The Work Session was held in Conference Room A to discuss code enforcement, after which, on motion duly made and seconded, it was unanimously declared adjourned at 8:05 p.m. III RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Battalia at 8:15 p.m. in the Court Room Present were the following members of the Board: Supervisor Dolores A. Battalia Councilwoman Caroline Silverstone Councilman Stephen C. Chapin Councilwoman Elaine Price Councilman John McGarr Also present were: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Edward M. Lieberman, Town Counsel Richard Tortorella, Fire Chief William McDermott, 1st Deputy Fire Chief IIICALL TO MUNITION Supervisor Battalia pointed out to those assembled the locations of exits as required by law for public gatherings. 409 BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Battalia at 8:25 p.m. in the Court Room. Present were the following members of the Commission: illIII Commissioner Dolores A. Battalia Commissioner Caroline Silverstone Commissioner Stephen C. Chapin Commissioner Elaine Price Commissioner John McGarr 1. Commissioner Chapin presented fire claims for authorization of payment and on his motion, seconded by Commissioner Price, it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office: ESCO $ 25.00 Excelsior Garage & Machine Works, Inc. 88.00 I. & T. Plumbing & Heating Co., Inc. 200.00 Mamaroneck Garage, Inc. 122.90 $435.90 2. Bond Resolution - Mini Attack Pumper IIITown Administrator, Stephen Altieri, outlined the procedure necessary pursuant to the Local Finance Law and Fire District Law for the mandatory referendum on the proposition of borrowing funds for the purchase of the mini attack pumper for which the State Legislature has awarded a $23,000 grant. Following a brief discussion, on motion by Commissioner Price, seconded by Commissioner Silverstone, the following resolution was unanimously adopted, to-wit: BOND RESOLUTION DATED MAY 3, 1989. A RESOLUTION AUTHORIZING THE PURCHASE OF A MINI-ATTACK PUMPER INCLUDING ORIGINAL APPARATUS TO BE USED IN CONNECPION THEREWITH FOR THE MAMARONECK FIRE DISTRICT NO. 1 IN THE TOWN OF NAMARONECK, WESTCHESTER COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $75.000, AND AUTHORIZING THE ISSUANCE OF $75,000 SERIAL BONDS OF SAID FIRE DISTRICT TO PAY THE COST THEREOF. BE IT RESOLVED, by the Board of Fire Commissioners of the Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, as follows: III Section 1. The purchase of a mini-attack pumper including original apparatus to be used in connection therewith, a specific object or purpose, for the Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, is hereby authorized at a maximum estimated cost of $75,000. 2 410 May 3, 1989 Section 2. The Plan for the financing of such specific object or purpose shall be by the issuance of $75,000 serial bonds of said Fire District, hereby authorized to be issued therefore pursuant to the Local Finance Law; provided, however, that the amount of serial bonds ultimately to be issued will be reduced by the amount of any Federal and/or State grants-in-aid received for such object or purpose. Further details concerning said bonds will be prescribed in a further resolution or resolutions of this Board. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is twenty years, pursuant to subdivision 27 of paragraph a of Section 11.00 of the Local Finance Law. Section 4. The faith and credit of said Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of any interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property in said Fire District, a tax without limitation as to rate or amount sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Fire District Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Fire District Treasurer, consistent with the provisions of the Local Finance Law. Section 6. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Fire District is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 7. Upon this resolution taking effect, the same shall be published in full in The Daily Times, which is hereby designated as the official newspaper of said Fire District for such purpose, together with a notice of the Fire District Secretary in substantially the form provided in Section 81.00 of the Local Finance Law. 3 41.1 May 3, 1989 Section 8. This resolution is adopted subject to approval at a special election of said Fire District to be held on the 13th day of June, 1989. A special election of the qualified voters of the Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, is hereby authorized to be held on the 13th day of June, 1989, at the Weaver Street Firehouse, in Mamaroneck, New York, in said Fire District, between the hours of 5:00 o'clock p.m. and 9:00 o'clock p.m. Prevailing Time, for the purpose of voting by ballot on the adoption or rejection of the bond resolution heretofore adopted at this meeting. Section 2. The notice of such special election shall be in substantially the following foam, to-wit: NOTICE OF SPECIAL ELECTION Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York NOTICE IS GEREBY GIVEN that, pursuant to Section 38.00 of the Local Finance Law and Section 179 of the Town Law, a special election of the qualified voters of the Mamar oneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, will be held at the Weaver Street Firehouse, in Mamaroneck, New York, in said Fire District, on the 13th day of June, 1989, between the hours of 5:00 o'clock p.m. and 9:00 o'clock p.m., Prevailing Time, for the purpose of voting by ballot on the adoption or rejection of the following resolution: 4 May 3, 1989 412 BOND RESOLUTION DATED MAY 3, 1989. A RESOLUTION AUTHORIZING THE PURCHASE OF A MINI-ATTACK PUMPER INCLUDING ORIGINAL APPARATUS TO BE USED IN CONNECTION THEREWITH FOR THE MAMARONECK FIRE DISTRICT NO. 1 IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OS $75,000, AND AUTHORIZING THE ISSUANCE OF $75,000 SERIAL BONDS OF SAIF FIRE DISTRICT TO PAY THE OOST THEREOF," duly adopted by the Board of Fire Commissioners of said Fire District on the 3rd day of May, 1989, be approved? Section 3. The Fire District Secretary is hereby authorized and directed to give notice of such special election by publication of the notice described in Section 2 hereof once in The Daily Times, a newspaper published in Mamaroneck, New York, and having a general circulation in said Fire District, the first publication to be not less than thirteen (13) nor more than twenty (20) days prior to the date of such election. Section 4. Only those persons registered with the County Board of Elections (hereinafter the "Board of Elections") on or before May 21, 1989 shall be entitled to vote upon the aforesaid proposition. No additional personal registration shall be permitted. The Board of Elections is hereby requested to deliver to the Fire District Secretary a list of persons registered to vote on or before the 21st day of May, 1989 to said Fire District or to place the registration poll records for such Fire District in properly locked ledgers in the temporary custody of the Fire District Secretary for the purpose of permitting the copying of such records. The Inspectors of Election shall meet at the time and place to be set forth in a further resolution of the Board of Fire 6 May 3, 1989 414 Commissioners of said Fire District to prepare the register for the election called hereby. Such register shall be prepared pursuant to the requirements of Section 175-a of the Town Law by adopting, using or copying from the registration list certified and supplied by the Board of Elections the names appearing thereon of all persons residing in said Fire District and qualified to vote in such election. The register shall include at least the space for the name of the voter, his or her address within said Fire District and a space for his or her signature to be signed by the voter on election day. The Fire District Secretary shall furnish the Inspectors of Election, at the expense of said Fire District, with all necessary registration books, papers, equipment and supplies. Section 5. This resolution shall take effect immediately. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Dolores A. RESOLUTION DESIGNATING INSPECTORS OF ELECTION OF THE MAMPiRONECK FIRE DISTRICT NO. 1 IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK. WHEREAS, subdivision 6 of Section 175-a of the Town Law, as amended by Chapter 456 of the Laws of 1986 of the State of New York, requires the board of fire commissioners of any fire district, by resolution adopted at least forty days prior to fire district elections, to designate a resident fire district elector to serve as chairman of such election and not less than two nor more than four resident fire district electors to act as election inspectors and ballot clerks in such election; and WHEREAS, any such resolution must also fix the compensation of such chairman and such inspectors; and WHEREAS, it is anticipated that a special election of the Mamaroneck Fire District No. 1 of the Town of Mamaroneck, Westchester County, New York, will be held not less than forty days from the date hereof; NOW, THEREFORE BE IT RESOLVED, by the Board of Fire Commissioners of the Mamaroneck Fire District No. 1 of the Town of Mamaroneck, Westchester County, New York, as follows: 7 • May 3, 1989 415 Section 1. The following resident fire district electors of said Fire District who are not officers of said Fire District, are hereby designated to act as election officers, respectively indicated below: Chairman of Election: Louise Ludecke Carole Hoffman Margaret Degan ) Inspectors Nancy Angiulo ) Patricia Flint ) Section 2. The persons named above shall be paid the sum of $40.00 each for their services. Section 3. This resolution shall take effect immediately. RESOLUTION SETTING THE TIME AND PLACE OF A MEETING OF THE INSPECTORS OF ELECTION OF THE NAMARONECK FIRE DISTRICT NO. 1 IN THE TOWN OF NNECK, WESTCHESTER COUNTY, NEW YORK, FOR THE PURPOSE OF PREPARATION OF THE FIRE DISTRICT ELECTION REGISTRATION. WHEREAS, the Board of Fire Commissioners of the Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York, resolved on May 3, 1989 to call a special election of said Fire District, such special election to be held at Weaver Street Firehouse, in Mamaroneck, New York, in said Fire District, on the 13th day of June, 1989, between the hours of 5:00 o'clock p.m. and 9:00 o'clock p.m., Prevailing Time; and WHEREAS, pursuant to Section 175-a of the Town Law, only persons registered with the Westchester County Board of Elections on or before May 21, 1989 shall be entitled to vote in such special election; and WHEREAS, such Section 175-a requires that a resolution setting the time and place of the meeting of the election inspectors appointed by said Board of Fire Commissioners of said Fire District for the aforesaid special election be adopted at least thirty days prior to such special election and be published of less than twenty-seven days prior to such special election; 8 May 3, 1989 416 s NOW THEREPORE, BE IT RESOLVED, by the Board of Fire Commissioners of the Mamaroneck Fire District No. 1 in the Town of Mamaroneck, Westchester County, New York; Section 1. The inspectors of election approved by resolution duly adopted by said Board of Fire Commissioners on May 3, 1989, shall meet at Weaver Street Firehouse in Mamaroneck, New York, in said Fire District, on the 25th day of May, 1989 at 10:00 o'clock a.m. to commence preparation of the register of those persons eligible to vote in such special election. In accordance with said Section 175-a of the Town Law, only those persons registered with the Board of Elections of Westchester County on or before May 21, 1989 will be entitled to vote at such special election. Section 2. This resolution, which takes effect immediately, shall be published in full in The Daily Times, a newspaper of general circulation in said Fire District, one time at least twenty-seven days before such special election. Chapin VOTING aye Elaine Price VOTING aye John McGarr VOTING aye The resolution was thereupon declared duly adopted. * * * * * * At this time, pursuant to explanationnby the Town Clerk, on motion by Commissioner Silverstone, seconded by Commissioner McGarr, it was unanimously RESOLVED, that this Board will hold a special meeting at 9:30 p.m. on June 13, 1989, at the Weaver Street Fire House, for the purpose of canvassing and certification of votes. 3. Prepare Specifications - Mini-Attack Pumper On motion by Commissioner McGarr, seconded by Commissioner Silverstone, it was unanimously RESOLVED, that the Board hereby authorizes the Town Administrator to prepare specifications and accept bids for a mini-attack pumper, including original apparatus. 9 May 3, 1989 417 4. Report of Bids - Telephone System Following a brief report by the Administrator of bids received, on motion by Councilwoman Silverstone, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board hereby authorizes the Administrator to execute the contract with the lowest responsible, and only bidder, A. T. & T., Inc. for furnishing and installing a telephone system in the Weaver Street Fire House building at a total price of $7,087.00. There being no further business to wane before this Commission, on motion by Commissioner McGarr, seconded by Commissioner Chapin, the meeting was unanimously declared adjourned at 8:40 p.m. APPROVAL OF MINUTES The minutes of the Regular Meeting of February 15, 1989 which had been previously submitted were presented and on motion by Councilwoman Silverstone, seconded by Councilman Chapin, were unanimously approved as amended. The minutes of the Regular Meeting of April 5, 1989 were presented and on motion by Councilwoman Silverstone, seconded by Councilman McGarr were unanimously approved as amended. AFFAIRS OF THE TOWN 1. Appointment - Recreation Commission On motion by Councilwoman Silverstone, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby reappoints Sandra Bile of Larchmont Village to the Recreation Commission for a term of seven years, expiring May 1996. 2. Consideration of NO PARK NG ordinance - Rockingstone Avenue The Supervisor asked for a motion and since no motion was given, no action was taken on the above-mentioned item. 10 May 3, 1989 418 3. Consideration of Traffic Control Device - Rockingstone Avenue and Mountain Avenue Following individual comments by each Board member and same discussion among the Board and some of the audience, on motion by Councilman Chapin, seconded by Councilwoman Price, the following resolution was adopted by roll-call to-wit: AN ACT TO AMEND THE VEHICLE AND TRAFFIC ORDINANCE OF THE TOWN OF MAMARONECK TO CONTROL TRAFFIC AT THE INTERSECTION OF MOUNTAIN AVENUE AND ROCKINGSTONE AVENUE BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK AS FOLLOWS: Section 1. 81-6 (40) of the Town Code of the Town of Mamaroneck is hereby repealed. 2. Section 81-6 is hereby amended by adding thereto a new Subdivision, to be known as Subdivision (40), to read as follows: (40) On Rockingstone Avenue approaching Mountain Avenue from both directions. 3. Subdivision A of Section 81-8 of the Town Code of the Town of Mamaroneck is hereby amended by adding thereto a new Subdivision, to be known as Subdivision (7) , to read as follows: (7) At the intersection of Rockingstone Avenue and Mountain Avenue; a red and yellow flashing light with the red light facing traffic on Rockingstone Avenue and the yellow light facing Mountain Avenue. 4. This act shall take effect immediately. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Dolores A. Authorization to Prepare Specifications and Accept Bids - Rubbish Removal-Hoatimocks Ice Rink On motion by Councilman Chapin, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to prepare bid specifications and accept bids for rubbish removal for the Hammocks Ice Rink construction project. 11 May 3, 1989 419 5. Set Date Public Hearing - Sewer Use Ordinance The Administrator briefly updated the Board on the need for the public hearing based upon the fact that since federal funds were used for the inflow-infiltration projects and pump station at Baldwin Avenue, the National Clean Water Act requires the locality to adopt a sewer-use ordinance. He explained further that this essentially governs the types of liquids and products that may enter the sanitary sewer system, and provides for enforcement of the ordinance. On motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby sets June 7, 1989 as the date for a Public Hearing on the proposed Sewer Use Ordinance; and be it further RESOLVED, that the Town Clerk be, and she hereby is authorized to publish in an official newspaper of the Town the Notice of said Hearing as required by law. 6. Salary Authorization - Recreation On motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that as provided for in the 1989 Town Budget, authorization is hereby granted for payment of salaries to the following: Mel Seigel, Tennis Instructor, Adult & Youth Lessons, $24/hour, effective 5/2/89; David Paterno, Park Labor, $6.50/hour, effective 5/2/89; Zena Royal King, Tennis Attendant, $7.50/hour, Memorial Park, effective 5/1/89. At this time the order of the agenda was changed and and added item entitled Establishment of Tara Bendix Memorial Fund was taken up. The Supervisor explained that the daughter of Helga Bendix, one of the Town's longstanding volunteers, died and establishment of a fund was suggested and discussed. On motion by Councilwoman Price, seconded by Councilman McGarr, the following resolution was unanimously adopted: 12 May 3, 1989 420 TARA BENDIX MEMORIAL FUND WHEREAS, the Town Board is deeply sorrowed by the passing away of Tara Bendix; and WHEREAS, Tara was a remarkable Down's Syndrome child who had worked diligently to attain many accomplishments, one of which was to be her graduation from Mamaroneck High School in June; and WHEREAS, Tara's mother,Helga, has been an involved and truly committed member of our Community, chairing various committees and working diligently to advocate the needs of special children; NOW THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Mamaroneck does hereby authorize the Comptroller to open a Manorial Fund in the name of Tara Bendix; and be it further RESOLVED, that contributions to this Fund be used for the express purpose of much needed landscaping of the property of the Group Hoarse located on Palmer Avenue in the Town of Mamaroneck.
