HomeMy WebLinkAbout1923_12_12 Town Board Minutes Meeting of the Town Board TOWN OF MAMARONECK held, December 12th, 1923. The meeting was called to order by Supervisor Burton at 8.30 P.M. PRESENT: Supervisor Burton, Justices Boyd, Collins, Shafer, Town Clerk Sherman, Upon motion, duly seconded, it was voted that the minutes of the meeting of November 21st, 1923 be approved. The following resolution was presented by Justice Boyd seconded by Justice Collins, which upon ROLL CALL was unanimously adopted: WHEREAS, the supervisor has presented a statement from which it appears that pursuant to authorization of this Board; a. the sum of $1917.49 has been expended for extra work performed and extra material furnished in and about the now Weaver St. Fire House, which said extra work and extra material were not contemplated in the original contract; b, the sum of $6056.72 was necessarily ex- pended pursuant to authorization of this Board in and about the filling and grading of the Weaver Street Fire House grounds; c. the further sum of $1172.20 was necessarily expended for furnishings and articles of furniture supplied to said Weaver Street Fire House; and d. that after applying the proceeds of the sale of the Weaver Street Fire House Bonds towards the payment of the cost of the site, attorneys and engineering fees, general construction, plumbing, heating and electric wiring, there was found to be a deficit of $1100.96 to pay for electric fixtures and for architect fees , now therefore, be it RESOLVED, that the sum of $11048.37 be and hereby is levied and assessed against the taxable property zituated within Fire, Lighting and Water Supply District No. 1 of the Town of Mamaroneck, and collected for the purpose of defraying the additional expense in and about the erection and completion of the Weaver Street Fire House, for filling and grading the Weaver Street Fire House grounds and for the cost of furnishings and various articles of furniture necessarily required by the Weaver Street Fire House and be it further RESOLVED, that this Board borrow on the faith and credit of the Town of Mamaroneck in anticipation of the collection of the tax levied as aforesaid; and be it further RESOLVED, that a certificate of indebted- ness be and the same hereby is directed to be issued in the amount of $11,048.37 to be dated December 12, 1923, which shall become due and payable on June 1, 1924. Said certificate shall bear interest at a rate not exceeding 6% per annum, shall be signed by the Supervisor and attested by the Town Clerk under the corporate seal of said Town, shall be sold by the Supervisor at not less than its par value and shall be in the following form, with the blanks properly filled out: STATE OF NEW YORK COUNTY OF WESTCHESTER TOWN OF MAMARONECK CERTIFICATE OF INDEBTEDNESS No. 4 $11,048.37 KNOW ALL MEN BY THESE PRESENTS, that the Town of Mamar- oneck, a municipal corporation within the County of Westchester, State of New York, acknowledge itself to be indebted and for the value received promises to pay to its successors and assigns, the sum of Eleven Thousand forty-eight and 37/100 ($11,048.37) Dollars, lawful money of the United States of America on June 1, 1924, with interest thereon at the rate of % per annum, This certificate is issued in pursuance of a resolution of the Town Board of said Town duly adopted at a special meeting thereof, held on December 12, 1923, in anticipation of the collect- ion of a certain tax levied against the taxable property situated within Fire, Lighting and Water Supply District No. 1 of said Town, for the purpose of paying for certain extra work and extra material performed and furnished, respectively, in and about the construction and completion of the Weaver Street Fire House, for the cost of filling and grading the Weaver street Fire House ground and for the cost of certain furnishings and articles of furniture supplied to the Weaver Street Fire House. IN WITNESS WHEREOF, the Town Board of the Town of Mamar- oneck has caused this certificate to be signed by its Supervisor and to be countersigned by the Town Clerk, and the corporate seal there- of to be hereunto affixed the 12th day of December, 1923. The following resolution was presented by Justice Collins, seconded by Justice Boyd, which upon ROLL CALL, was unanimously adopted: WHEREAS, the Board of Sewer Commissioners have prepared a statement from which it appears that pending the issuance and sale of certain sewer bonds for Sewer District No. 1 of the Town of Mamaroneck, New York, the issuance and sale of which have been duly authorized by the qualified taxpayers of said district, they require the sum of Forty Thousand ($40,000) Dollars to meet certain payments, now therefore be it RESOLVED, that this Board borrow on the faith and credit of the Town of Mamaroneck, the sum of $40,000.00 in anticipation of the sale of the bonds hereinbefore mentioned; and be it further RESOLVED, that a certificate of indebtedness be and the same hereby is directed to be issued in the amount of $40,000.00 to be dated December 12, 1923, and to become due and pay- able on or before August 1st, 1924, and to be paid out of the proceeds of the salr of said sender bonds hereinbefore mentioned. Said certificate of indebtedness shall bear interest at a rate not exceeding 6% per annum, shall be signed by the Supervisor and attested by the Town Clerk under the corporate seal of said Town, shall be sold by the Supervisor at not less than the pay value thereof and shall be in the following form with the blanks properly filled out: STATE OF NEW YORK COUNTY OF WESCHESTER TOWN OF MAMARONECK No. 3 $40,000.00 KNOW ALL MEN BY THESE PRESENTS, that the Town of Mamar- oneck, a municipal corporation within the County of Westchester, State of New York, acknowledges itself to be indebted and for value received promises to pay to its successors or assigns, the sum of Forty Thousand ($40,000.00) Dollars, lawful money of the United States of America, on or before August 1, 1924, with interest thereon at the rate of % per annum, This certificate is issued, in pursuance of a resolution of the Town Board of said Town duly adopted at a special meeting thereof, held on December 12, 1923, in anticipation of the sale of certain sewer bonds for Sewer District No. 1 of said Town of Mam- aroneck and shall be paid from the proceeds of the salr of the aforesaid bonds. IN WITNESS WHEREOF, the Town Board of the Town of Mamar- oneck has caused this certificate to be signed by its Supervisor and to be countersigned by the Town Clerk, and the corporate seal thereof to be hereunto affixed the 12th day of December, 1923. A communication from the Board of Assessors was received and read stating that the said Board, had organized for the term commencing January 1st, 1924, by selecting Ferdinand Fish and William E. Mulcahy, Chairman and Secretary respectively, of the Board of Assessors. Upon motion duly seconded, it was VOTED, that the action of the Board of Assessors in appointing Ferdinand Fish Chairman and William F. Mulcahy, Secret- ary of the Board of Assessors for the term commencing January 1st, 1924, be and the same is hereby approved. A communication from the Weaver Street Fire Company was received and read requesting the appointent of John F. Ullrich as Engineer to operate the raw hook and ladder fire apparatus. It was voted to lay the matter over until a future meeting. A communication and requisition of the Weaver Street Fire Company was received and read, requesting the purchase of supplies and equipment for the year 1924. The matter was laid over. A communciation and report of an accident at the rear door of the Weaver Street Fire House was received and read and the same was ordered noted in the minutes and placed on file. A communication from Domenic DiPetro & Company was re- ceived and read, requesting permission to erect a sign on the Town Cemetery for business advertising. It was voted that the commun- ication be placed on file and the application be denied. The following communication was received, from the Board of Appeals, which was ordered filed and spread upon the minutes. December 7, 1923. Mr. F. M. Sherman, Town Clerk, 6 Elm Street, Mamaroneck, N.Y. Dear Mr. Sherman: The following resolution, was adopted by the Board of Appeals at its meeting held last night: RESOLVED, that the Board of Appeals recommend to the Town Board that the appeal of Michael Doherty to erect a one family residence on the east side of Premium River Road, three hundred feet south of Edgewater Place, within thirty feet of the street line be granted and the decision of the Building Commission be reversed. Whereupon the following resolution was offered by Justice Shafer, seconded by Justice Collins, which was unanimously adopted: WHEREAS, the Board of Appeals of the Zoning Commission have acted upon and have reco- mmended to the Town Board that the appeal of Michael Doherty to erect a one-family resi- dence on the east side of Premium River Road, 300 feet south of Edgewater Place, within thirty feet of the street lane be granted and the decision of the Building Commission be re- versed, therefore be it RESOLVED, that the Town Board pursuant to Article 5, Section 23 of the Town Law, hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission.
