Present were the following members of the Board: Supervisor Caroline Silverstone Councilman Stephen Chapin Councilwoman Elaine Price Councilman John McGarr Councilwoman Kathleen Tracy O,Flinn Also present were: Stephen V. Altieri, Town Administrator Eric S. Zaidins, Counsel to the Town Carol A. Acocella, Deputy Town Clerk CALL TO ATTENTION supervisor Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Silverstone at 8:30 - p.m" in the Court Roam. Civil Officers: On motion by Councilman Chapin, seconded by Councilman McGarr, it was unanimously RESOLVED, that Jay Reynolds of Blossom Terrace is hereby appointed as Civil Officer of the Town of Mamaroneck to serve a team of office effective January 1, 1990 and terminating December 31, 1990. Conservation Advisory Commission: On motion by Councilman McGarr, seconded by Councilwoman Price, it was unanimously RESOLVED, that Sandy Feldman of Pryer Lane is hereby appointed as a member of the Conservation Advisory Commission, to serve a term of two years, effective January 1, 1990 and terminating on December 31, 1991; and be it further RESOLVED, that Kevin Ryan of Beverly Place, Larchmont Village be, and hereby is appointed to an additional year of membership on the Conservation Advisory Commission and is hereby appointed Chairman of this Commission for a tern of two years teami_hating December December 31, 1991; and be it further RESOLVED, that Herbert Calman of Seven Oaks Lane is hereby appointed as a member of the Conservation Advisory Commission, to serve a term of two years, effective January 1, 1990 and terminating December 31, 1990. 4 193 January 3, 1990 Board of Plumbers: On motion by Councilwoman o-rFlinn, seconded by Councilman McGarr, it was unanimously RESOLVED, that Dennis Tortorella of Fernw+ood Road is hereby appointed a member of the Board of Plumbers for a tem of two years commencing January 1, 1990 and ternL_nating December 31, 1991; and be it further RESOLVED, that the Town Board of the Town of Mamaroneck does hereby appoint Dr. Lawrence Lerman to the Board of Plumbers to serve at the pleasure of the Board. Comptroller: On motion by Councilwoman Price, seconded by Councilman Chapin, it was unanimously RESOLVED, that Carmine DeLuca is hereby appointed Comptroller of the Town of Mamaroneck for a tern of two years commencing January 1, 1990 and terminating on December 31, 1991. Receiver of Taxes: On motion by Councilwoman Price, seconded by councilman Chapin, it was unanimously RESOLVED, that Carmine DeLuca is hereby appointed Receiver of Taxes for the Town of Mamaroneck for a tern of two years commencing January 1, 1990 and terminating on December 31, 1991. Superintendent of Highways: On motion by Councilman Chapin, seconded by councilman McGarr, it was unanimously RESOLVED, that P. Thomas Leddy is hereby appointed Superintendent of Highways for the Town of Mamaroneck for a tern of two years commencing January 1, 1990 and terminating on December 31, 1991. 5 194 January 3, 1990 Police Pension Fund - Trustees: On motion by Councilwoman Price, seconded by Councilwoman OIFlinn, it was unanimously RESOLVED, that Caroline Silverstone and John McGarr be, and hereby are appointed Trustees of the Police Pension Fund of the Town of Mamaroneck for the year 1990. Police Pension Fund - Treasurer: On motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that C'anni ne A. DeLuca be, and hereby is appointed Treasurer of the Police Pension Fund of the Town of Mamaroneck for the year 1990. Registrar of Vital Statistics: On motion by Councilwoman O'Flinn, seconded by Councilman Chapin, it - was unanimously RESOLVED, that Patricia A. DiCioccio is hereby appointed Registrar of Vital Statistics for a tear of office of two years commencing January 1, 1990 and terminating on December 31, 1991, without additional salary compensation. Deputy Registrar of Vital Statistics: On motion by Councilman McGarr, seconded by Councilwoman Price, it was unanimously RESOLVED, that Carol A. Acocella is Hereby appointed Deputy Registrar of Vital Statistics for a tern of office of two years commencing January 1, 1990 and tenni rating on December 31, 1991, without additional salary compensation. Deputy Town Clerk: On motion by Councilman McGarr, seconded by Councilwoman Price, it was unanimously RESOLVED, that in accordance with recoamiendation of the Town Clerk, Carol A. Acocella be, and hereby is appointed Deputy Town Clerk. 6 195 January 3, 1990 Confidential Secretary to the Supervisor: Supervisor Caroline Silverstone hereby appointed Lillian Robustelli as her Confidential Secretary. Budget Officer: Supervisor Caroline Silverstone hereby appointed Town Administrator, Stephen V. Altieri as Budget Officer. SUPERVISORIS APPOINTMENT: Deputy Supervisor Town Supervisor, Caroline Silverstone, pursuant to her own recoamnendation, hereby appointed Stephen. Chapin as Deputy Town Supervisor of the Town of Mamaroneck, to serve in the absence of the Town Supervisor. DESIGHMON OF: Town Board Meetings Official Newspapers Depositories of Funds and Bank Signatures Town Board Meetings: On motion by Councilwoman Price, seconded by Councilman Chapin, it was unanimously RESOLVED, that the Regular Meetings of the Town Board will be held in the Court Room of the Town Center, 740 West Boston Post Road, Mamaroneck, at 8:15 p.m. on the first and third Wednesdays of each month except during the months of July and August, during which months meetings will be held on Wednesday, LTuly 18, 1990 and August 15, 1990; and be it further RESOLVED, that said meetings, dates and places may be changed at the pleasure of the Board upon adequate notice being given. Official Newspaper: On motion by Councilman McGarr, seconded by Councilman Chapin, it was unanimously RESOLVED, that The Daily Times and The Soundview News be, and hereby are designated as the official newspapers of the Town of Mamaroneck for the purpose of publishing legal notices during 1990. 7 196 January 3, 1990 Depositories of Funds and Bank Signatures: On motion Councilwoman Price seconded Councilman McGarr, it by r by r was unanimously RESOLVED, that the following banks and trust ccagianies are hereby designated as depositories for funds of the Town of Mamaroneck for the year 1990 to be continued in their present status: The Bank of New York County Trust Region, Mamaroneck; The Chasse Manhattan Bank, N.A., Larchmont; Barclays Bank of New York, Mamaroneck; Marine Midland Bank, Mamaroneck; Sound Federal Savings and Loan Association, Mamaroneck; and Chemical Bank, New Rochelle; and be it further RESOLVED, that all authority heretofore granted to withdraw finds from, and to draw checks, drafts and other orders upon the Town of Mamaroneck accounts maintained at the aforesaid banks hereby is rescinded and revoked - and hereafter such withdrawals checks, drafts and other orders shall be authorized when signed by signature or facsimile signature of the Town supervisor or Deputy Supervisor and Comptroller, or Deputy Receiver of Taxes/Deputy Comptroller; and be it further RESOLVED, that all withdrawals, checks, drafts and other orders relative to the cm mmity Services Discretionary Fund located at the Bank of New York shall be authorized when signed by the signatures of Helen Mohan, Director of community Services, and Stephen V. Altieri, Town Administrator. AFFAIRS OF THE TOWN 1. Authorization - Westchester Shore Humane Society Contract j Following explanation by the Administrator and some discussion among the Board, on motion by Councilman McGarr, seconded by Councilwoman Price, it was unanimously 8 197 January 3, 1990 RESOLVED, that this Board hereby authorizes the Torun Administrator to enter into Contract with the Westchester Shore Humane Society, _ Inc. to operate a dog patrol for violations of Ordinance of the Town of Mamaroneck adopted February 7, 1932, which is known as Chapter 6, Section 4 of the Code of the TOWN OF MNUUnREK. 2. Authorization - Deputy Town Clerk Signature On motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that Carol A. Acocella be, and she hereby is authorized to sign on the Town Clerks checking account with The Bank of New York, Mamaroneck, New York. At this time the order of the Agenda and Item No. 4 under AFFAIRS OF THE TOWN was taken up. 4. Resolution Re: Real Estate Closing-Larchmont Motel Following explanation by the Town Administrator, on motion by Councilwoman Price, seoonded .by Councilman Chapin, the following resolution was unanimously adopted: WHEREAS, the Town Board of the Town of Mamaroneck has previously authorized the purchase of the Larchmont Motel for the scan of $2,350,000.00; and WHEREAS, a closing is scheduled to complete the purchase of the Larchmont Motel; NOW, THEREFORE BE IT RESOLVED, that Town Administrator, Stephen V. Altieri is hereby authorized to execute all documents necessary to carry out the purchase of the Larchmont Motel and to issue payment for the purposes of carrying out the purchase of the Motel for $2,350,000.00. 9 January 3, 1990 At this time the regular order of the Agenda was resumed. 3. Bond Resolution - Computer Equipment Purchase The Administrator reported and updated, some discussion followed, and on motion by Councilvanan Price, seconded by Councilman McGarr, the following resolution was unanimously adopted to-wit: BOND RESOLUTION DATED JANUARY 3, 1990 A RESOLUTION AUTHORIZING THE ISSUANCE OF $160,000 SERIAL BONDS OF THE TOWN OF MAMAiRONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY THE COST OF THE PURCHASE OF COMPUTER EQUIPMENT FOR SAID TOWN. WHEREAS, all conditions precedent to the financing of the capital project hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; and WHEREAS, it is now desired to authorize the financing of such capital project; Now, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. For the specific object or purpose of paying the cost of the purchase of computer equipment for the Town of Mamaroneck, Westchester County, New York, there are hereby authorized to be issued $160,000 serial bonds of said Town pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the maximum estimated cost of the aforesaid specific object or purpose is $160,000 and that the plan for the financing thereof shall consist of the issuance of the $160,000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. Further details concerning said bonds will be prescribed in a further resolution or resolutions of this Town Board. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is five years, pursuant to subdivision 32 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will not exceed five years, and that no down payment is required therefor pursuant to Section 107.00(d) (5) of the Local Finance Law. Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section S. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such obligations 10 199 January 3, 1990 as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year. Section 6. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 7. This resolution, which takes effect immediately, shall be published in full in The Daily Times, the official newspaper, together with a notice of the Town Clerk in substantially the foam provided in Section 81.00 of the Local Finance Law. The question of the adoption of the foregoing resolution was duly put to a vote on roll call which resulted as follows: Councilwoman O'Flinn VOTING Aye Councilman McGarr VOTING Aye Councilwoman Price VOTING Aye Councilman Chapin VOTING Aye Supervisor Silverstone VOTING Aye The resolution was thereupon declared duly adopted. WRITTEN COMMUNICATIONS ORAL COMMUNICATIONS There were no written or oral communications to came before the Hoard at this time. TOWN CLERK Reports The Town Clerk presented the Building and Plumbing Report for the month of December 1989. THE SUPERVISOR The Supervisor reported that there are openings in the Coastal Zone Management Commission and the Human Rights Commission. 11 200 January 3,1990 ADJOUF2m" There being no further business to came before the Hoard, on motion by Councilwoman Price, seconded by Councilman Chapin, the meeting was unanimously declared adjourned into a work session to discuss zoning implementation of the Master Plan and the proposed newspaper recycling law.
