CONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order by
Supervisor Battalia at 8:15 p.m. in the Court Room.
Present were the following members of the Board:

CALL TO ATTENTION
Supervisor Battalia pointed out to those assembled the locations of
exits as required by law for public gatherings.
BOARD OF FIRE COMMISSIONERS
The Meeting was called to order by Commissioner Battalia at 8:20 p.m.
in the Court Room.
Present were the following members of the Commission:

1. Town Administrator, Stephen Altieri, presented fire claims for
authorization and on motion by Commissioner Silverstone,
seconded by Commissioner McGarr, it was unanimously

2. Salary Authorization
The Administrator explained that because of the retirement of
Firefighter Henry Newman, a vacancy exists for which his office
has canvassed the County eligibility list, interviews were held
by the Fire Department, and the Fire Council is recommending
the hiring of Mr. Andrew LaRocco. On motion by Commissioner
McGarr, seconded by Commissioner Silverstone, it was unanimously
RESOLVED, that this Board hereby
appoints Andrew H. LaRocco of the
Village of Mamaroneck to the
position of Firefighter for the
Town of Mamaroneck Fire Department,
at an annual salary of $22,000,
effective July 10, 1989.
Following some discussion on Fire Department access to the Thruway,
there being no further business to cane before this Commission, on
motion by Commissioner Chapin, seconded by Commissioner Price, the
meeting was unanimously declared adjourned at 8:35 p.m.
At this time, Supervisor Battalia acknowledged the presence of former
Councilman Larry Lerman and former Councilman and Assemblyman John
Peron.

Supervisor Battalia presented a plaque to Stephen Altieri in memory
of his father, and announced that there are some new sugar maple
trees placed in back of the Town Center as shade trees for the senior
citizens, one of which has been dedicated to someone with a very
close connection to this Town, Mr. Gino J. Altieri, beloved father of
the Town Administrator, Stephen Altieri.
The Administrator briefly thanked everyone, commenting that his
father had become very active in public service toward the end of his
career and held an unusual affection for the fact that he, his son,
had chosen a career in public service, making this plaque so very
special.
The Supervisor announced that there is a new resident of the Town of
Mamaroneck by the name of Sara Ann Chapin, who became a citizen on
Saturday morning. She then extended congratulations to Councilman
Chapin.
APPROVAL OF MINUTES
On motion by Councilwoman Silverstone, seconded by Councilman Chapin,
the minutes of the Special Meeting of May 25th were unanimously
approved.
On motion by Councilwoman Silverstone, seconded by Councilwoman
Price, the minutes of the Regular Meeting of June 7th were
unanimously approved.
AFFAIRS OF THE TOWN
1. Appointment - CAC
Councilwoman Silverstone briefly explained that Jane Moss had
resigned from the CAC and, since she was the representative from
Larchmont Village, their Board unanimously proposed Sandy
Feldman. On motion by Councilwoman Silverstone, seconded by
Councilman Chapin, it was unanimously
RESOLVED, that this Board hereby
appoints Sandy Feldman of Pryer
Lane, Larchmont Village, to the
Conservation Advisory Commission,
to fill the unexpired teen of
Jane Moss.

2. Consideration - FEIS Boston Post Road/Weaver Street Urban
Renewal
Following a brief discussion, on motion by Councilwoman Price,
seconded by Councilwoman Silverstone, it was unanimously
RESOLVED, that this Board hereby
accepts the Final Environmental
impact Statement as complete and
_ -- - -- _ subject to a comment period which
will terminate on July 11, 1989.
3. Authorization - Sewer Testing Agreement-County of Westchester
The Administrator informed the Board that soon the Town will
complete the two major sewer improvement projects mandated by
the State DEC pursuant to the National Clean Water Act and, he
noted that the next step is to identify and remove private
sources of storm water infiltration through the use of a smoke
testing procedure which would be provided by the DEC at no cost
to the Town, with the exception of traffic diversion and
enforcement of remediation of any private illegal conections.
On motion by Councilman McGarr, seconded by Councilman Chapin,
it was unanimously
RESOLVED, that this Board hereby
authorizes the Town administrator
to execute the agreement with the
New York State Department of
Environmental Conservation to
conduct a smoke testing procedure
within the Town to determine and
locate sources of storm water
inflow into local sanitary sewers.
4. Authorization - Accept Bids-Police Department
The Administrator briefly explained that the Police
Commissioner's Office requested authorization to purchase a
highly advanced night vision scope for the purpose of covert
anti-crime surveillance during periods when normal vision is
hampered. On motion by Councilman Chapin, seconded by
Councilwoman Price, it was unanimously
RESOLVED, that this Board hereby
authorizes the Town Administrator
to accept bids for a vision scope
known as VARO AN/PVS4 Second
Generation Starlight Scope.

5. Resolution - Legislation Warehousing of Vacant Units-Condo/Co-op
Conversions
Following a brief explanation by Councilwoman Silverstone and on
her motion, seconded by Councilman McGarr, it was unanimously
RESOLVED, that this Board hereby
supports the Governor's Program
Bill 1989 - Attorney General's
Legislative Program No. 295 Re:
an act to amend the general
business law, in relation to the
computation of excessive vacancies
in the conversion of residential
property to cooperative or
condominium ownership;
and be it further
RESOLVED, that the Town Clerk is
hereby authorized to send a copy
of the resolution adopted by the
the Town of Mamaroneck at its
Regular Town Board Meeting of
June 28, 1989 endorsing support.
6. Traffic Committee Recommendations
1. Intersection-Murray Ave./No. Chatsworth & Myrtle Blvd.
Following sane discussion, this item was held over to the
meeting of July 12th.
2. Parking East Side-Maple Hill Drive
Following some discussion, on motion by Councilman Chapin,
seconded by Councilwoman Silverstone, the following resolution
was adopted with Supervisor Battalia abstaining:
WHEREAS, there is now an existing
parking ban on the east side of
Maple Hill Drive on Sundays
between 8:00 a.m. and 1:00 p.m
presumed necessary to prohibit
excessive parking by those attending
church services, and since the Traffic
Traffic Committee has stated that
parking is minimal and this ban
should be lifted;
NOW, THEREFORE BE IT
RESOLVED, that the Town Board of
the Town of Mamaroneck, by virtue
of the authority granted to it,
does hereby repeal the amendment
to the Town Code under Chapter 81,
Article II E.

7. Update-Monroe Nursery School
The Administrator outlined additional steps being taken at this
time to further develop future use of the above-mentioned
property on Weaver Street. He noted that the Recreation
Department is finalizing types of programs to be offered and the
effective date for such. He also noted that a job description
for a caretaker is being drafted, which includes a small
apartment ensuring security and custodial services for the
building and grounds. He concluded that at the August 16th
meeting the Board will be provided with a complete proposal for
use of the facility, including cost schedules. He then fielded
questions for the Board and some discussion followed.
8. Update - Hammocks Ice Rink Restoration
The Town Administrator updated the Board on the Hammocks Ice
Rink Reconstruction Project and noted the current status of the
following: all old equipment and appurtenances were removed and
sold for $20,000; all contracts have been executed and
insurance certificates and bonds are being finalized; a
preliminary meeting with contractors to discuss schedule,
coordination and administrative procedures has been held;
installation of foundation piles was completed on June 23rd;
the excavation and foundation contractor mobilized on site and
has removed significant portions of existing curbing; and final
shop drawings have been approved for the pre-engineered
building.
9. Set Public Hearing - Sewer Use Ordinance
On motion by Councilwoman Price, seconded by Councilman McGarr
it was unanimously
RESOLVED, that this Board hereby
sets July 12, 1989 as the date
for a Public Hearing on the
proposed sewer use ordinance;
and be it further
RESOLVED, that the Town Clerk be,
and she hereby is authorized to
publish in an official newspaper
of the Town, Notice of said
hearing as required by law.
10. Set Public Hearing - Amend Local SEAR Law
On motion by Councilwoman Silverstone, seconded by Councilman
McGarr, it was unanimously

RESOLVED, that this Board hereby
sets July 12, 1989 as the date
for a Public Hearing on the
proposed amendment to the Town's
local SEQR law;
and be it further
RESOLVED, that the Town Clerk be,
and she hereby is authorized to
publish in an official newspaper
of the Town, Notice of said
Hearing as required by law.
11. Salary Authorizations - Highway Department
- Conservation
- Recreation
The Administrator reported that there is an opening in the
Highway Department, as well as two summer positions in both
Highway and Conservation. On motion by Councilwoman
Silverstone, seconded by Councilwoman Price, it was unanimously
RESOLVED, that this Board hereby
appoints Mr. Peter J. Bonito of
Cabot Road to the position of
Laborer in the Highway Department
at an annual salary of $18,200,
effective as of June 19th;
and be it further
RESOLVED, that as provided for in
the 1989 Town Budget, authorization
is hereby granted for payment of
salaries to the following:
Patrick Curley, Highway Laborer,
$7.00/hour, effective 6/20/89;
Laura Spaccavento, Conservation
Laborer, $4.50/hour, effective
6/20/89.
Pursuant to a memorandum from William Zimmermann, Superintendent
or Recreation, on motion by Councilwoman Silvertone, seconded by
Councilman Chapin, it was unanimously
RESOLVED, that as provided for in
the 1989 Town Budget, authorization

12. Authorization - Capital Project-Purchase of Monroe Nursery
School
On motion by Councilwoman Silverstone, seconded by Councilman
McGarr, it was unanimously
RESOLVED, that this Board hereby
establishes Capital Project 89-2
(Purchase of Monroe Nursery School)
in the amount of $626,000.00;
and be it further
RESOLVED, that authorization is
granted to transfer funds from
the Capital Reserve Land
Acquisition Fund to the Capital
Fund Checking Account in the
amount of $375,791.49 plus, with
the balance of monies to be
transferred in 1990-1991.
13. Home Rule Request - Police Retirement
The Administrator reported there is State legislation allowing
credit time lost during a lay-off period to be bought back by
Police Officers and, he noted, a home rule request by a Town
Police Officer would have no financial impact on the Town but
must be done through special legislation through the Senate and
Assembly. On motion by Councilwoman Silverstone, seconded by
Councilwoman Price, the following resolution was unanimously
adopted:
WHEREAS, this Town Board heretofore
requested our legislators in the
State Legislature to introduce
legislation allowing Frank
Occhiogrosso to purchase certain
retroactive service credit; and
WHEREAS, Bills in response to this -—
request have been introduced in
the Assembly and Senate, numbered
A.4199-B and S.2903-B, respectively;
NOW, THEREFORE BE IT
RESOLVED, by the Town Board of the
Town of Mamaroneck:
III The Town Clerk is hereby authorized
and directed to file the appropriate
Home Rule Request for the Assembly
and Senate Bills numbered A.2553-B
and S.1538-A respectively.

PROCLAMATION - Sam Ackerman Day
Councilwoman Silverstone gave a brief synopsis of Sam Ackennan's span
of time in Larchmont over the past quarter century and his many
accomplishments on behalf of senior citizens.
PROCCAMAZION
WHEREAS, SAM ACKERMAN came to £archmont from Tu dor Oita
in 1970 and Joined the Carchmont-Mamaroneck
Senior Center in 1974 to help abhor people,
AND
3DH£R£AS, he organized the Senior Citizen fund raising
efforts raising $5,000.00 far the Valunteer
Ambulance Carps,
AND
WH£R£A$, Sam also directed the £archmont effort to get
10% ftiscounts fur senior citizens,
AND _
WHEREAS, he arranged mang interesting and amusing
programs for the Senior Center, and is now
greatlg missed because he is residing in the
Dumont Masonic-Hame

WHEREAS, Sam Ackerman will celebrate his 100th
birthtag on June 21, 1989.

REPORTS OF THE COUNCIL
Councilwoman Price stated that there will be a group of young people
working throughout the community on certain projects for the
Conservation Department, and if one should happen to see them, they
should make them feel welcome and show appreciation for all the hard
work they are performing for our benefit.
Councilwoman Silverstone reported that there is a vacancy on the
Conservation Advisory Commission from the Village of Mamaroneck, and
that she has contacted Mayor Noto and asked him to provide a
recommendation.
Councilwoman Silverstone also mentioned how smoothly the Year of the
Family is going, and noted that both Chambers of Commerce have agreed
to restore the Halloween window painting.
Councilman McGarr requested a report from the Town Administrator on
the status of funds expended since the 1989 Town budget's adoption
one half year ago.
THE SUPERVISOR
Supervisor Battelle asked the Board members to check. their calendars
and be sure about the dates for the July and August meetings.
WRITTEN COMMUNICATIONS

ORAL COMMUNICATIONS
Dr. Alan Mason reported on events at the Reservoir and discussions of
a meeting he attended with three members of the Larchmont Village
Board and Friends of the Reservoir, and noted that he will be
attending another meeting on July 10th.
ADJOURNMENT
There being no further business to come before the Board, on motion
by Councilman McGarr, seconded by Councilwoman Price, the meeting was
unanimously declared adjourned at 9:30 p.m.
