certain equipment was no longer taxable by the Town and since New York Telephone recently submitted a petition to the Town Assessor stating what was exempt, he requested that said equipment be removed from the tax rolls and, on motion by Councilwoman Silverstone, seconded by Councilman -Amlicke, it was unanimously RESOLVED, that in accordance with terms recommended by the Town Assessor, this Board hereby authorizes the correction of the unlawful entry on the Tax Rolls with regard to the equipment owned by New York Telephone Company in accordance with the petitions of the New York Telephone Company. APPROVAL OF MINUTES The Minutes of November 5, 1986 were presented and, on motion by Councilwoman Silverstone, seconded by Councilman Amlicke, were unanimously approved as amended. At the request of Councilman Lerman, action on the Minutes of November 19, 1986 was tabled until the next meeting of the Town Board. WRITTEN COMMUNICATIONS There were no written communications to come before the Town Board at this time. ORAL COMMUNICATIONS There were no oral communications to come before the Town Board at this time. REPORT OF THE TOWN CLERK Patricia DiCioccio presented the Town Clerk's Report for the month of November, 1986 and she also presented the Building and Plumbing Report for November, 1986. - 11 - 083 December 17, 1986 THE SUPERVISOR Reports Supervisor Battalia stated that since this was Attorney Silverberg's last meeting with the Town Board, she would like to take this opportunity to express her sincere thanks for a job well done and she added the Board felt that only one gift to honor him would be appropriate! With that, Attorney Silverberg was presented with a "Purple Heart" balloon on which was inscribed: "For Service Above and Beyond the Call of Duty." Mr. Silverberg was also presented with a coffee mug which read, "Everyone is Entitled to My Opinion." A round of applause followed and Attorney Silverberg then extended his thank yous to the Board for their "thoughtful gifts." Supervisor Battalia then stated she would not give any report tonight as it was Mrs. Silverberg's birthday and she did not want to see Attorney Silverberg miss the birthday party celebration. Mrs. Eugenia Dimitriadis inquired about the status of the incinerator to which Supervisor Battalia stated that the Town Attorney had drafted a proposed local law and she requested that Mrs. Dimitriadis be furnished with a copy of the draft. REPORTS OF THE COUNCIL Councilman Amlicke: 1. Extended his personal thanks to Mr. Silverberg and to Mr. Lee Hoffman. 2. Reported on the library contract. He stated that they now had an agreement and the only change that was made since the last meeting was that the Village of Larchmont did not want a joint meeting in October with the Town Board. ADJOURN There being no further business to come before the Board, on motion by Councilman Lerman, seconded by Councilman Amlicke, it was unanimously resolved that the meeting be adjourned at 10:45 P.M.
