HomeMy WebLinkAbout1990_10_17 Town Board Regular Minutes 396 MINUTES OF THE REGULAR NEETING OF THE TOWN BOARD AND BOARD OF FIRE C14MISSIONERS OF THE TOWN OF MMMWMXZ, HELD ON THE 17TH DAY OF OCTOBER 1990 IN THE COURT ROOM OF THE TOWN CEDER, 740 WEST BOSTON POST ROAD, NNECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 7:00 p.m., at which time the Board recessed into Executive Session. The Executive Session held in Conference Roans A to discuss personnel was, on motion duly made and seconded, unanimously declared adjourned at 8:18 p.m. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 8:25 p.m. Present were the following members of the Board: Supervisor Caroline Silverstone Councilman Stephen Chapin Councilwoman Elaine Price Councimmn John. McGarr Councilwoman Kathleen Tracy O'Flinn Also present were: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Steven M. Silverberg, Town Counsel Paulette Gabbriellini, Assistant to the Town Administrator CALL TO ATTENTION Supervisor Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. At this time the order of the Agenda was changed and the Supervisor called upon Commissioner Dallas. The Commissioner requested salary authorization for promotion of Patrolman John Fox front the rank of Police Officer to the civil service rank of Probationary Police Sargeant at an annual salary of $47,000, effective October 23, 1990. He noted that Officer Fox was selected front the top three names on the Westchester County eligibility list, and also updated the Board on his accomplishments. 397 October 17, 1990 After being sworn in by the Supervisor, Officer Fox introduced his family and all were congratulated by Supervisor Silverstone and the Board members, as well as Commissioner Dallas. At this time the regular order of the agenda was resumed and the item BOARD OF FIRE OOIMSSIONER.S was taken up. BOARD OF FIRE COMMISSIONIER.S The Meeting was called to order by Commissioner Silverstone at 8:28 p.m. in the Court Ran. Present were the following members of the Commission Commissioner Caroline Silverstone Commissioner Stephen Chapin Commissioner Elaine Price Commissioner John McGarr Commissioner Kathleen Tracy O'Flinn Commissioner McGarr presented fire claims for authorization of payment and upon his motion, seconded by Commissioner Oirlinn, it was unanimously RESOLVED, that this commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller,s Office: Larchmont Auto Parts $ 21.60 Larchmont Auto Parts 17.90 Lt. Appointment - Hunan Rights Commission On recommendation and motion of Councilwoman Price, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board hereby appoints Fred Baron of Murray Avenue, Town, to the Commission of Human Rights for a period of three years, terminating October 1993. 2. Letter - Joseph Messina Mr. Messina spoke about a recently installed basketball pole and hoop on the perimeter of his property facing Lakewood Lane, noting that he had been informed that it was installed on the Towns right-of-way. He presented the Board with a petition from. all the neighbors who fully support this addition, and also with photos of its appearance. A discussion ensued concerning various aspects and implications of-poles and hoops generally located around Town, as well as that on Mr. Messina's property. The final decision of the Board was to allow his pole and hoop to remain until a definite solution with regard to basketball hoops is worked out. The Supervisor appointed Councilwoman O,Flinn and Councilman McGarr to study this problem. 3. Update - Premium Marsh Dredging The Administrator announced that since it is getting near the time to advertise for bids, he felt it was time to update the Board on the status of the Premium Marsh project. He reported that Malcolm Pirnie has prepared permit applications and is finalizing bid documents for dredging. He stated that soil samples analyzed and reviewed by the EPA and Army Corps of Engineers found the material suitable for disposal in the western and central sites of Long Island Sound. He went on to say that the permit application is now before the DEC, and that they will inform the Town by October 26th as to whether it is complete, in which case bid application will then begin. He concluded by noting that an informational meeting for residents within that area will be scheduled for November 13th. A brief discussion ensued among the Board and some residents, with Mr. Altieri fielding questions. 4. Update - Red Bridge Restoration The Administrator explained that the City of New Rochelle was to assume responsibility for preparing all bid documents and overseeing construction and, due to other projects going on in New Rochelle, they had informed him that the Red Bridge project will be put off until spring 1991. He mentioned that this is probably to the Towns advantage in view of the upcoming Premium River dredging project. 3 October 17, 1990 399 5. Update - Tax Collection Proceedings Town Attorney, Steve Silverberg, reported that since August he has been successful in having overdue back taxes reduced by $98,000, down from $458,000 to $360,000. Additionally, he stated, they have received over $30,000 on taxes not a year late but still in arrears, and promises from people for payments within the next few months of $56,000. He noted that 26 people who basically ignored making payment and will receive one last letter to make arrangements to pay, before the Town Constable is sent to serve summonses. He mentioned that they are trying to work with people who have problems and are granting them time to make payments, some are estates and houses being sold with the intention of settling tax payments upon closings. 6. Authorization - Retainer Agreement-Certiorari Consultant Following explanation by the Administrator, on motion by Councilman McGarr, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby authorizes the Administrator to extend the existing agreement with Mr. George Derderian to provide appraisal and consulting services through December 31, 1990 in the amount of $4,160. 7. Discussion Permit Parking - Lots #1 and #2 The Town Clerk reported that Lot #1 is complete and there are now a total of 230 permit spaces, 5 more than previously existed, and the cost is $175.00. She went on to say that a quarterly permit is $55.00 and that 241 permits have been sold, with a waiting list of 36, and she recommended overselling this lot by 20%. The Clerk also requested that the Board pass a resolution creating three different types of parking in the meter area, with 6 late-morning parking spaces created along the back of the lot for those who arrive after 9:30 a.m., leaving 66 meter spaces to be split into 36 non-resident and 30 resident. She noted that the non-resident permit would cost $100.00 per year plus $1.50 per day for the meter and the resident permit would be $10.00 per year with a $1.50 per day for the meter, the $10.00 covering administrative costs. Discussion followed, after which, on motion by Councilman Chapin, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes the Town Clerk to implement the changes which she has devised for Parking Lot #1. The Clerk then recommended that the Town change 15 spaces in Lot #2 which are.presently resident parking, to non-resident permit daytime parking at a cost of $275.00 per year (mostly New Rochelle residents) which is well below the $535.00 that New Rochelle currently charges for their resident permits. Following discussion, it was decided to have the Traffic Committee review this situation. 4 October 17, 1990 400 8. Amend Budget Calendar The Administrator suggested that both the budget and Affordable Housing Task Force work be done at a meeting together and, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby proposes an amendment to the 1990 Budget Calendar, whereby submission of the Tentative Budget is deferred to Tuesday, October 30, 1990. 9. Authorization - Transfer of Funds-Roads Resurfacing The Administrator explained, and on motion by Councilman Chapin, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby authorizes transfer of $145,000 from the Highway Fund to the Capital Projects Fund for Project #90-11 Resurfacing of Roads-1990. 10. Authorization to Accept Bids - Police Winter and Summer Uniforms - Street Painting - Fuel Oil #2 - Cleaning of Police Uniforms Following a brief explanation by the Administrator, on motion by Councilwoman O'Flinn, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to prepare specifications and accept bids on the followin items for the year 1991: Police winter and summer uniforms Street painting Fuel oil #2 Cleaning of police uniforms 11. Salary Authorizations - Highway - Recreation - Police Department On motion by Councilwoman Price, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board hereby authorizes an annual salary in the amount of $18,500 to Giovanni Bianco of Mamaroneck for the position of Laborer in the Highway Department, effective 10/29/90. 5 401 October 17, 1990 On motion by Councilwoman Price, seconded by Councilman Chapin, it was unanimously RESOLVED, that as provided for in the 1990 Town Budget, authority is hereby granted--for payment of salary to the following: Margaret O'Neill , Cashier, Hommocks Park Ice Rink, $10/hour, effective retroactive to 10/5/90. Proposal - Board of Architectural Review Town Counsel mentioned that he had been asked by the Board to draft a proposal for a Board of Architectural Review and suggested that a Public Hearing date be set. On motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby sets November 7, 1990 as the date for a Public Hearing on a proposed Board of Architectural Review; and be it further RESOLVED, that the Town Clerk be, and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. APPROVAL OF MINUTES The minutes of the regular meetings of September 18, 1990 and October 3, 1990 were approved as corrected. WRITTEN COMMUNICATIONS ORAL COMMUNICATIONS Councilwoman Price suggested that letters be written to both Gail Shaffer, Secretary of State, and the New York Times Editorial Board about the inappropriateness of the Times, editorial comment in yesterday's New York Times with regard to Davids Island. Councilman McGarr and Councilwoman Price mentioned that they will work with the Village of Larchmont on a written agreement on the Reservoir. TOWN CLERK The Clerk presented the Building & Plumbing Report for September 1990. 7 403 October 17, 1990 AWOURIWENP There being no further business to come before the Board, the Supervisor declared the following proclamation for United Nations Week in the Town of Mamaroneck, and on motion by Councilwoman Price, seconded by Councilman McGarr, the meeting was unanimously declared adjourned in honor of United Nations Week. PROC-L-AMAT ION WHEREAS, This year all Americans are asked to renew their support for and dedication towards the United Nations system and the important work it has accomplished for the past 45 years; and WHEREAS, It is apparent to everyone that the firm and united response of nations throughout the world to the Traqi-_ invasion of Kuwait, led prompt and decisive actions by the United States, and would not have been possible without the United Nations as a recognized international conscience of the world; and WBEREAS, On the 45t12 anniversary of the United Nations' founding, Americans of all ages and backgrounds join together throughout the nation on United Nations Day to demonstrate to the rest of the world that the United States continues to support the work of the U.N. through constructive and cooperative action on myriad world problems and concerns. NCW, THEREFORE, BE IT RESOLVED, that I, Caroline Silverstone, Supervisor of the Town of Mamaroneck, New York, do hereby proclaim that October 21 through October 27 be observed as UNITED NATIONS WEEK In the Town of Mamaroneck and urge all citizens to participate in programs and activities designed to foster an understanding of the potential of the United Nations towards promoting world peace and well being.
