HomeMy WebLinkAbout1989_02_01 Town Board Regular Minutes 342 MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD AND BOARD OF FIRE COMMISSIONERS OF THE TOWN OF MAMARONECK, HELD ON THE 1ST DAY OF FEBRUARY 1989 IN THE COURT ROOM OF THE TOWN CENTER, 740 WEST BOSTON POST ROAD, MAMARONECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Battalia at 7:10 p.m., at which time the Board recessed into Executive Session. The Executive Session was held in Conference Roan A to discuss matters of personnel and litigation, after which, on motion duly made and seconded, it was unanimously declared adjourned at 8:30 p.m. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Battalia at 8:40 p.m. Present were the following members of the Board: Supervisor Dolores A. Battalia Councilwoman Caroline Silverstone Councilwoman Elaine Price Councilman John McGarr Councilman Chapin was unable to attend since he was not in Town at this time. Also present were: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Edward M. Lieberman, Town Counsel Richard Tortorella, Fire Chief William McDermott, 1st Deputy Fire Chief CALL TO ATIEN2ION Supervisor Battalia pointed out to those assembled the locations of exits as required by law for public gatherings. 343 February 1, 1989 BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Battalia at 8:45 p.m in the Court Roam. Present were the following members of the Commission: GbamLissioner Dolores A. The Town Clerk presented for the record the Affidavits of Publication and Posting of the Notice of Hearing. The Supervisor informed the Board that she had been contacted, earlier this evening, by Hr. Hesel who told her that the Howell Park Association wished to withdraw their request for one-way traffic on Howell since it appears that closing of the Weaver Street Bridge had reduced traffic significantly and its reopening has not caused any major increase. Supervisor Battalia noted that while they feel traffic may eventually rear up again, for the moment they do not want to establish any inconvenience to the neighborhood. Following some discussion by the Board, the Supervisor then asked if anyone wished to address the Board either in favor or against the proposal or the withdrawal of such. There being no one who wished to speak, on motion by Councilwoman Price, seconded by Councilman McGarr, the meeting was unanimously declared closed. At this time, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby rejects the proposal to establish one-way traffic on Howell Avenue between Hawthorne Road and Weaver Street. PUBLIC HEAR - No Turn on Red-Myrtle Boulevard and North Chatsworth Avenue On motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Public Hearing be, and hereby is declared open. The Town Clerk presented for the record the Affidavits of Publication and Posting of the Notice of Hearing. Following explanation by the Administrator in the absence of Councilman Chapin, liaison of the Traffic Committee, Supervisor Battalia asked if anyone wished to address the Board in favor of the proposal. Patricia Bailey of Lookout Circle asked about the length of time of the light and noted that she was in favor, as was Sandra Kerrest, also of Lookout Circle. 3 February(t, 1989 345 There being no further comments, on motion by Councilwoman Price, seconded by Councilwoman Silverstone, the Public Hearing was unanimously declared closed. Thereafter, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, the following resolution was unanimously adopted: WHEREAS, on August 8, 1984, the Police Commission passed a Resolution to install "No Turn on Red" signs on the north and south corners of Myrtle Boulevard and North Chatsworth Avenue; and WHEREAS, at the request of the Village of Larchmont, the "No Turn On Redly sign on the northeast corner of said intersection was removed during the time of the closure of the Weaver Street Bridge; and WHEREAS, the Traffic Cammitte has recommended that the removal of said sign be made permanent; NOW, THEREFORE BE IT RESOLVED, that pursuant to Section 81-4 (H) of the Town Code, the Resolution of August 8, 1984 is hereby repealed to the extent that said sign be removed from the northeast corner of the intersection of Myrtle Boulevard and North Chatsworth Avenue permanently. AFFAIRS OF THE TOWN 1. Appointments - Cable TV Advisory Board - Conservation Advisory Commission The Supervisor reported that Councilman Chapin was suddenly called out of Town so appointment to the Cable Board would be held over. Councilwoman Silverstone briefly outlined the qualifications, of Susan Cavalieri and mentioned that she had been recommended by the Mayor of Larchmont. Thereafter, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby appoints Susan Cavalieri of Oak Avenue, Larchmont Village, as a member of the Conservation Advisory Commission for a period of two years. 4 February , 7, 1989 346 2. Authorization - Settlement of Tax Certiorari-Con Edison Following explanation by the Town Administrator, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that in accordance with the terms recommended by Special Counsel for the Town, Marvin Fink, this Board hereby authorizes settlement of certiorari proceeding - Con Edison vs. Town of Mamaroneck - for assessment years 1975 through 1988. Thereafter, on motion by Councilwoman Price, seconded by Councilman McGarr, the following resolution was unanimously adopted: WHEREAS, the State Division of Equalization and Assessment has transmitted to the Town of Mamaroneck, on December 19, 1988, the final special franchise assessment for Con Edison; and WHEREAS, the 1989 Budget for the Town of Mamaroneck was adopted on December 20, 1988 pursuant to New York State Law; NOW, THEREFORE BE IT RESOLVED, that this Board hereby authorizes the Town Budget Officer to adjust the tax rate for 1989 to the necessary amount. 3. Authorization - Capital Improvements-WJWW The Administrator informed the Board that although they received a report for four proposed joint projects, the Westchester Joint Water Works, at this time, is not requesting authorization on projects #1 and #11 but this information is provided as an update and authorization for it will be requested later in 89 or early 90. He reported that what they are requesting is authorization on projects #111 and #1V of which the Town's share is $61,000. Following a brief discussion, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck does hereby adopt the Capital Improvements program for 1989 and hereby authorizes transfer of funds in the amount of $61,000; 5 February 1, 1989 T and be it further RESOLVED, that the adopted Capital improvements program be subject to other action required by the Town Board for a special improvement district insofar as the Deerfield Lane project is concerned. 4. Authorization - Prepare Bids & Specifications and Accept Bids Hammocks Ice Rink Following a brief explanation and updating by the Town Administrator, the Board reviewed each of the three cost summaries and asked questions which were fielded by Mr. Altieri. A great deal of discussion ensued. Mr. Jerry Glazer gave a very lengthy address to the Board. Mr. Dom Ruggiero stated that he was not asked to review the new plans. Mr. Birdzell spoke more about the cost breakdown. Mr. Jim Romeo spoke about the three systems. Thereafter, on motion by Councilwoman Silverstone, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to prepare specifications and advertise for bids for both the least expensive and most expensive of the feasibility cost summaries which have been submitted. 5. Authorization - Contract Renewal Westchester Shore Humane Society On motion by Councilwoman Silverstone, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to enter into agreement with Westchester Shore H mane Society for municipal dog patrol and the care and custody of dogs under the Town dog ordinance. 5. Request of Burbank Realty - Parking Lot #1 On motion by Councilwoman Silverstone, seconded by Councilwoman Price, it was unanimously 6 348 February 1, 1989 • RESOLVED, that this Board hereby authorizes the Town Administrator to enter into agreement with Burbank Realty to place hoods III over the parking meters in Lot #1 and along Depot Way and Vine Street as a free 'BE OUR VALENTINEn for commuters for the sum of $200.00. 7. Salary Authorization - Town Administrator - Recreation The first item, salary authorization - Town Administrator was held over to the next meeting. THE SUPERVISOR Supervisor Battalia announced that tomorrow night at 8:00 p.m., there would be a joint organizational meeting with the Housing Task Force. She also reminded the Board that there should be a meeting on the strategic planning project, and noted that there are a number of assignments due. A meeting was decided upon for February 7th at 7:30 p.m. The Supervisor commented that since the Board has not yet finished the strategic plan, in order to allow Steve to begin planning, she would like the Board members to list their top priorities of what they would like to see the Board accomplish this year. The Town Administrator noted that tomorrow the Staff would be submitting their goals for 1989. ADJOURNMENT There being no further business to wane before the Board, on motion by Councilwoman Silverstone, seconded by Councilwoman Price, the meeting was unanimously declared adjourned at 9:30 p.m., and reconvened into Executive Session to continue discussion on litigation.
