The meeting was called to order by Supervisor Burton
at 11.15 P.M.

Upon motion it was voted to dispense with the reading
of the miutes of the meetings not yet approved.
The report of the Receiver of Taxes for the month of
November, 1923, was received, read, ordered place on file and
is as follows:

Pursuant to Section 23 of the Westchester County Tax
Law I hereby respectfully report the amount of the State, County

The following resolution was presented by Justice Boyd
and seconded by Justice Collins:
WHEREAS, $10,000 Hook and Ladder Fire Truck
and Apparatus Bonds for Fire Lighting and
Water Supply District No. 1 of the Town of
Mamaroneck, New York, have heretofore been
duly authorized to be issued and have been
sold and it is desirable to amend the form
of said bonds, Now, Therefore, Be It
RESOLVED, that said Bonds be in substan-
tially the following form, to-wit:

KNOW ALL MEN BY THESE PRESENTS that the Town of Mamar-
oneck a municipal corporation within the County of Westchester,
State of New York, hereby acknowledges its indebtedness and for
value received promises to pay to bearer on the first day of
April, 19___, the sum of One Thousand Dollars ($1,000.00), to-
gether with interest thereon from the date hereof at the rate of
five per centum per annum, payable April 1, 1924 and semi-annually
thereafter on the first days of October and April upon present-
ation and surrender of the annexed interest coupons as the same
respectively mature; both principal and interest being payable in
gold coin of the United States of America of the present standard
weight and fineness or its equivalent in lawful money of the
United States in New York exchange, at the First National Bank,
Mamaroneck, New York.
This bond is one of an issue of bonds aggregating the
sum of $10,000.00 numbered 1 to 10 inclusive, of like date, amount
and tenor, but maturing at different times, issued pursuant to the
Laws of the State of New York, known as Sections 313 and 313-a of
the Town Law for the purpose of paying the cost of an automotive
hook and ladder fire truck and apparatus for the extinguishment of
fires, for use within Fire, Lighting and Water Supply District No.
1 of the Town of Mamaroneck, New York, and pursuant to proceedings
and resolutions in all respects authorizing the same.
It is hereby certified, recited and declared that all
conditions, acts and things essential to the validity of this
bond, exist, have happened and have been done in due time, form
and manner, and that every requirement of law effecting this
bond and the issue of which it forms a part has been duly com-
piled with, and that the total indebtedness of said Town, includ-
ing this issue of bonds, is within ever debt and other limit
prescribed by the Constitution and Laws of the State of New York,
and that the full faith, credit and resources of said Town are
hereby irrevocably pledged to the punctual payment of the interest
and principal of this bond according to its terms.
This bond may be converted into a registered bond in
accordance with provisions of the General Municipal Law. If
this bond be registered the interest hereon at the request of the
registered owner will be remitted by mail in New York exchange.
IN WITNESS WHEREOF, the said Town of Mamaroneck, has
caused this bond to be signed by its Supervisor and sealed with the
corporate seal of said Town, attested by its Clerk, and the int-
erest coupons hereto annexed to be signed with the facsimile sig-
nature of its Supervisor, and this bond to be dated as of the
first day of November, 1923.

due on its Hook and Ladder Fire Truck and Apparatus Bond, dated
November 1, 1923.

FURTHER RESOLVED, that said bonds shall be signed by the
Supervisor of said Town, sealed with the corporate seal of said Town
attested by the Town Clerk and the interest coupons shall be signed
with the fac-simile signature of the said Supervisor.
FURTHER RESOLVED, that all resolutions or parts resolu-
trans inconsistent herewith be and the same are to be extent of such
inconsistency hereby rescinded.
Upon a vote being taken of the foregoing resolution, the
same was unanimously adopted by the following votes:

Supervisor Burton presented a statement prepared by the
County attorney, which shows the amounts which the Larchmont National
Bank and the First National Bank of Mamaroneck are entitled to receive
by way of refund for the 1920 and 1921 bank taxes which is in accord-
ance with the compromise agreement recently entered into with the
Bankers Association. That said agreement provides for a refund to
said bank of 50% of the 1920, 1921 and 1922 bank tax on National Banks,
and the 1920 and 1921 bank tax on State Banks and further authorizing
the County Treasurer of the County of Westchester to refund in whole
or in part as the case may be, the 1922 bank tax paid by National
Banks and mark the same paid as to State Banks where the tax has been
paid and refund such part of it as remains due them after making the
payments required to effect said compromise.
Supervisor Burton also stated that according to said state-
ment the Larchmont National Bank would be entitled to a refund of
$164.25 for 1920 and 1921 bank tax and that the First National Bank of
Larchmont, New York, would be entitled to a refund of $231.45 on
account of the 1920 and 1921 bank tax and recommend the adoption of
a resolution authorizing the payment of said refund to said banks and
directing the County Treasurer to cancel the 1922 taxes which remain
open against them.
Juctice Collins presented the following resolution:
WHEREAS, at a meeting held by members of
the Bankers Association of Westchester Co,
and members of the Board of Supervisors of
said County the claims of the various banks
against the various municipalities within
which they transact business for a refund
of the bank tax of 1920 and 1921 was compro-
mised on the basis of refunding to said
banks 50% of the tax paid by them to the
municipalities levying the same, said bank
tax having been declared by the United
States Supreme Court to be unconstitutional.
NOW, THEREFORE, be it
RESOLVED, that the Supervisor be and hereby
is authorized and directed to make a refund
to the First National Bank of Mamaroneck,
N.Y, and to the Larchmont National Bank for
their 1920 and 1921 bank taxes upon the
basis of said compromise; and be it further
RESOLVED, that the County Treasurer of West-
chester County be and hereby is authorized
and directed to cancel upon has books, the
bank tax levied against the Larchmont Nat-
ional Bank and the First National Bank of
Mamaroneck for the year 1923 wherever the
same appears, or to make a refund of the
same upon the basis of said compromise, if
the same has been paid, And be it further
RESOLVED, that the Clerk be and hereby is
authorized and directed to certify to the
County Treasurer of Westchester County the
action taken by this Board.
Upon a vote being taken upon the foregoing resolution the
same were unanimously adopted.
Mr. H. M. Whitaker, Chairman of the Board of Police Commiss-
ioners of the unincorporated part of said Town, addressed the Board
and stated that the appropriation made for his department for the
year which is about to close has been exhausted and that it needed
the additional sum of $2500.00 to meet the payroll and various
other claims which have been already incurred. He requested the
Board that said sum be allowed and that is be added to the 1924 approv-
priation to be made for his department.
Justice Boyd offered the following resolution:
RESOLVED, that there be levied and assessed
against the taxable property situated, lying
and being within the unincorporated part of
the Town of Mamaroneck, (lying outside the
Villages of Larchmont and Mamaroneck) and
collected, the sum of $2500.00 for the Board
of Police Commissioners of said Town. And
be it further
RESOLVED, that the Supervisor be and hereby
is authorized and empowered to transfer to
the account of the Board of Police Commiss-
ioners of the Town of Mamaroneck out of any
monies which he may have on hand, the said
sum of $2500.00 until such times as he
disposes of the certificate of indebted-
ness hereinafter authorized to be issued;
and be it further
RESOLVED, that the Supervisor be and he here-
by is authorized and empowered to negotiate
and sell upon the faith and credit of the
Town of Mamaroneck a certificate of indebted-
ness in the sum of $2500.00 in anticipation
of the collection of taxes levied and assessed
for that purpose such certificate to be sold
for not less than the par value thereof, to
bear interest at a rate not exceeding 6% per
annum; to mature at such time as the Super-
visor may determine, to be paid from the taxes
which will become due on April 1, 1924
levied for Police purposes. And it is further
RESOLVED, that the Supervisor and Town Clerk
be and they hereby are authorized and em-
powered to execute such instruments and
papers as may be required to carry into
effect the foregoing resolution.
Upon a vote being taken upon the following resolutions
the same were declared to be unanimously adopted.
The Town Clerk reports that a claim has been filed by
the Automatic Registering Machine Company for the sum of $1,904.50
for the two voting machines which he purchased from said Company
pursuant to a resolution adopted by this Board at their meeting
held on Ocotber 1923.
Justice Collins offers for adoption the following reso-
lution:
RESOLVED, that there be levied and assessed
against the taxable property of the Town
of Mamaroneck and collected the sum of
$1,904.50 to pay for two voting machines,
including the cost of cartage, bought of
the Automatic Registering Machine Company
on October 23rd, 1923.
Upon a vote being taken upon the foregoing resolution,
the same upon ROLL CALL was unanimously adopted.
The Supervisor reports that after the proceeds of the
sale of lots Nos. 14, 15, 32 and 33, Block 94, Section 8, for the
non-paymant of taxes, were applied for the payment of the costs
of the foreclosure action, Referee's fees, expenses of sale and
taxes, there remained open and outstanding an item of taxes levied
against said premises in the year 1899 upon which there is due
$44.54. That the amount for which said premises were sold, viz:
$1,000.00m was insufficient to cover said taxes of 1899, and re-
quests the adoption of the following resolution; be it
RESOLVED, that the Receiver of Taxes is
and hereby is authorized and directed to
cancel upon his books wherever the same
may appear the item of taxes levied in
the year 1899 against lots Nos. 14, 15,
32 and 33, Block 94, Section 8, which
premises are also known as Lots Nos. 123,
124, 188 and 189, Map of Waverly Sub-
division Grand Park, it being reported
that the proceeds derived from the sale
of said premises for the non-payment of
taxes in an action entitled Town of Mam-
aroneck, Plaintiff, against Amelia Delano,
el al, Defendants, are insufficient to pay
the same.
Upon a vote being taken the foregoing resolution was unan-
imously adopted.
A communication wax received and read from Harry T. Mc-
Givney, Receiver of Taxes, advising the Board of the appointment
of Santo Lanza as Deputy Receiver of Taxes and asking that the same
be approved by the Town Board.
Upon motion, duly seconded, it was
RESOLVED, that the appointment of Santo
Lanza as Deputy Receiver of Taxes be
and the same is hereby approved, subject
to his qualifying and the securing of
the necessary bond.
Justice Collins moved and Justice Boyd seconded the adopt-
tion of the following resolution:
WHEREAS, The Board of Sewer Commissions
of Sewer District No. 1 of the Town of
Mamaroneck heretofore filled in the office
of the Town Clerk a map and plan of such
District as required by law, and has re-
ported to the Town Board the amount of
cost of construction of Section 4 of the
Sewer System determined as required by law,
the said report of said cost reading as
follows:-

to wit $53,854.53, we herewith respectfully report to you that the
amount of the cost of the construction of Section 4 of the Sewer
System in Sewer District No. 1 of The Town of Mamaroneck, including
engineers' fees and other necessary expenses in connection there-
with, will be approximately $62,000.00
We, therefore, request that you immediatey authorize and
direct the issue and sale of bonds for the amount of $50,000.00,
which is in addition to the $35,000.00 heretofore authorized, and
which, with the money on hand which represents savings effected on
prior contracts, will give us sufficient funds to complete this
contract.

Town of Mamaroneck:-
1. $50,000. Sewer District Bonds of the Town of Mamar-
oneck shall to issued pursuant to the provisions of the Town Law,
constituting Chapter 62 of the Consolidated Laws of the State of
New York, and of Chapter 432 of the Laws of 1922 of the State of
New York. Said bonds shall be dated July 1st, 1923, shall bear
interest at the rate of Four and three-quarters per centum (4-3/4%)
per annum, payable semi-annually on January 1st and July 1st in
each year, and shall be fifty in number, numbered 1 to 50,

able to the Order of the Town of Mamaroneck, for two peroenttma (25)
