CONVENE REGULAR MELTING
The Regular Meeting of the Town Board was called to order by
Supervisor Silverstone at 7:00 p.m., at which time the Board
recessed into Executive Session.
The Executive Session was held in Conference Room A to discuss
matters of litigation and personnel, after which, on motion duly
made and seconded, it was unanimously declared adjourned at 8:20
p.m.
RECONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order by
Supervisor Silverstone at 8:25 p.m. in the Court Room.
Present were the following members of the Board:

Supervisor Silverstone pointed out to those assembled the locations
of exits as required by law for public gatherings.

BOARD OF FIRE cOMMISSIONERS
The Meeting was called to order by commissioner Silverstone at 8:28
p.m. in the Court Room.
Present were the following members of the Commission:

1. Commissioner Chapin presented fire claims for authorization of
payment and on his motion, seconded by Commissioner McGarr, it
was unanimously
RESOLVED, that this commission
hereby authorizes payment of the
following Fire Department claims
as approved by the Fire Chief and
audited by the Comptroller's Office:

2. Authorization to Accept Bids - Fire Hose
On motion by Commissioner Chapin, seconded by Commissioner
Price, it was unanimously
RESOLVED that this Board hereby
authorizes the Administrator to
prepare specifications and accept
bids for the purchase of a fire
hose for Engine #51 as appropriated
in the 1990 Fire Department
budget.
There being no other business to cane before this Commission, on
motion by Commissioner Price, seconded by Commissioner McGarr, the
meeting was unanimously declared adjourned at 8:40 p.m.

At this time Supervisor Silverstone asked that the order of the
Agenda be changed and that a report on Davids Island be added.
Steve Silverberg, Counsel on the Davids Island proposal, proceeded
to report and update, noting the various stages of activity which
will follow within the next several months and noting also, that no
copies of the Final Envirormtental Impact Statement have been
received yet. Following some discussion, on motion by Councilwoman,
Price, seconded by Councilman McGarr, it was unanimously
RESOLVED, that this Board hereby
authorizes Steven Silverberg, as
Counsel for the consortium formed
by Pelham, LarcYmont Village and
Town of Mamaroneck, to move forward
and continue with the environmental
study and work to be done within
the coming months with regard to
Davids Island.
At this time the regular order of the Agenda was resumed.
AFFAIRS OF THE TOWN
1. Appointment - Conservation Advisory Commission
On motion by Councilwoman Price, seconded by Councilman Chapin,
it was unanimously
RESOLVED, that this Board hereby
reappoints Charles Bernstein of
Port Drive, Mamaroneck Village,
for another two-year teen of
office on the Conservation Advisory
commission.
At this time the order of the Agenda was changed and the Supervisor
advised that two resumes had been received for Civil Officers.
Councilwoman Price briefly described their backgrounds and, upon her
motion, seconded by Councilman Chapin, it was unanimously
RESOLVED, Joseph Mitchell of
Fenimore Road is hereby appointed
as a Civil Officer for the Town
of Mamaroneck, to serve a term
of office effective immediately
and terminating on December 31, 1990;
and be it further
RESOLVED, that Daniel J. Tutolo
of Laurel Avenue is hereby appointed
as a Civil Officer for the Town of
Mamaroneck to serve a tern of office
effective immediately and terminating
on December 31, 1990.

Councilman Chapin commented that people on the Traffic Committee
have served admirably in a function which is sometimes demanding,
often thankless and always important. Thereafter, on motion by
Councilman Chapin, seconded by Councilman McGarr, it was unanimously
RESOLVED, that the terms of office
for the Traffic Committee be changed
to a period of three years, with these
teams being staggered so they will not
all expire at the same time;
and be it further
RESOLVED, that the following persons
be reappointed to the Traffic Committee
of the Town of Mamaroneck, for the term
of office as indicated:
Leslie Schlam of Fern Road, one year,
expiring January 1991;
Ned Ryan of West Garden Road, one year,
expiring January 1991;
Dennis Kenny of Lookout Circle, two
years, expiring January 1992;
Anthony Math of Washington Square, two
years, expiring January 1992;
Martin Zavell of Maple Hill Drive, as
Chairman for a period of two years,
expiring January 1992;
Richard Mari of Larchmont Acres, three
years, expiring January 1993;
Rosemary Magazino of Murray Avenue,
three years, expiring January 1993.

At this time the regular .order of the Agenda was resumed and Item
No. 2 under AFFAIRS OF THE TOWN was taken up.
2. Authorization - Certiorari Settlements
Following explanation by the Administrator, on motion by
Councilman Chapin, seconded by Councilwoman Price, it was
unanimously
RESOLVED, that in accordance with
teams recommended by Appraisal
Consultants, Inc. of White Plains,
this Board hereby authorizes the
settlement of certiorari proceeding
-448 Mamaroneck Avenue, Block 907
Lot 22, vs. Town of Mamaroneck for
reduction of the 1988 assessment

and be it further
RESOLVED, that in accordance with
terms reomutended by Appraisal
Consultants, Inc. of White Plains,
this Board hereby authorizes the
settlement of certiorari proceeding
-1910-12 Palmer Avenue, Block 606
Lot 435, vs. Town of Mamaroneck for
assessment years 1984 through 1988.
3. Petition to Change Zoning-Byron Place
The Supervisor called upon William Maker, who represents the
owner of property on Byron Place. He presented a site plan
indicating a building his client would like to construct and
explained that this property abuts the utility and garage area
that services the municipal needs of the Town, and if it were
rezoned to 'ILI" (Light Industry) from IIBII (Business) it would
meet all dimensional requirements of that district and could be
built without having to obtain variances of any kind. He also
requested that the Town Board declare itself lead agency
pursuant to the State Environmental Quality Review Act.
Discussion ensued among the Board and Mr. Maker was informed
that it is mandatory that this matter be first referred to the
Planning Board. Councilwoman Price noted that the Town Board
would reserve the decision relating to lead agency until the
Planning Board has given its report to them, since the Planning
Board, itself, may wish to declare itself lead agency.
Thereafter, on motion by Councilwoman Silverstone, seconded by
Councilman Chapin, it was unanimously
RESOLVED, that this Board hereby
makes the mandatory referral of
the request for rezoning of Byron
Place, Section: 1 Block 132
Lot: 410 to the Town of Mamaroneck
Planning Board.
At this time Supervisor Silverstone recognized Assemblyman Ron
Tocci, who spoke briefly about the proposals made by the Thruway
Authority to modify the exit ramp on Mamaroneck Avenue, noting that
although it is in the Village of Mamaroneck, he is certain that
surrounding ceammnities may be interested and, he emphasized, it is
not final, so that it could be another year or two before it is
settled. He spoke also about the budget, and the Supervisor
questioned him about the revenue sharing from the State, mentioning
that this could have an impact on the property taxes of the
community. He reassured her that this is not being eliminated, at
least not during this.year.

4. Set Public Hearing Date
- Amendments to Zoning Ordinance-Master Plan
- Mandatory Newspaper Recycling Ordinance
- No Parking Ordinance-Premium Conservation Area
On motion by Councilwoman Price, seconded by Councilman McGarr,
it was unanimously
RESOLVED, that this Board hereby
sets Wednesday, February 21, 1990
as the date for a Public Hearing
on the proposed amendments to the
zoning ordinance with reference to
the Master Plan update;
and be it further
RESOLVED, that this Town Board
hereby declares itself as the Lead
Agency, and that these zoning
amendments are an unlisted action
having no impact on the environment
under State or Local Law, therefore
being a negative declaration;
and be it further
RESOLVED, that the Town Clerk be,
and she hereby is authorized to
publish in an official newspaper,
of the Town, the Notice of said
Hearing as required by law.
Following a very lengthy discussion, on motion by Councilman
Chapin, seconded by Councilwoman Price, it was unanimously
RESOLVED, that this Board hereby
sets Wednesday, March 7, 1990 as
the date for a Public Hearing on
a proposed Mandatory Newspaper
Recycling ordinance;
and be it further
RESOLVED, that the Town Clerk be,
and she hereby is authorized to
publish in an official newspaper
of the Town, the Notice of said
Hearing as required by law.
The Administrator explained that the Traffic Cmumi.ttee had
recommended this ordinance and, following some discussion among
the Board, on motion by Councilwoman McGarr, seconded by
Councilwoman Price, it was unanimously
RESOLVED, that this Board hereby
sets Wednesday, March 7, 1990 as
the date for a Public Hearing on
a proposed traffic regulation
that no parking be permitted at
any time on either side of Dillon
Road at the entrance to the Premium
Conservation Area, and that this
area be designated a IFIbw-Away"
zone,;

and be it further
RESOLVED, that the Town Clerk be,
and she hereby is authorized to
publish in an official newspaper
of the Town, the Notice of said
Hearing as required by law.
5. Authorization Westchester County Bus Shelter Agreement
On motion by Councilman Chapin, seconded by Councilwoman Price,
it was unanimously
RESOLVED, that this Board hereby
authorizes the Town Administrator
to execute the bus shelter
agreement with the County of
Westchester.
6. Authorization - Transfer of Funds-Telephone Equipment
on motion by Councilman McGarr, seconded by Councilman Chapin,
it was unanimously
RESOLVED, that this Board hereby
authorizes transfer of $2,500 for
purchase and installation of three
34 button telephone sets from A T
& T to Account #A1650.402-Telephone
Installation.
7. Authorization - Accept Bids Various Equipment and Projects
on motion by Councilman McGarr, seconded by Councilwoman Price,
it was unanimously
RESOLVED, that this Board hereby
authorizes the Town Administrator
to prepare specifications and
accept bids for the following:
1. Replacement of traffic signal
controller-Palmer Avenue and
Richbell Road.
2. Resurfacing of roads.
3. Sidewalk restoration
4. Refuse collection vehicle.
5. Heavy duty four-wheel drive
dump truck.

8. Resolution - Closing of Bars
This item was held over.
9. Authorization - Use of Voting Machines
The Town Clerk explained the requests made by both the Village
of Larchmont and the Village of Mamaroneck, after which, on
motion by Councilwoman Price, seconded by Councilman Chapin, it
was unanimously
RESOLVED, that this Board hereby
authorizes the use of ten voting
machines by the Village of
Larchmont on March 20, 1990;
and be it further
RESOLVED, that this Board hereby
authorizes the use of seventeen
voting machines by the Village
of Mamaroneck on March 20, 1990;
and be it further
RESOLVED, that the Village of
Mamaroneck is hereby granted use
of the Town Court Room for
conducting of their elections.
10. Designation of Delegate to Association of Towns Meeting
On motion by Councilman McGarr, seconded by Councilwoman Price,
it was unanimously
RESOLVED, that this Board hereby
designates the Town Supervisor
as the Delegate for the Town of
Mamaroneck at the Association of
Towns Meeting to be held in New
York City on February 18-21, 1990.
At this time, the Supervisor announced that another item had been
added to the Agenda.
11. Authorization - Municipal Project Application
on motion by Councilwoman Price, seconded by Councilman McGarr,
it was unanimously
RESOLVED, that this Board hereby
authorizes the Supervisor of the
Town of Mamaroneck to execute the
Municipal Project Application for
State Aid to Recreation with the
New York State Division for Youth
State Aid.

WRITTEN COMMUNICATIONS
ORAL COMMUNICATIONS
There were no written or oral cognmmications to costae before the
Board at this time.
THE SUPERVISOR
Supervisor Silverstone commented that she had received two
communications regarding the blinker light on Rockingstone and
Mountain Avenue. She stated that she would respond to them and keep
them on record to see what may develop concerning this matter, and
some discussion ensued among the Board about the matter.
REPORTS OF THE TOWN CLERK
The Town Clerk submitted the Annual Report of the Building
Department for the year 1989.
APPROVAL OF MINUTES - December 6, 1989
- December 20, 1989
The minutes of the Regular Board Meeting of December 6, 1989 were
approved with three corrections.
The minutes of the Regular Board Meeting of December 20, 1989 were
approved with two corrections and one change.
ADJOURNMENT
I
There being no further business to owe before the Board, on motion
by Councilwoman Price, seconded by Councilman McGarr, the meeting
was unanimously declared adjourned into Executive Session to discuss
matters of personnel, at 10:15 p.m.
