HomeMy WebLinkAbout1989_03_15 Town Board Regular Minutes 376 MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD AND BOARD OF FIRE COMMISSIONERS OF THE TOWN OF MAMARONECK, HELD ON THE 15TH DAY OF MARCH 1989 IN THE COURT ROOM OF THE 'DOWN CENTER, 740 WEST BOSTON POST ROAD, NNECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Battelle at 7:00 p.m., at which time the Board recessed into Executive Session. The Executive Session was held in Conference Room A to discuss matters of personnel and real property, after which, on motion duly made and seconded, it was unanimously declared adjourned at 8:20 p.m. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Battelle at 8:30 p.m. in the Court Room. Present were the following members of the Board: Supervisor Dolores A. Battelle Councilwoman Caroline Silverstone Councilman Stephen C. Chapin Councilwoman Elaine Price Councilman John McGarr Also present were: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Edward M. Lieberman, Town Counsel Arthur T. Dallas, Police Commissioner William McDermott, 1st Deputy Fire Chief CALL TO ATTENTION Supervisor Battelle pointed out to those assembled the locations of exits as required by law for public gatherings. 377 BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Battalia at 8:35 p.m in the Court Room. Present were the following members of the Commission: Commissioner Dolores A. Battalia Commissioner Caroline Silverstone Commissioner Stephen C. Chapin Commissioner Elaine Price Commissioner John McGarr 1. Commissioner Price presented fire claims for authorization of payment and on her motion, seconded by Commissioner McGarr, it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office: Albertson Communications, Inc. $ 64.00 All Power Equipment Co., Inc. 745.00 A11 Power Equipment Co., Inc. 89.65 Consolidated Uniform Service 13.97 Excelsior Garage & Machine Works, Inc. 988.20 Larchmont Auto Parts Distr., Inc. 79.80 FF John Maxwell 39.00 New England Uniform 1,182.00 Technical Electronics, Inc. 365.90 Town of Mamaroneck Professional Fire Fighters Association 165.00 Fire Training - Westchester County Fire Control 100.00 $3,831.68 There being no further business to come before this Commission, on motion by Commissioner Silverstone, seconded by Commissioner McGarr, the meeting was unanimously declared adjourned at 8:45 p.m. APPROVAL OF MINUTES - February 15, 1989 The Minutes of February 15th were held over pending additions and changes. AFFAIRS OF TIE TOWN 1. Discussion of Traffic Committee Recommendations - Rockingstone Avenue and Mountain Avenue Supervisor Battalia gave a brief update, followed by further clarifications by the Town Administrator that the majority of 2 March 15, 1989 378 the Traffic Committee wishes to have the flashing signal eliminated and a full operating traffic signal installed, while the minority favors changing the existing signal to provide a red indicator on Rockingstone Avenue and a yellow indicator on Mountain Avenue. Following a somewhat lengthy discussion, on motion by Councilwoman Silverstone, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board hereby sets April 26, 1989 as the date for a Public Hearing on a proposed reversal of the order of the signal light on Mountain Avenue and Rockingstone Avenue; and be it further RESOLVED, that this Board hereby sets April 26, 1989 as the date for a Public Hearing on the elimination of parking for a distance of 200 feet in either direction from the intersection of Mountain Avenue and Rockingstone Avenue; and be it further RESOLVED, that the Town Clerk be, and she hereby is authorized to publish in an official newspaper of the Town of Mamaroneck the Notice of said Hearing as required by law. 2. Authorization - Westchester County Tax Warrant 3. Authorization - Town Tax Warrant On motion by Councilman Chapin, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes the Deputy Receiver of Taxes for the Town of Mamaroneck to collect 1989 State, County, Town and Special District taxes and the water rents which become a lien on January 1, 1989; and be it further RESOLVED, that in accordance with provisions of Section 500 of the Westchester County Administrative Code, the Deputy Receiver of Taxes shall publish in the official newspaper of the Town of Mamaroneck, the "Notice of Collection of State, County, Town, and Special District Taxes and water rents;" 3 379 March 15, 1989 and be it further RESOLVED, that in accordance with the provisions of Section 550 of the Westchester County Administrative Code, the Town Board does hereby direct the Deputy Receiver of Taxes and Assessments to mail to each taxpayer of the Town of Mamaroneck, whose address is known to said Deputy of Receiver of Taxes and Assessments, a tax bill for all taxes and water rents, the expense thereof to be a Town charge. (see Tax Warrants on pages 5 and page 6) 4. Authorization - Tax Lien Sale On motion by Councilwoman Silverstone, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board hereby authorizes a Tax Lien Sale to be held on Friday, May 19, 1989 at 10:00 a.m. for the 1988 Town and County taxes and the 1988-89 School taxes. 5. Authorization - Purchase of Dump Truck On motion by Councilman Chapin, seconded by Councilwoman Silverstone, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to submit an order under the New York State purchasing contract for one 35,000 GVM Dump Truck for a total price of $48,685. 4 380 March 15, 1989 - ------- --- STATE OF NEW YORK ) — COUNTY OF WESTCHESTER ) I, Edward J. Authorization - Acceptance of Public Improvements - Garfield Apartment Complex (Carlton House) The Administrator fielded questions fraan the Board, after which time, on motion by Councilwoman Price, seconded by Councilman McGarr, the following resolution was unanimously adopted: WHEREAS, the Planning Board of the Town of Mamaroneck granted final site plan approval on May 8, 1985 and final subdivision approval on the development of the Carlton House Condominiums (hereinafter ”Applicant"); and WHEREAS, such approvals set forth certain requirments for road improvements, sanitary sewer improvements, drainage improvements and other terms and conditions in conjunction with the development of said project; and WHEREAS, the Town Administrator has received reports from the Highway Department, Building Inspector and Consulting Engineer indicating the satisfactory completion of the road, sanitary sewer, drainage and improvements; and WHEREAS, the Applicant has offered New Jefferson Street for dedication to the Town; NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Mamaroneck hereby agrees to accept New Jefferson Street as constructed by the Applicant together with the sanitary sewer and drainage improvements constructed by the Applicant in connection with said project; and be it further RESOLVED, that the Town Board directs the release of any bonds posted to secure the construction of said improvements. 7. ORAL COMMUNICATIONS Phyllis Wittner, Chairman of the CZMC, submitted the second annual report of the Town of Mamaroneck - Village of Larchmont Coastal Zone Managment Commission for October 1987 through September 1988. REPORTS OF THE COUNCIL No Reports TOWN CLERK The Town Clerk submitted the monthly reports of the Town Clerk's Office and the Building Department for the month of February 1989. ADJOURNMENT There being no further business to came before the Board, on motion by Councilman McGarr, seconded by Councilwoman Price, the meeting was unanimously declared adjourned into a work session at 10:00 p.m. WORK SESSION - Held after Town Board Meeting of March 15, 1989 The Supervisor and Town Board discussed with the Administrator his lists of goals for the year 1989. The Administrator indicated that Department Heads had also been asked to list their individual goals and that both Town Board and Staff goals would be prioritized. The Administrator shall prepare the staff list of goals and the Supervisor shall prepare the list of goals for the Town Board. The Board then discussed the current status of the Master Plan update and further reviewed the proposed M.U.B. zone. The Administrator submitted to the Board a report prepared by the Building Inspector indicating various residential uses that may he acccenplished within the M.U.B. zone.
