HomeMy WebLinkAbout1924_04_02 Town Board Minutes 295 Meeting of Town Board Town of Mamaroneck held, April 2, 19' - The meeting was celled to order by Supervisor Burton at 9:30 P.M. PRESENT: Supervisor Burton, Justices Boyd, Collins & Shafer, Town 'Clerk Sherman. Upon motion duly seconded, it was voted to dispense with the reading of minutes of meetings not yet approved. The report of the Receiver of Taxes for the month of March, 1934 was received, read, ordered placed on file and is as follows: April 1st, 1924. I find in my in- spections a disposition of bath builder and owner to co-operate with this department and in only a few instances has it been necessary for me to suggest changes in construction to conform to the code. Dear Mr. Sherman* At a meeting of the Board of Appeals held last night, the following resolutions were adopted: Resolved, That the Board of Appeals recommend to the Town Board that the appeal of Hazel . Merrit to erect a private garage on the south- east side of Myrtle Avenue, five hundred and fifty-three feet north of Thomson Street within seventy-five feet of the street line be granted, and the decision of the Building Commission be reversed. Resolved, That the Board of Appeals recommend to the Town Board that the appeal of the New Rochelle Foundry Company to alter the present foundry building on the north side of Lester Place, one hundred and fifty feet west from Monroe Avenue, within a "B" Residential District for stoarge pur- poses only be granted, and the decision of the Building Commission be reversed. Resolved, That the decision of the Building Com- mission in connection with the appeal of Joseph Acampora to erect a private residence on the south- :vest corner of Myrtle and Cedar Streets within -- thirty feet of the street line be reversed, but that the Board of Appeals recommend to the Town Board that the appeal be granted with the proviso that no Part of said building shall be nearer than fifteen feet to Cedar Street or nearer than thirty feet to Myrtle Avenue. Resolved, That the appeal of Luca Tripoli to erect a private residence on the south side of West Brook- side Drive, One hundred and seventy-five feet west of Lansdowne Drive within thirty feet of the street line be denied, and the decision. of the Building Commission be affirmed. Resolved, That the Board of Appeals recommend to the Town Board that the appeal of George Seinner to erect a private residence on the southeast corner of Valley Road and Fern Road within thirty feet of the street line as shown on the plot be granted, and the decision of the Building Commission be reversed. Resolved, 'That the Board of Appeals recommend to the Town Board that the appeal of Mrs. E. J. Smith to alter the present frame building at 65 Palmer Avenue within an "A" Residential District by adding a sun porch in accordance with the plans submitted be granted, and the decision of the Building Commission be reversed. Resolved, That the Board of Appeals recommend to the Town Board that the appeal of Joseph M. Fallon, Jr. to erect a private residence on the northwest corner of Myrtle Avenue and Preston Street within thirty feet of the street line in accordance with the plot plans be granted, and the decision of the Building Commission be reversed. Yours very truly, (Signed) Richard N, fall Secr. Board of Appeals 301 Mr.Tilliam McCarthy appeared before the Board oh behalf of his appeal case of the New Rochelle Foundry Co. ir. A.H. Stevens was also present and he stated that it was his opinion that the understanding at the meeting of the Board of Appeals pertaining to the New Rochelle Foundry Company' s appeal was that no extra cupolas were to be added to the structure. Thereupon the following resolutions were presented and upon Roll Call were unanimously adopted- WHEREAS, the Board of Appeals recommend to the Town Board that the appeal of H. w.Merritt to erect a private gargge on the aouthwast side of Myrtle Avenue,five hundred and fifty three feet north of Thomson St. within Ik±zIaxfsaIxzfxkhx alrami1 seventy five feet of the street line be granted, and the decision of the Building Commission be reversed,therefore be it RESOLVED, that the Town Board pursuant to Article 15, Section 26 of the Town Law, hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. WHEREAS, the Board of Appeals recommiand to the Town Board that the appeal of the New Rochelle Foundry Company to alter the present foundry building on the north side of Lester Place, one hundred and fifty feet west from Monroe Avenue, within a "B" res- idential district for storage purposes only be granted, and the decision of the Building Commission be reversed, therefore be it RESOLVED, that the Town Board pursuant to Article 15, Section 26 of the Town Law, hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. WHEREAS, the Board of Appeals recommend to the Town Board that the appeal of George Seinner to erect a private residence on the southeast corner of Valley Road and Fern Road within thirty feet of the street line as shown on the $lot be granted, and the decision of the Building Commission be reversed, there- fore be it RESOLVED, that the Town Board pursuant to Article 15, Section 26 of the Town Law,hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. WHEREAS, THE Board of Appeals recommend to the Town Board that the appeal of Hrs.E.J. Smith to alter the present frame building at 65 Palmer Avenue within an "All Residential District by adding a sun porch in accordance with the plans submitted be granted, and the decision of the Building Commission be reversed, therefore be it RESOLVED, that the Town Board pursuant to Article 15, Section 26 of the Town Law, hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. A communication from Mr.A. J.Eaves of 12 Locust Avenue, Larchmort, N.Y. , was received and read complaining of the duplication of names of streets within the Larchmont Postal district . The matter was referred to the Committee of this Board for their reco!f_mendation. A communication from the Weaver Street Fire Co. was received and read requesting the purchase of uniforms for the paid fireman and also the purchase of a fleece lined corduroy coat to be used by the e drivers/ The ma t er s w ere referred to the Fire House Comm. Upon motion duky seconded., it was Voted, that anyone prestItt wishing to appear before the Board, be now heard. yr.t4essersmith addressed the Board on behalf of Dr. William H.Cantle and P1r.Gail Boarden in relation to the closing of Murray Avenue at the Murray Avenue School. After discussing the question at length with both PSr.yessersmith and. Police Commissioner Whitaker, it was VOTED, that the matter of closing of Murray Avenue between Glen Road and Forest Avenue, be referred to the County Attorney, Supervisor and Police Commis® ioners for legal opinion and to report back to this Board. The Supervisor stated that it may be necessary for him to proceed to Albany to take care of certain legislation before the Legislature and upon motion duly seconded, it was VOTED, that the Supervisor be authorized and empowered to make whatever expendit- ures are necessary to appear at Albany or behalf of pending legislation, if found necessary, and expenses incurred therebm be made a Town charge. - 3'03 The following resolution was presented and upon Roll Call was unanimoulsy adopted: IVIEREAS, the Board of Appeals recommeddto the Town Board that the appeal of Joseph M.Fallon Jr. , to erect a private residence on the northwest corner of Myrtle Avenue and Preston Street within thirty feet of the street line in accordance with the plot plans be granted, and the decision of the Building Commission be reversed, therefore be it RESOLVED, that the Town Board pursuant to Article 15, Section 26 of the Town Law, hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. A communication was received from ,.r.Ferdinand Fish requesting extra compensation for his duties as an Assessor. After discussing the matter the communication was ordered filed and the same laid over for further consideration. The meeting adjourned at 11.10 P.M. Town Clerk.
