HomeMy WebLinkAbout1990_04_18 Town Board Regular Minutes 279 MINUTES OF THE REGULAR NEUrI� OF THE TOWN BOARD AMID BOARD OF FIRE COM4IISSIONERS OF THE 'DOWN OF MNMRONECK, HELD ON THE 18TH DAY OF APRIL 1990 IN THE COURT ROOM OF THE TOWN CENTER, 740 WEST BOSTON POST ROAD, MMOX4rECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 7:00 p.m., at which time the Board recessed into a Work Session. The Work Session held in Conference Roan A to discuss the Zoning Code was, on motion duly made and seconded, unanimously declared adjourned at 8:15 p.m. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone ,at 8:20 p.m. Present were the following members of the Board: Supervisor Caroline Silverstone Councilman Stephen Chapin Councilwoman Elaine Price Councilman John McGarr Councilwoman Kathleen Tracy O'Flinn Also present were: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Paulette Gabbriellini, Assistant to the Town Administrator Steven V. Silverberg, Counsel to the Town William McDermott, Fire Chief CALL TO ATTENTION Supervisor Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. April 18, 1990 29 PUBLIC Hk?. - Bonding Resolution-Sanitation District Purchase of Refuse Packer The Supervisor, asked for a motion to open the Public Hearing and, on motion by Councilwoman Price, seconded by Councilman Chapin, it was unanimously RESOLVED, that the Public Hearing be, and it hereby is declared open. The Town Clerk presented for the record the Affidavits of Publication and Posting of the Notice of Hearing. The Town A&dnistrator explained that the purpose of this Public Hearing was to consider borrowing of funds for the purchase of one 20-yard refuse collection vehicle. He noted that because the town's sanitation expenditures come under the sanitation district, it is necessary to hold a public hearing. He noted also that this purchase is in accordance with the Tornm,s five-year capital Improvement Plan. The Supervisor asked the Board for comments. She then asked if anyone wished to sp ak either in favor of or in opposition to the Bond Resolution. There being no response, the Supervisor asked for a motion to close, and on motion by Councilman McGarr, seconded by Councilwoman Price, the Public Hearing Was unanimously declared closed. Th'ereafte'r, on motion by Councilman McGarr, seconded by Councilwoman O%Flinn, the following resolution was unanimously adopted: t1kREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York, has duly caused to be prepared a plan and report relating to the increase and improvement of Refuse and Garbage District No. 1 within said Town consisting of the purchase of a 1990 refuse packer truck: and WHEREAS, all conditions precedent to the financing of such capital project, including compliance with the provisions of the State Environmental Quality Review Act, have been performed: and WHEREAS, a Public Hearing was held at the Regular Meeting of the Town Board of the Town of Mamaroneck, Westchester County, New,York on the 4th day of April 1990, at 8:20 p.m.; NOW, THEREFFORE BE IT RESOLVED, that this Board hereby adopts a bond resolution authorizing the purchase of a 1990 refuse packer truck, at a maxin un estimated cost of $40,000, to which will be applied $40,000 available monies of said District. 2 April 18, 1990 281 The question of adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Kathleen Tracy 01Flinn VOTING We John McGarr —VOTIM We Elaine Price VOTING We Stephen Chapin VOTING aye Caroline Silverstone VOTING aye The resolution was thereupon declared duly adopted. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Silverstone at 8:30 p.m. in the Court Room. Present were the following members of the Commission: commissioner Caroline Silverstone Commissioner Stephen Chapin Commissioner Elaine Price commissioner John McGarr Commissioner Kathleen Tracy 01Flinn 1. Commissioner Price presented fire claims for authorization of payment and on her motion, seconded by commissioner McGarr, it was unanimously RESOLVED, that this commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptrollerfs Office: ESCO $ 25.00 Home Fair 7.98 Lawrence Heat & Power Corp. 992.98 Ralph's Electric 310.00 Rickert Lock & Safe Co. 8.40 Town of Mamaroneck Professional Fire Fighters Association 110.04 Westchester Rockland Newspaper, Inc.' 55.30 Westchester Rockland Newspaper, Inc. 158.24 $1,667.94 2. Councilwoman Price informed everyone of the passing of volunteer firefighter, Gus Funck, noting that funeral services would be held at 10:00 a.m. tomorrow at Larchmont Avenue Church. She went on to say that she wished this opportunity to comment briefly on controversy that has surrounded the professional firefighters and volunteers. She stated that the volunteers are our fighting force, and as much as the Town depends on the paid staff to drive the trucks and to man the fire house, it is our volunteers that go out and fight the fires. She added that it is not a question of being primary or secondary. She emphasized again that they go out and fight the fires, that they are our fighting unit, and that she would like to note for the record the enormous amount of time and training they go through, as well as all the courses they must take. She concluded that she, as liaison, intends to draft a letter in terms of appreciation of what they do and a recognition of how they do it, and send it to the paper. 3 April 18, 1990 282 There being no other business to cone before this Commission, on motion by Commissioner O'Flinn, seconded by Commissioner Chapin, the meeting was unanimously declared adjourned at 8:45 p.m. APPROVAL OF N3 N= The minutes of the Special Meeting of March 14, were approved as corrected. The minutes of the Regular Meeting of March 21, 1990 were approved as amended. ANUS OF THE TOWN 1. 1989 Financial Report The Town Administrator reminded the Board that they have received a financial summary of the operating funds of the Town as well as a summary of expenditures and revenues for the fiscal year ending December 31, 1989. He went on to say that for fiscal 1989 the Town's total expenditures of $13,052,777 had two significant items, $431,790 for the purchase of tax liens and $394,100 for projects under the Town's five-year capital improvement plan, which did not impact on the tax levy and, if deducted, leave total expenditures of $12,226,887. He explained that this total figure is only 2% above the amount budgeted for 1989, indicating that the Town's budget process is thorough and estimate quite accurate. The Administrator stated that the other major part of the report has to do with revenues and he went on to field questions pertaining to such. He emphasized that although in most instances actual revenues exceeded estimates, categories of mortgage tax, interest Parings and state aid are extremely volatile. He noted that 1991 may be a year in which we may see a decrease in State Revenue Sharing, which could mean a loss of about $500,000. He mentioned that talk right now has concerned either decrease or elimination, but as yet no decision by the State Legislature has been made. Mr. Altieri pointed out that the last portion of the summary deals with the analysis of each of the operating funds, noting that each closed out the year with a surplus, which is quite positive but, he emphasized, one must deduct from the reserve balance numbers shown the application that is made into the 1990 budget, so that those are the balances as of December 31, 1989. In conclusion, Mr. Altieri stated that there should always be suitable reserve balances since they are invaluable for unexpected expenses. He remarked that Moodys and Standard & Poors view reserve balances as a positive indication that the Town of Mamaroneck does plan for the unexpected and does not enter into the bond market arbitrarily. Councilwoman Price questionned the Administrator on whether he thought these reserve balances were responsible for the Double A + 1 rating. He responded that it was one of many factors 4 April 18, 1990 283 that led Moodys to be very comfortable with the Towns financial condition and increase its bond rating, noting that they looked at our reserve funds, our assessments, our general accounting and purchasing procedures, and they look at the frequency with which we go into the bond market for money, and the demographics of the Town. Councilwoman Price then asked Mr. Altieri what having the Tawas s bond rating increased means in teams of savings to the taxpayers. His response was that generally when there is an increase in your bond rating, you are able to borrow money at a reduced rate so, obviously, any and all of our debt service is at an interest rate lower than in prior years when we had a lesser rating. The Supervisor stated that on behalf of the Board, she wished to commend the Administrator for producing this very extensive end-of-year financial report, which keeps the Board well informed and indicates that all is running smoothly. 2. Item No. 2 was removed from the Agenda. 3. Authorization -, Transfer of Funds - Project 186-5 on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes a transfer of funds in the amount of $12,000 for Project #86-5 for computerization of the Building Department. 4. Authorization - Close Out Federal Revenue Sharing Checking Account Following explanation by the Supervisor, some discussion ensued as to how best put to use the final outstanding balance of $514.12 remaining in this account since it is unlikely that the Town will again receive federal revenue sharing as in past years. Finally, on motion by Councilman McGarr, seconded by Councilwoman Price, with Councilman Chapin voting nay, it was RESOLVED, that this Board, by the power vested in it, hereby authorizes the close out of the Federal Revenue Sharing Fund checking account and designates the outstanding balance of $514.12 to be used toward the Monroe Day Camp program- 5 April 18, 1990 284 5. Salary Authorizations - Comptroller's Office - Recreation The Administrator reported that Peggy Nero has passed the Senior Account Clerks exam and that in view of the nature and increased responsibilities of her position and her exhibition of a good working knowledge of the computer, it is recommended that she be promoted to this position. On motion by Councilman Chapin, seconded by Councilwoman OIFlinn, it was unanimously RESOLVED, that this Board hereby authorizes the promotion of Peggy Nero to Senior Account Clerk at a salary of $27,575 annually, effective retroactive to April 1, 1990. On motion by Councilman McGarr, seconded by Councilman Chapin, it was unanimously RESOLVED, that as provided for in the 1990 Town Budget, authorization is hereby granted for payment of salary to Raymond Yank, Swim Team Coach (extended season) , $30.00 per hour, effective retroactive to March 21, 1990. 6. Request - Use of Voting Machines-School District Pursuant to memo by the Town Clerk, on motion by Councilman Chapin, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby approves the use of 15 voting machines by the School District for the annual election and budget vote to be held on Wednesday, May 23. 7. Report of Bids - Refuse Packer Truck - Dump Truck The Town Administrator updated and reported on the bid openings, after which time, on motion by Councilman Chapin, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to execute Contract TA-90-3 with Gabrielli Mack Sales & Service, Inc. of the Bronx, New York, as the lowest responsible bidder meeting specifications to furnish and deliver one 35,000 Gross Vehicle Weight Four Wheel Drive Truck. 6 April 18, 1990 285 On motion by Councilwoman O'Flinn, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to execute Contract TA--90-4 with Gabrielli Mack Sales & Service, Inc. of.the Bronx, New York, as the lowest responsible bidder meeting specifications to furnish and deliver one 20-Yard Refuse Packer. THE SUPERVISOR The Administrator gave a brief update on the "Spring Fling Carnival" that had taken place at Hcambocks School, noting that the revenue from this totaled $7,000.00. Some discussion ensued. She noted that she has sent all this information to the Commissioner of the DEC and to Mr. O'Rourke and the County Board. Councilwoman O,Flinn reminded everyone about Beautification Day on April 21st. Councilman McGarr briefly commented on the extension of the Larchmont Library.
