Town of Mamaroneck
held Nov. 21st, 1923
The meeting was called to order by Supervisor Burton at
10.00 P.M.
PRESENT: Supervisor Burton,
Justices Boyd, Dudley and Shafer,
Town Clerk Sherman,
Counsellor Gamble.
The minutes of the meetings of Sept. 13th, 17th, 19th,
24th, 25th, Oct. 1st, 3rd, 17th, Nov. 8th, 9th, were upon motion
approved.
A communication from the Childs' Welfare Association was
received and read petitioning the Board for increase in the month-
ly allowance to the Childs' Welfare Association, requesting to fix
the said monthly appropriation to $75.00. Mrs. Thomas and Mrs.
Stevens of the Association were present and appeared before the
Board and spoke of some of the work being done by the Childs'
Welfare Association.
Upon motion by Justice Boyd, seconded by Clerk Sherman,
it was
RFSOUTD, that it is the sense of this Sward
that the request for increase of funds of
the Child Welfare Association from $50.00 to
$75.00 per month be granted, same to take
effect as of Jan. 1st, 1924, and that Counsel-
lor Gamble be directed to prepare the proper
resolution for the next meeting of the
Health Board.
The reports of the Receiver of Taxes for the months of
September and October were received, read, ordered placed on file
and is as follows:

The report of the Police Department for the months of Septem-
ber and October were received and read, showing for the month of
September, 48 arrests and fines collected amounting to $625.00 and
for the month of October, 70 arrests and fines amounting to $1,370.00.
The reports were ordered received, noted in the minutes and placed on
file.

A communication from the Board of Appeals was received and
read, requesting the adoption of an ordinance by the Town Board
amending Section 26 of the Building Ordinance so as to indicate the
specific time rewired for the publication and posting of notices.
The matter was referred to Counsellor Gamble to draft the amendments
necessary.
The following communication was also received from the
Board of Appeals, which was ordered filed and spread upon the minutes:

Mamaroneck, New York.
At a meeting of the Board of Appeals held last Thursday nights
October 25, at its offices, 8 Elm Street, Mamaroneck, the following
resolutions were adopted:
Resolved, That the Board of Appeals recommend to the
Town Board that the appeal of Robert Gibson to erect
a one-family residence an the south aide of Forest Ave.
near Murray Ave. within thirty feet of the street line
and six feet of the side line be granted, and the de-
cision of the Building Commission be reversed, upon con-
dition that no part of the building shall come nearer
than twenty feet to the southerly side of Forest Ave.,
or nearer than two feet to the easterly line of the lot.
Resolved, That the appeal of Michael Doherty to erect a
one-family residence on the south side of Premium River
Road, two hundred feet south of Edgewater Place, within
thirty feet of the street line be adjourned to Nov. 15.
Resolved, That the Board of Appeals recommend to the
Town Board that the appeal of Luigi Sganga to erect a.
one-family residence on the nest side of Murray Avenue,
within thirty feet of the street line be granted, and
the decision of the Building Commission be reversed,
provided that no part of the dwelling or stoops or
steps thereof be nearer than twenty-two feet to the
street line.
Resolved, That the Board of Appeals recommend to the
Town Board that the appeal of H. R. Mitchell to
erect a one-family residence on the west side of
Rockingstone Ave, one hundred and twenty-five
feet south of Forest Ave., within thirty feet of
the street line be granted, and the decision of
the Building Commission be reversed, provided
that no part of the building shall be nearer than
eighteen feet to the street lime.
Resolved, That the Board of Appeals recommend to the Town
Board that the appeal of Michael Doherty to erect a one-family resi-
dence on the east side of Premium River Road, two hundred and fifty
feet south of Edgewater Place within thirty feet of the street line
be granted, and the decision of the Building Commission be reversed.
Resolved, That the Board of Appeals recommend to the Town
Board that the appeal of Mrs. Bernetta Bowman to erect a two-story
residence on the north side of Hillcrest Avenue, three hundred and
fifty feet east of Judson Street within thirty feet of the street
line be granted, and the decision of the Building Commission be re-
versed, provided that no part of the building or any portion thereof
shall set closer to the street line than sixteen feet, and in no
case shall the porch be within eighteen feet six inches of the
street line.
Resolved, That the Board of Appeals recommend to the Town
Board that the appeal of George L. Synett to erect a one-family
residence on the east side of Edgewater Place, Dillon Park, seventy-
five feet north from Premium River Road, within thirty feet of the
street line be granted, and the decision of the Building Commission
be reversed, provided that no part of the building or portion there-
of shall set closer to the street line than elven feet three inches,
Appeals #28 and #30 and the resolutions in relation thereto
were amended respectively to read as follows:
Resolved, That the Board of Appeals recommend to the Town
Board that the appeal of the New Rochelle Realty Company to erect a
one-family residence on the south side of Edgewood Avenue, east from
Edgewood Terrace, within thirty feet of the street line be granted,
and the decision of the Building Commission be reversed.
Resolved, That the Board of Appeals recommend to the Town
Board that the appeal of the New Rochelle Realty Company to erect a
one-family residence on the east side of Chatsworth Avenue, south
from Edgewood Avenue, within thirty feet of the street line be granted,
and the decision of the Building; Commission be reversed.

Whereupon the following resolutions were offered by Justice
Dudley, seconded by Justice Boyd, which were unanimously adopted:
WHEREAS, the Board of Appeals of the Zoning Com-
mission have acted upon and have recommended to
the Town Board that the appeal of Robert Gibson
to erect a one-family residence on the south side
of Forest Avenue near Murray Avenue, within 30
feet of the street lane and 6 feet of the side
line be granted, and the decision of the Building
Commission be reversed, upon condition that no
part of the building shall come nearer than 20
feet to the southerly side of Forest Ave. or
nearer than 2 feet to the easterly line of the lot,
therefore be it
RESOLVED, that the Town Board pursuant to Article
5, Section 26 of the Town Law, hereby consents
to and confirms the action of the Board of Appeals in
section with the easterly boundary line
of the Village of Larchmont easterly to
its point of intersection with the West-
erly boundary line of the Village of
Mamaroneck, be and hereby are eliminated
and removed from the A to A-2 Residence
Districts and C Business Districts in
which said districts are now severally
zoned and are hereby rezoned as F Un-
classified Districts.
And be it
FURTHER RESOLVED, that Nos. 6,8 and 11
of the Rules and Regulations of the
Board of Appeals under the aforesaid
Zoning Ordinance be repealed and that
said Rules and Regulations be renumbered
accordingly.
And be it
FURTHER RESOLVED, that this Ordinance
shall take effect immediately.
And: be it
FURTHER RESOLVED, that the Town Clerk be
and he hereby is authorized and directed
to publish these resolutions in The Larch-
mont Times, a newspaper published in the
said Town, and to post the same in at
least three public places in said Town,
all in the manner provided in Chapter 322
of the laws of 1922 and amendments thereto,
and the cost of publication on and posting is.
hereby made a proper Town charge.
Captain Birch of the Weaver Street Fire Company
appeared before the Board and requested the changing of the
order of the blowing of the fire whistle heretofore adopted
by the Town Board. Upon the recommendation of Justice
Shafer, it was voted to lay the matter over to a special
meeting to be held on January 29, 1925.
Mr. Gagliardi on behalf of the Park Commission
presented the following resolutions, which were offered by
Justice Shafer and seconded by Justice Boyd:
WHEREAS, on January 6, 1925, at a
meeting held and convened by this Town
Board, an order, in due form, was duly
made by this Board pursuant to the
provisions of Chapter 574 of the Laws
of 1924, creating and establishing
Town Park District No. 1 of the Town
of Vamaronecic' New York, by including
therein the real property and premises
in said order described; and
WHEREAS, on January 7, 1925, William
F. Edwards, Alfred H. Stevens and
Fenimore C. Goode, resident owners of
real property in said Park District
were duly appointed Park Commissioners
of said Park District, by George W.
Burton, Supervisor of said Town of
Mamaroneck, which appointment has been
duly approved by this Board; and

TOWN PARK DISTRICT NO. 1 BONDS OF
THE TOWN OF MAMARONECK, NEW YORK.
KNOW ALL MEN BY THESE PRESENTS, that the Town of
Mamaroneck, munipal corporation in the Countv of West-
chester, State of New York, hereby acknowledges its indebted-
ness and for value received promises to pay to bearer on the
1st day of February, 19 , the sum of One Thousand ($1, 000)
Dollars, together with interest thereon from the N date hereof
at the rate of 42 per certum per annum, payable semi-annually
on the 1st day of August and February in each year upon
presentation and surrender of the annexed interest coupons
as the same respectively mature; both principal and interest
being payable in alwful money of the United States of America,
in New York Exchange, at the Trust Company of Larchmont,
Larchmont, New York.
This bond is one of an issue of bonds of like
date, tenor and denomination except as to date of maturity,
aggregating the sum of One Hundred Forty Eight Thousand
($148,000.00) Dollars, and is issued pursuant to and in strict
compliance with the Constitution and statutes of the State of
New York, including Chapter 574 of the Laws of the State of
New York of 1924, and pursuant to proceedings of the Town
Board of said Town duly had and taken in all respects author-
izing and the same, for the purpose of acquiring, developing and
improving certain lands and premises for park purposes in the
Said Town of Mamaroneck, New York.
This bond may be converted into a registered bond
in accordance with the provisions of the general municipal law.
If this bond be registered the interest hereon at the request
of the registered owner will be remitted by mail in New York
Exchange.
It is hereby certified, recited and declared that
all acts, conditions and things required to exist, to happen
and to be performed precedent to and in the issuance of this
bond, exist, have, happened and have been performed in due
time, form and manner as required by law and that the issue
of bonds of which this is one, together with all other in-
debtedness of said Town, is within every debt and other limit
precribed by the Constitution and Laws of the State aid of New
York. The full faith, credit and resources of said Town are
hereby irrevocably pledged to the punctual payment of the
principal and interest of this bond according to its terms.
IN WITNESS WHEREOF, the said Town of Mamaroneck
has caused this bond to be signed by its Supervisor and
sealed with its corporate seal, attested by its Town Clerk
and the interest coupons hereto annexed to be signed with
the fac-simile signature of its Supervisor, and this bond
to be dated as of the first day of February, 1925.

Upon the written request of the owner of the
within bond for its conversion into a registered bond, I
have this day cut off and destroyed coupons annexed to
this bond amounting in the aggregate to $ and
the interest on this bond at the rate and on the dates as
was provided by the coupons as well as the principal there-
of, will hereafter be paid to legal
representatives, successors or assigns at the place of
payment specified therein, or at the request of the re-
gistered owner, the interest will be remitted by mail in
New York Exchange. This bond hereafter will be transfer-
able on the books of the Town Clerk of the Town of Mamaro-
neck, New York, only on presentation of the same to the
said Town Clerk with a written assignment duly acknowledged
or proved.

signed by the Supervisor of said Town, sealed with the cor-

simile signature of said Supervisor and that both principal
and interest shall be payable in lawful money of the United
States of America in the New York Exchange, at the Trust
Company of Larchmont, Larchmont, New York.
And it is further
THEREFORE, BE IT RESOLVED, that the petition
of the New York Telephone Company be denied.
