MINUTES OF THE REGULAR MEETING
OF THE TOWN BOARD AND BOARD OF
FIRE COMMISSIONERS OF THE TOWN OF
NPIMARONECK, HELD ON THE 20TH DAY
OF DECEMBER 1988 IN THE COURT ROOM
OF THE TOWN CEN'T'ER, 740 WEST BOSTON
POST ROAD, MAMARONECK, NEW YORK
CONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order by
Supervisor Battalia at 7:00 p.m., at which time the Board recessed
into Executive Session.
The Executive Session was held in Conference Roan A and matters of
personnel were discussed, after which time, on motion duly made
and seconded, it was unanimously declared adjourned at 8:00 p.m.
RECONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order by
Supervisor Battalia at 8:15 p.m. in the Court Rogan.
Present were the following members of the Board:

CALL TO ATTENTION
Supervisor Battalia pointed out to those assembled the locations
of exits as required by law for public gatherings.

BOARD OF FIRE COMMISSIONERS
The Meeting was called to order by Commissioner Battalia at 8:15
p.m. in the Court Roam.
Present were the following members of the Commission:

1. Commissioner Silverstone presented fire claims for
authorization of payment and on her motion, seconded by
Commissioner McGarr, it was unanimously
RESOLVED, that this Commission

There being no further business to came before this Commission, on
motion by Commissioner Chapin, seconded by Commissioner Price, the
meeting was unanimously declared adjourned at 8:25 p.m.
At this time the regular order of the Agenda was changed and part
two of item 10 under AFFAIRS OF THE TOWN was taken up.
10. Salary Authorization - Police Department
At this time the Supervisor called upon Police Commissioner
Dallas to give an address to all present. The Commissioner
stated that the Police Department has, over the last four
years, undergone some major reorganization externally as well
as internally and that 77% of the total staff has been

affected by appointment, advancement or promotion. He added that
this evening is one of the most significant events within the
Police Department and that during his career he has had the
pleasure of working with same of the finest men in this
Department. He went on to say that while visual styles have
changed from time to time, there is one common thread necessary to
good management and it is basicallay that a Chief has to
completely and absolutely devote himself to the Departments
organization and welfare since no system of management will
prevail without that devotion. He stated additionally that in
1985 it was his distinct privilege to meet several such people and
tonight he would like to call attention to one of them.
The Commissioner then introduced Paul Munch, mentioning that
management is not an easy task but without a sense of dedication,
it would certainly fail. He gave a brief biography of Paul's 17
year career, noting that he spearheaded the overhaul of the radio
communications system and is coordinating a computer system to
serve in Departmental reports, investigative records, work
schedules, orders and internal communications.
He then requested salary authorization for the Civil Service rank
of Chief of Police to perform duties as designated by the Police
Commissioner and to act as Chief of the Department for the Town of
Mamaroneck. He concluded that Lieutenant Paul Munch has
successfully completed the written examination and is currently
number one on Eligibility List No. 7239 as certified on September
13, 1988.
Supervisor Battalia then asked for a motion and on motion by
Councilwoman Silverstone, seconded by Councilman John McGarr, it
was unanimously
RESOLVED, that this Board hereby
appoints Lieutenant Paul Munch to
the position of Chief of Police
for the Town of Mamaroneck at an
annual salary of $53,000, effective
January 1, 1989.
Supervisor Battalia then swore in Lieutenant Munch, followed by
applause from the audience which included members of the Police
Department and his family.
Commissioner Dallas then gave a brief biography of Officer Paul
Creazzo who was promoted to the Detective Division on December 10,
1988 following three years of service in the Patrol Division, and
introduced Thomas G. Gisin, a new Police Officer appointed in
November.
Supervisor Battalia then swore in Thomas G. Gisin to the position
of Police Officer.
At this time Supervisor Battalia stated that, on behalf of the
Board and herself, she wished to thank each and everyone of you in
the Police Department, since it has been a long five years, they
have been through a lot together and she is pleased and delighted
with the results.

At this time the regular order of the agenda was resumed and Item
#1 under AFFAIRS OF THE TOWN was taken up.
AFFAIRS OF THE TOWN
1. Appointments - Conservation Advisory Commission
- Marriage Officer
Councilwoman Silverstone briefly described the qualification
of Kevin Ryan and upon her recommendation and motion,
seconded by Councilman McGarr, it was unanimously
RESOLVED, that this Board hereby
appoints Kevin Ryan of Beverly
Place, Larchmont Village, to the
Conservation Advisory Commission
to fulfill the remaining tern of
Elinor Fredston which expires on
December 31, 1989.
The appointment of Marriage Officer was held over to the
meeting of January 4, 1989.
2. Adoption of 1989 Budget
On motion by Councilwoman Price, seconded by Councilman
Chapin, the following resolution was adopted on a roll-call
vote of the Board:
WHEREAS, this Town Board has met
on December 7,1988 at the time
and place specified in the Notice
of Public Hearing on the adoption
of a Preliminary Budget for 1989
and has heard all persons desiring
to be heard thereon;
NMI, THEREFORE BE IT
RESOLVED, that this Bord does
hereby adopt such Preliminary
Budget as the Annual Budget of
this Town for the fiscal year
beginning on the first day of
January 1989, and that such
Budget as so adopted be entered
in detail in the minutes of the
proceedings of this Town Board;

and it is further
III RESOLVED, that the Town Clerk of
this Town shall prepare and certify
in duplicate, copies of said Annual
Budget as adopted by this Town
Board, together with the estimates,
if any, adopted pursuant to Section
202-a, subdivision 2 of the Town
Law, and deliver one (1) copy
thereof to the Clerk of the County
Board of Legislators of this County;
and it is further
RESOLVED, that for the fiscal year
1989, the sum hereinafter set forth
in the attached Budget be levied,
assessed, and collected upon the
taxable properties in the Town of
Mamaroneck outside of the Villages
of Larchmont and Mamaroneck (part
Town), the properties of the
several districts and the several
parcels of taxable property,
franchise and assessments, and
III persons within the Town and within
such special districts, be extended
on the tax roll of the Town of
Mamaroneck against each of the
several parcels affected by such
assessments, or parts thereof;
and it is further
RESOLVED, that pursuant to the
provisions of Chapter 654 of the
Laws of 1927 as amended, and the
provisions of Article 12 of Chapter
61 of th Consolidated Laws, known
as the Town Law, as amended, there
be levied against the several lots
and parcels of land contained upon
the Statement hereto annexed and
marked "Exhibit A," the several
sums set forth opposite each such
parcel or lot of land on such
statement as and for unpaid water
charges due upon said lots or
parcels, which said sums shall be

4. Discussion - Community Action Program
The Supervisor explained that the After School Program as
originally proposed by CAP for 1988 was not instituted and
that at that time the Board had authorized an appropriation
of approximately $6,500 which has not been expended. She
explained further that this item can be encumbered, which
would carry this appropriated amount into 1989 of which the
Board unanimously approved.
5. Report of Bids - Fuel Oil

- Police Uniforms
Following explanation by the Administrator, on motion by
Councilwoman Silverstone, seconded by Councilman Chapin, it
was unanimously
RESOLVED, that this Board hereby
authorizes the Town Administrator
to enter into contract with the
following lowest responsible
bidders meeting specifications:
Lawrence Heat & Power for fuel
oil #2 at .5830 per gallon;
Lawrence Heat & Power for diesel
fuel at .5890 per gallon;
M & S Striping for reflectored
street painting at .0550 and
non-reflectored street painting
at .04;
Standard Law for winter and summer
police uniforms at $270.70 per
complete uniform.
6. Discussion - Status of Group Homes
Supervisor Battelle reported that she had received a letter
from CRISP, listing the sites in process along with the
Palmer Avenue site, and she wished to update the Board with
respect to Moran Place and to obtain authorization to sign
the request for information. The Supervisor noted that
Councilwoman Silverstone had received a call from the
Director of DDSO stating that they would comply with the
Building Inspector's safety recommendations. The Supervisor
also went on to say that she later received a call that they
had changed their mind. Supervisor Battalia mentioned that
both the

Mental Health Agency and the Disabilities Agency have taken
the position that they are exempt from all code requirements
which, although incorrect, nonetheless remains their
position, and they are currently fighting legislation about
this. She further mentioned that they have retreated from
their position to comply with the Building Inspector's
requirements with respect to the staircase because it will
cost from $20,000 to $30,000 over the $650,000 they are now
up to, and would create another safety matter. She commented
that they expect to have residents in by January 15th and had
agreed to contact the Site Advisory Committee with respect to
a neighborhood advisory group since she had strongly
suggested that the Advisory Committee could be of great
assistance to them in identifying people and building a
bridge between the community and the facility itself.
The Supervisor then requested Town Counsel to speak with the
Building Inspector and decide what to do with respect to this
issue when they do open since the Board's main concern is to
protect the Town. Town Counsel agreed and commented that he
had previously spoken with the Building Inspector, who had
called the State Building Code Division. He went on to say
that since it is not clear as to whether a violation could be
issued anyway, the Building Inspector will verify that the
condition exists and inform the State Building Code Division
in writing that there is a violation of the building code
but, because the violator is a State agency, we may not have
jurisdiction and are thereby serving notice concerning this
matter.
Councilwoman Silverstone stated that she had passed the site
several times and would be very angry if she lived in that
neighborhood since vehicles are parked all over, including
around the hairpin turn, and construction debris was
scattered everywhere. She called the Building Inspector
suggesting a dumpster be used and they appear to be putting
some material into it but it is every sloppy construction
site. She noted that someone had called about a branch that
had fallen during the storm which no one had bothered to pull
off the street. Councilwoman Silverstone commented that she
felt this site must be watched on a regular basis and
although she is not certain as to whether the Building
Department has any jurisdiction over the way the construction
is being handled, they must be reminded that their
relationship with the neighborhood is important.
Further discussion ensued and Supervisor Battelle made a
recommendation that the inquiry be amended to include the
Larchmont Motel and she would then sign it and send it out,
to which the Board unanimously agreed.
7. Authorization - Westchester County Prisoner Transportation
Agreement
Administrator Altieri reported that the County has increased
the rate of reimbursement from $60.00 per round trip to
$65.00 per round trip for the prisoner transportation

agreement for 1989 and 1990 which reimburses the Town for
transporting prisoners to and frost Valhalla where the County
provides correctional facilities for local governments.
Discussion followed relating to the actual number of
roundtrips for which reimbursement is made and the ambiguous
wording of the contract itself. Thereafter, on motion by
Councilwoman Silverstone, seconded by Councilman Chapin, it
was unanimously
RESOLVED, that this Board hereby
authorizes the Town Administrator
to execute the Westchester County
Prisoner Transportation Agreement
subject to clarification of the
contract.
8. Authorization - Snow Removal Contract Westchester County
Following explanation by the Administrator, on motion by
Councilwoman Silverstone, seconded by Councilwoman Price, it
was unanimously
RESOLVED, that this Board hereby
authorizes the Town Administrator
to enter into agreement with the
State of New York, retroactive to
July 1, 1988 to provide for
reimbursement in the 1988/89 snow
season providing for the Town to
receive a total of $10,000 for
snow removal services.
9. Authorization - Town Comptroller to Close Financial
Records-1988
The Administrator noted that this was a year-end formality
and on motion by Councilman McGarr, seconded by Councilman
Chapin, it was unanimously
RESOLVED, that this Board hereby
authorizes the Town Comptroller to
make appropriate journal entries
and budget transfers for the
purpose of closing the Towns
financial records for the fiscal
year 1988.

10. Salary Authorization - Recreation
As per memo from Superintendent of Recreation, William
Zininer Mann, on motion by Councilwoman Price, seconded by
Councilwoman Silverstone, it was unanimously
RESOLVED, that as provided for in
the 1988 Town Budget, authorization
is hereby granted for payment of
salaries to the following:
Susie Spano, Key Attendant, Hammocks Pool, $3.50/hour,
effective 12/21/88;
Michael Ferro, Referee, Youth Hockey, $9.00/hour,
effective retroactive to 12/12/88;
Allison Keane, Timekeeper, Youth Hockey, $4.00/hour
effective retroactive to 12/10/88;
Charles Berkowitz, Alternate Rink Attendant, Hammocks Park
Ice Rink, $6.00/hour, effective 12/19/88;
Vincent Montesano, Alternate Skate Room Attendant,
Hammocks Park Ice Rink, $7.00/hour effective
retroactive to 12/2/88;
Susan Vanderslice, Alternate Cashier, Homnocks Park Ice
